1982-102 265L NO - AN ORDINANCB AMENDING THE ZONING MAP OF THE CITY OF DENTON, TEXAS, AS SAME WAS ADOPTED AS AN APPENDIX TO THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS, BY ORDINANCE NO 69-1, AND AS SAID MAP APPLIES TO PART OF LOT 1, BLOCK 2 AND ALL OF LOTS 2-6, BLOCK 2 AND ALL OF LOTS 1-7, BLOCK ~ OF THE SOUTNMONT SUBDIVISION IN THE CITY OF DENTON, TEXAS, AND MORE PARTICULARLY DESCRIBED HEREIN, AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS SECTION I The Zoning Classification and Use designation of the following described property, to-wit Ail that certain tract or parcel of land s~tuated ~n the C~ty and County of Denton, Texas, being a part of Lot 1, Block 2 and all of Lots 2~6. Block 2 and all of Lots 1-7, Block 3 of the Southmont Subd~vls~on ~n the C~ty of Denton, Texas ~s hereby changed from Single-Family "SF-16" D~str~ct Classifi- cation Use to Planned Development "PD" D~str~ct Classification and Use under the Comprehensive Zoning Ordinance of the C~ty of Denton, Texas The Zoning Map of the C~ty of Denton, Texas, adopted the 14th day of January, 1969, as an Appendix to the Code of Ordinances of the C~ty of Denton, Texas, under Ordinance No 69-1, be, and the same ~s hereby amended to show such change ~n D~strict Classification and Use, subject to the s~te plan attached hereto and the follow~ng conditions 1 The property will be developed ~n accordance w~th the approved s~te plan Ail subd~ws~ons and resubd~ws~ons shall conform to C~ty of Denton subd~ws~on regulations and an official copy of deed restrictions and covenants shall be flied with the C~ty and County of Denton, Texas 3 The one hundred and ten foot (110') port.on of Southmont Drive designated for closing on the official site plan shall be qu~tclaimed in accordance w~th City of Denton procedures and other legal requirements 4 Fencxng must be erected so that xt does not obstruct vxsibxhty and is xn conformance w~th City of Denton codes and ordinances 5 Failure by the homeowner's assoc~atxon to ma~ntaxn areas dxrectly related to the draxnage of the property to the degree as judged adequate by the Cxty Engxneer shall result in the following procedure a The c~ty shall notxfy the homeowner's assocxa- txon twenty-four (24) hours ~n advance of cxty maintenance crews beginnxng operations so that any hazards xn the desxgnated areas may be elxminated PAGE ONE b If hazard is not corrected in the twenty-four (24) hour period, the ctty crews will work to remove the hazard c After city crews have completed all the work needed to remove the hazard, charges will be assessed to the homeowner's association based on the following I Equipment Cost X 1 S 2 Labor Cost X I 23 3 Overhead 15% overhead on entire charge 5 Developer shall pay any expenses for relocation of any utilities within this development SECTION II That the City Council of the City of Denton, Texas, hereby finds that such change is in accordance with a comprehensive plan for the purpose of promoting the general welfare of the City of Denton, Texas, and with reasonable consideration, emong other things for the character of the district and for its peculiar suitability or particular uses, and with a view to conserving the value of the buildings, protecting h~an lives, and encouraging the most appropriate uses of land for the maxlm~ml benefit to the City of Denton, Texas, and its c~tlzens SECTION III That this ordinance shall be in full force and effect immediately after its passage and approval, the required public hearings having heretofore been held by the Planning and Zoning Commission and the C~ty Council of the City of Denton, Texas, after giving due not~ce thereof PASSED AND APPROVED this the 7?~-~day of December, 1982 ATTES VICKI P/I~STLING DEPUTY CITY SI~CRETAI~Y CITY OF DENTON, TEXAS APPROVBD AS TO LEGAL FORM C J TAYLOR, JR , CITY ATTORNEY CITY OF DENTON, TEXAS PAGE TWO I® e ®
