AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF DENTON,
TEXAS, AS SAME WAS ADOPTED AS AN APPEND IX TO THE CODE OF
ORDINANCES OF THE CITY OF DENTON, TEXAS, BY ORDINANCE NO 69-1,
AND AS SAID MAP APPLIES TO APPROXIMATELY 30 ACRES OF LAND OUT OF
THE M E P & P R R CO SURVEY, ABSTRACT NO 1473 OF DENTON
COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED HEREIN, AND
DECLARING AN EFFECTIVE DATE
THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS
SECTION I
The Zoning Classification and Use designation of the
following described property, to-w~t
Being a tract or parcel of land lying ~n the M E P & P R R Co
Survey, Abstract No 1473, Denton County, Texas, known as 701
Mockingbird Lane, City of Denton, Texas, and being part of a
tract conveyed bt W C Grant, Jr to J C W~lson, recorded ~n
Volume 335, Page 512 Deed Records of Denton County, Texas, and
being part of a tract conveyed to Leroy Whltlock by the
Veteran's Land Board of the State of Texas, recorded in Volume
383, Page 554 of said Deed Records, sa~d tract or parcel of land
being more particularly described by metes and bounds as follows
BEGINNING at a point ~n the west r~ght of way l~ne of
Mockingbird Lane a 38 0 foot w~de r~ght of way by measurement,
sa~d point being 1180 5 feet south of the south right of way
line of Audra Lane, sa~d beginning point being the intersection
point of the said west r~ght of way line of Mockingbird Lane

in accordance with building code and zoning

The Zoning Map of the City of Denton, Texas, adopted the
14th day of January, 1969, as an Appendix to the Code of
Ordinances of the City of Denton, Texas, under Ordinance No
69-1, be, and the same is hereby amended to show such chang~ in
District Classification and Use
SECTION II
That the City Council of the C~ty of Denton, Texas, herebv
f~nds that such change ~s ~n accordance with a comprehensive
plan for the purpose of promoting the general welfare of the
City of Denton, Texas, and with reasonable consideration, among
other things for the character of the d~strlct and for ~ts
peculiar suitability or particular uses, and with a view to
conservlng the value of the bulldlngs, protecting human lives,
and encouraging the most appropriate uses of land for the
maximum benefit to the City of Denton, Texas, and ~ts cltlzen~
SECTION III
That this ordinance shall be ~n full force and effect
lmmed~ately after its passage and approval, the required public
hearings having heretofore been held by the Planning and Zon~nq
Commission and the C~ty Council of the City of Denton, Texas,
after giving due notice thereof

WHEREAS, Mr Art Kramer, has applied for approval ora detmled plan for 16 0453 acres
descnbedlm Exhbit A, and located within Planned Development 34 (PD-34) a planned development
district established by Ordinance 82-96, and
WHEREAS, on March 12, 1997, the Planmng and Zomng Conumssion recommended
approval of the requested detml plan, and
WHEREAS, the City Council finds that this detailed plan will be m compliance with th~
Denton Development Plan, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That Ordinance No 82-96 as it relates to Planned Development District 34
(PD.34),ia planned development district comprising 29 2125 acres of land, is hereby amended with
respect tO 16 0453 acres of land located therein, and more particularly described in the legal
descnptl0n attached hereto and incorporated herein as Exhibit A, by adopting a detail plan for said
16 0453 acre parcel, attached hereto and incorporated herein as Exlublt B for all purposes
SECTION II That the prowslons of fins ordinance, as they apply to the 16 0453 acres
descnbec~ by Exhibit .4, govern and control over any contllctmg provmons of Ordinance No 82-96
as It relates to the subject property, but all the prowsions of smd ordinance as it applies to the
remmnder of the planned development district not herein amended shall continue in force and effect
and shall I apply to the remainder of sa~d district
~ That a copy of this ordinance shall be attached to Ordinance No 82 96
shovnng the amendment herein approved
~ That any person violating any provision of flus ordinance shall, upon
conv~ctl0n, be fined a sum not exceeding $2,000 00 Each day that a provision ofth~s ordinance is
violated shall constitute a separate and distinct off'ense
