AN ORDINANCE AMENDING THE ZONING ORDINANCE, APPENDIX B, ARTICLE 23,
SUBSECTION C(1) OF THE CODE OF ORDINANCEq OF THE CITY OF DENTON,
TEXAS, RELATING TO THE APPEAL PROCEDURE BEFORE THE BOARD OF
ADJUSTMENT, PROVIDING FOR A FILING FEE AND DECLARING AN EFFECTIVE
DATE
THE COUNCIL OF THE CITY OF DENTON, TEXAg, HEREBY ORDAINS
SECTION I
That Appendix B, Article 23, Subsection C(1) of the Code of
Ordinances of the City of Denton, Texas, is hereby amended so that
the same shall hereafter read as follows
APPENDIX B, ARTICLE 23C
(1) Appeals to the board of ad]ustment can be
taken by any person aggrieved, or by an officer, depart-
ment or board of the municipality affected by the
decision of the bu~ldlng ~nspector Such appeal shall
be taken with f~fteen (15) days after the decision has
been rendered by the building znspector, by filing with
the officer from whom the appeal as taken and w~th the
board of ad]ustment, a not~ce of appeal speclfyzng the
grounds thereof Such notice of appeal shall be accom-
panied by a fzllng fee in the amount of Fifty ($50 00)
Dollars, provided, however, that the board may wazve
such filing fee when ~t appears to the board that the
particular property is adversely affected by c~rcum-
stances created by the Czty of Denton, not by the
appellant, and that a special exception to the zoning
regulations be granted. The officer from whom the
appeal is taken shall forthwith transmit to the board
all the papers constituting the record upon which the
decision of the officer was based
S~CTION II
That Appendix B, Artlcle 23, Subsections C(2) and C(3) of
the Code of Ordinances of the C~ty of Denton, Texas, shall remain
unchanged
SECTION III
Th~s ordlnance shall become effective from and after ~ts date
of passage and approval /~% ~~
