1982-054 AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF DENTON, TEXAS, AS SAME WAS ADOPTED AS AN APPENDIX TO THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS, BY ORDINANCE NO 69-1, AND AS SAID MAP APPLIES TO 3 359 ACRES OF LAND, MORE OR LESS, AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS SECTION I The Zoning Classification and Use designation of the following described tracts of land, to-wit All that certain lot, tract or parcel of land lying and being situated in the City and County of Denton, State of Texas, and being part of the B B B & C R R Survey, Abstract No 185, and being part of Lot Nos 1, 2, 4, 5, 10, 11, 12, 13, 14, 16, 17 and 18, Block 1 of the C C Bell Addltlon and more particularly descrlbed as follows BEGINNING at the northwest corner of Lot 5, C C Bell Addition, same being the intersection of the south right of way line of Withers Street with the east right of way line of Bell Avenue, THENCE east along the north boundary l~ne of said Lot 5, same belng the south right of way line of W~thers a distance of 150 feet to the northeast corner of sa~d Lot 5, same being the northwest corner of Lot 10, C C Bell Addition, THENCE south along the east boundary line of said Lot 5 a distance of 40 feet to a point for a corner, THENCE east a distance of 150 feet to a point in the east boundary line of Lot 10, same sa~d point lying in the northwest r~ght of way l~ne of M~ngo road, THENCE south 30° 28' west along the northwest right of way line of Mingo Road a distance of 392 26 feet to a point for a corner in the south boundary line of Lot 14, THENCE west along the south boundary l~ne of Lot 14 passing the southwest corner of Lot 14 and the southeast corner of Lot 1 a distance of 279 77 feet to a point for of Lot 1 and 2, same being the east right of way line of Bell Avenue, a distance of 154 82 feet to a point for a corner, THENCE east a distance of 150 feet to a point for a corner in the east boundary line of Lot 2 and the west boundary line of Lot 13, THENCE north along the west boundary l~ne of Lot 11, 12 and 13 and the east boundary line of Lot 2, 3 and 4 a distance of 200 18 feet to a point for a corner, THENCE west a distance of 150 feet to a point for a corner in the west boundary line of Lot 5 and the east right of way line of Bell Avenue, THENCE north along the west boundary line of Lot 5 and the east right of way line of Bell Avenue a distance of 150 5 feet to the place of beginning and containing 3 359 acres of land, more or less ls hereby changed from General Retail "GR" and Mult~-Famlly "MF-i" Distr~cts Classif~cation Use with Specific Use Conditions to Planned Development "PD" District Classification and Use under the Comprehensive Zoning Ordlnance of the City of Denton, Texas subject to the following conditions and restrict~ons to-w~t 1 Permitted office and general retail land uses shall conform with land uses in the off,ce and general retail categories as specified in the use schedule of the City of Denton Zoning Ordinance, 2 General retail land use for the entire development shall not exceed twenty-eight percent (28%) of the gross floor area, 3 The wooden fence indicated on the site plan shall be slx feet (6') in height and shall be erected before ~ssuance of any certificate of occupancy, 4 All structures w~thln the development shall be no more than one (1) story in height, 5 No portable advertising signs are permitted within this planned development distr~ct, 6 A maximum of three (3) detached permanent signs will be permitted to advertise the office/rental center The signs shall observe a m~nlmum setback of twenty-f~ve feet (25') from the property lines of the development and each such sign shall be no larger than thirty-six square feet (36') in area and a maximum height of slx feet (6') as measured from the ground, 7 Each of the office/rental clusters is permitted to have no more than one (1) detached sign for identification purposes Each of these signs shall be located between the structure and the parallel sidewalk and shall be no greater than twenty-five square feet (25') in area with a maximum height of slx feet (6') as measured from the ground, Z-1536-TOM STINGLEY-PAGE TWO 8 Resubdivision of the property in accordance with City of Denton subdivision regulations is required prior to development, 9 The specific shape of the buildings shown on the site plan may be varied as long as the overall square footage does not exceed 35,000 square feet The Zoning Map of the City of Denton, Texas, adopted the 14th day of January, 1969, as an Appendix to the Code of Ordinances of the City of Denton, Texas under Ordinance No 69-1, be, and the same is hereby amended to show such change in District Classification and Use, with the conditions specified SECTION II That the City Council of the City of Denton, Texas hereby finds that such change is in accordance with a comprehensive plan for the purpose of promoting the general welfare of the City of Denton, Texas, and with reasonable consideration, among other things for the character of the district and for its peculiar suitability or particular uses, and with a view to conserving the value of the buildings, protecting human lives, and encouraging the most appropriate uses of land for the maximum benefit to the City of Denton, Texas, and its citizens SECTION III That this ordinance shall be in full force and effect immediately after its passage and approval, the required public hearings having heretofore been held by the Planning and Zoning
