1982-014AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF DENTON, TEXAS, AS SAME WAS ADOPTED AS AN APPENDIX TO THE CODE OF ORDINANCES OF THE CiTY OF DENTON, TEXAS, BY ORDINANCE NO 69-1, AND AS SAID MAP APPLIES TO APPROXIMATELY 16 6134 ACRES OF LAND, MORE OR LESS, AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS S~CTION I The Zoning Classification and Use designation of the following described tracts of land, to-wit BEING a tract of land situated in the John McGowan Survey, Abstract NO 797, Daniel Lambert Survey, Abstract No 784 and the J S Taft Survey, Abstract No 1256, Denton County, Texas and being more particularly described as follows COMMENCING at a point situated in the southerly line of said Loop 288 (a variable right-of-way) and the easterly line of Interstate Highway No 35-E (a variable rlqht-of-way), THENCE along the easterly line of said Interstate 35-E and departing the southerly line of said Loop 288 the following south 01o41'20'' east a distance of 70 71 feet to a point, south 34042'00'' east a distance of 226 60 feet to a point, south 42o00'59'' a distance of 90 60 feet to the point of beginning, THENC~ north 42o33'00'' east departing the aforementioned Interstate 35-E a distance of 145 00 feet to a point for a corner, THENCE north 86o43'17'' east a distance of 90 00 feet to a point of corner, THENCE north 05049'03'' east a distance of 95 00 feet to a point for a corner THENCE north 64045'00'' west a distance of 14 00 feet to a point for a corner THENCE north 25015'00'' east a distance of 170 17 feet to a point for a corner THENCE north 34o48'00'' east a distance of 136 00 feet to a point for a corner THENCE north 48002'34'' west a distance of 21 62 feet to a point for a corner THENCE north 41o57'26'' east a distance of 357 99 feet to a point for a corner THENCE north 60o43'46'' east a distance of 268 95 feet to a point of curvature to the left, Z-1526 - MR NEIL HILL - PAGE ONE SITE PLAN CONDITIONS 1 The area designated for retail use encompassing the building and parking area shall be developed in accord with the site plan Minor variations ~n building use or shape will be permitted when the building s~ze or land use Intensity is not ~ncreased Ma]or changes must be approved by the Planning and Zoning Commission and City Council 2 A mlnlmum twenty-five foot (25') setback from the property line shall be observed along the perimeter of the property The Zoning Map of the City of Denton, Texas, adopted the 14th day of January, 1969, as an Appendix to the Code of Ordinances of the C~ty of Denton, Texas under Ordinance No 69-1, be, and the same ~s hereby amended to show such change in Dlstr~ct Classification and Use, with the conditions specified SECTION II That the City Council of the City of Denton, Texas hereby f~nds that such change is ~n accordance with a comprehensive plan for the purpose of promoting the general welfare of the City of Denton, Texas, and with reasonable consideration, among other things for the character of the district and for 1ts peculiar suitability or particular uses, and w~th a v~ew to conserving the value of the buildings, protecting human l~ves, and encouraging the most appropriate uses of land for the maximum benefit to the City of Denton, Texas, and ~ts citizens SECTION III That th~s ordinance shall be ~n full force and effect ~mmedlately after its passage and approval, the required public hearings having heretofore been held by the Planning and Zoning Commission and the City Council of the C~ty of Denton, Texas, after giving due notice thereof PASSED AND APPROVED th~s the 26th day o~ January, 1982j ~IC~AR~D 04 STEWART, MAYORV CIT!
