1981-085 NO AN ORDINANCE BY THE CITY OF DENTON, TEXAS, DETERMINING AND ESTABLISHING THE MAXIMUM PRIMA FACIE SPEED LIMIT ON THAT CERTAIN PORTION OF DALLAS DRIVE BEGINNING AT A POINT APPROXIMATELY 900 FEET NORTH OF THE INTERSECTION OF DALLAS DRIVE AND TEASLEY LANE, THENCE IN A SOUTHERLY DIRECTION ON DALLAS DRIVE TO A POINT APPROXIMATELY 50 FEET NORTH OF ITS INTERSECTION WITH PIPING ROCK TO BE THIRTY- FIVE (35) MILES PER HOUR, DETERMINING AND ESTABLISHING THE MAXIMUM PRIMA FACIE SPEED LIMIT ON THAT CERTAIN PORTION OF DALLAS DRIVE BEGINNING AT A POINT APPROXIMATELY 50 FEET NORTH OF THE INTERSECTION OF DALLAS DRIVE AND PIPING ROCK, THENCE IN A SOUTHERLY DIRECTION ON DALLAS DRIVE TO A POINT APPROXIMATELY 500 FEET SOUTH OF ITS INTERSECTION WITH THE EAST FRONTAGE ROAD OF INTERSTATF HIGHWAY 35E TO BE FORTY-FIVE (45) MILES PER HOUR, PROVIDING A PENALTY OF A FINE NOT TO EXCEED TWO HUNDRED ($200 00) DOLLARS, REPEALING ORDINANCE NO 81-78, PROVIDING A SEVERABILITY CLAUSE, AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I Based upon an engineering and traffic Investigation, the City Council hereby determines that the reasonable and safe prima facle maximum speed limit on that certain portion of Dallas Dr~ve beginning at a point approximately 900 feet north of the intersection of Dallas Drive and Teasley Lane, thence in a southerly d~rect~on on Dallas Drive to a Dolnt approximately 50 feet north of ~ts ~ntersect~on with Piping Rock to be thirty-five (35) miles per hour SECTION II Based upon an eng~neerlng and traffic investigation, the City Council hereby determines that the reasonable and safe prima facle maximum speed llmlt on that certain portion of Dallas Dr~ve beginning at a point approximately 50 feet north of the lntersect~on of Dallas Drive and Piping Rock, thence a southerly d~rectlon on Dallas Dr~ve to a point approximately 500 Feet south of ~ts lntersect~on w~th the east frontaqe road of Interstate Highway 35E to be forty-flve (45) miles per hour SECTION III An ~ndlvldual adjudged guilty of exceeding th~s speed limit, shall be guilty of a m~sdemeanor, and punished by a f~ne not to exceed Two Hundred ($200 00) Dollars SECTION IV That if any section, subsection, paragraph, sentence, clause, phrase or word in this ordinance, or application thereof to any person or circumstances is held invalid by any court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of th~s ordinance, and the City Council of the City of Denton, Texas, hereby declares it would have enacted such remaining portions despite any such ~nvalldlty SECTION V That Ordinance NO 81-78 is hereby repealed SECTION VI That this ordinance shall become effective fourteen (14) days from the date of ~ts passage, and the City Secetary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record-Chronicle, the official newspaper of the Clty of Denton, Texas, within ten (10) days of the date of Its passage ~ PASSED AND APPROVED this the~_ day of September, 1981 CIT~ OF DE~ON, TE~S ATTEST APPROVED AS TO LE~AT, ~ORM CITY O~ DENTON, TEXAS
