1982-051 NO 14, 15, 16 AND THE SOUTHERLY ONE-HALF OF LOT 17 AS SHOWN ON THE PLAT OF THE C C BELLS ADDITION TO THE CITY OF DENTON A~ RECORDED IN VOLUME "U", PAGE 86 OF THE DEED RECORDS OF DENTON COUNTY, TEXAS, PROVIDING FOR THE REVERSION OF THE FEE TO SAID PROPERTY, RETAINING WATER, SEWAGE AND DRAINAGE EASEMENTS THEREIN, AUTHORI2ING NECESSARY LEGAL DOCUMENTS TO BE PREPARED AND EXECUTED, AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City Council of the City of Denton, Texas, has been requested by the owners of ad]olnlng property to vacate and close that unused portion of Vine Street hereinafter described, and WHEREAS, the Clty Council of the City of Denton, Texas, is of the opinion that the best interest and welfare of the public will be served by vacating and closing that portion of said street hereinafter described, reserving easements there~n for water, sewer and drainage, NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I That, sub]ect to reservations of easements for water, sewer and drainage, the following described portions of Vine Street are hereby closed and permanently vacated as a public street and right-of-way of any kind or character forever All that certain lot, tract or parcel of land lying and being situated in the BBB & CRR COMPANY SURVEY, ABSTRACT NO 185 in the City and County of Denton, and being a portion of Vine Street as shown on the Plat of the C C Bells Addition to the C~ty of Denton as recorded 1n VOLUME "U", Page 86 of the Deed Records of Denton County, Texas, and being more particularly described as follows BEGINNING at a point for corner on the West Boundary line of Vine Street and the East Boundary of Lot 14 of the C C Bell Addition, said point being 34 38 feet North of the original Southeast corner of said Lot 14, THENCE North 02© 06' 05" West along the West Boundary line of V~ne Street and the East Boundary line of said Lot 14, 222 99 feet to a point for corner, THENCE South 87© 50' 33" East 40 10 feet to point for corner on the East Boundary of Vine Street and the West Boundary line of Lot 17 of the C C Bell Addition, THENCE South 02o 06' 05" East along the Fast Boundary line of Vine Street 152 feet to a point for corner, THENCE South 280 21' 19" West 78 gl feet to the POINT OF BEGINNING SECTION II That the ownership of the fee of that portion of V~ne Street closed and vacated here~n shall revert to the adjacent property owners as provided by law, subject to retention by the C~ty of easements for water, sewer and drainage in, under, upon and across any and all parts of the property described herein SECTION III That portion of the street here~n described being vacated and closed is made subject to all existing zoning regulations, deed restrictions if any, existing easement rlqhts of others whether apparent or not, and the conveyance herein shall be construed to extend only to that interest the govern~nq body of the City of Denton may legally and lawfully vacate and close SECTION IV That the City Attorney is hereby authorized to prepare and deliver whatever legal documents are regulred with regard to the area vacated and conveyed herein and the Mayor is authorized to execute a Quitclaim Deed to the adjacent property owners, attested to by the City Secretary, provided, however, the C~ty of Denton shall not be responsible for any closing costs whatsoever SECTION V That this ordinance shall become effective immediately after passage and approval PASSED AND APPROVED by the City Council on the{~day of Mav, 1982 ATTEST CI~RLOTT~ ALLEN, CITY SECRETARY CITY OF DENTON, TEXAS APPROVED AS TO LEGAL FORM C J TAYLOR, JR , CITY ATTORNEY CITY OF DENTON, TEXAS BY ~'
