1981-108 NO 81-108 AN ORDINANCE GRANTING A SPECIFIC USE PERMIT AND AMENDING THE ZONING MAP OF THE CITY OF DENTON, TEXAS, AS SAME WAS ADOPTED AS AN APPENDIX TO THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS, BY ORDINANCE NO 69-1, AND AS SAID MAP APPLIES TO PART OF LOTS 14 AND 15, WHEELER ADDITION AND KNOWN AS 1835 NORTH LOCUST, AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS SECTION I The Zoning Classification and Use designation of the following described property, to-w~t Part of Lots 14 and 15, Wheeler Addition, and is located along the west s~de of North Locust Street beginning approximately 100 feet south of the ~ntersect~on of North Locust Street and University Dr~ve, also known as 1835 North Locust Street as shown on the Tax Records of the City of Denton, Texas situated in the City of Denton, Denton County, Texas, which ~s classified as Neighborhood Service "NS" D~str~ct Classification Use under the Comprehensive Zoning Ordinance of the C~ty of Denton, Texas is hereby changed and a Sepclf~c Use Permit ~s hereby granted for the use of sald property for a Seafood Market and Restaurant without drlve-ln service, subject to the following conditions and restrictions to-w~t 1 The restaurant use shall be l~mlted to the ex~sting 21' X 37' building, 2 The maximum number of seats shall be limited to eighteen (18), 3 No permits shall be ~ssued for portable advertising s~gns at 1835 North Locust, the permanent s~gn s~ze shall be l~mlted to 3' X 3', 4Formal agreement shall be produced authorizing the use parking on the abutting lots to the north ~n addition to all uses authorized in a Neighborhood Service "NS" D~strict The development of the property shall be in substantial compllance with the site plan attached hereto and made a part hereof for all purposes The Zoning Map of the C~ty of Denton, Texas, adopted the 14th day of January, 1969, as an Appendix to the Code of Ordinances of the City of Denton, Texas under Ordinance No 69-1, be, and the same ~s hereby amended to show such change in Dlstr~ct Classification and Use SECTION II That the C~ty Council of the C~ty of Denton, Texas hereby finds that such change ~s in accordance with a comprehensive plan for the purpose of promoting the general welfare of the S-159-LEWIS C TUCKER-PAGE ONE City of Denton, Texas, and with reasonable consideratIon, amonq other things for the character of the dlstrlct and for its peculiar suitability or particular uses, and wlth a view to conservlng the value of the bulldlngs, protecting human l~ves, and encouraging the most appropriate uses of land for the maximum benefit to the City of Denton, Texas, and ~ts citizens SECTION III That th~s ordinance shall be ~n full force and effect ~mmedlately after its passage and approval, the required public hearlngs hav~ng heretofore been held by the Planning and Zonlng Commission and the City Council of the C~ty of Denton, Texas, after giving due not~ce thereof PASSED AND APPROVED this the 15th day of December, 1981 ITl O~ DE~TON, TEXAS CITY OF DENTON, TEXAS APPROVED AS TO LEGAL FORM C J TAYLOR, JR , CITY ATTORNEY CITY OF DENTON, TEXAS S-159-LEWIS C TUCKER-PAGE TWO
