1981-066AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF DENTON, TEXAS, AS SAME WAS ADOPTED AS AN APPENDIX TO THE CODE OF ORDINANCES OF THE CITY OF D~.NTON, TEXAS, BY ORDINANCE NO 6q-l, AND AS SAID MAP APPLIRS TO APPROXIMATELY 3 798 ACRES OF LAND, MORE OR LESS, OUT OF THE WILLIAM DABBS SURVEY, ABSTRACT NO 328 IN THE CITY OF D~.NTON, AND MORE PARTICULARLY D~.SCRIB~.D HEREIN, AND D~.CLARING AN EFFECTIVP. DATE THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS SECTION I The Zoning Classification and Use Designation of the following described property, to-wit Ail that certain 5 798 acre tract or parcel of land situated in the William Dabbs Survey, Abstract No 328, Denton County, Texas, said tract being part of a tract occupied on the ground as tract shown by deed to Joseph E Stockard, Trustee and recorded in Volume 871, Page 875 of the Deed Records of Denton County, Texas and being more particularly described as follows BEGINNING for the southeast corner of the tract being described herein at an iron pin set in the north line of U S Highway No 580 at the southeast corner of said Stockard Trustee Tract, THENCE westerly 679 61 feet with the arc of curve to left through a central angle of 06o 40' 46" to the southwest corner of said Stockard Tract, THENCE north 00° 27' 50" west with the west line of said Stockard Tract 251 0 feet to the north line of City Limit of Denton, Texas, THENCE easterly 644 1S with the arc of curve to right through a central angle of 06° 04' 14" and a radius of 6079 64 feet, chord bearing north 870 56' 4S" east 64~ 87 feet along said City Limits to its intersection with the eastern line of said Stockard Tract, THENCE south 08° 29' 50' east 255 3 feet to the point of beginning and containing approximately 3 798 acres of land, more or less is hereby changed from Agricultural "A" District Classification Use to Planned Development "PD" District Classification and Use under the Comprehensive Zoning Ordinance of the City of Denton, Texas sub3ect to the following conditions and restrictions, to-wit 1 Access to said property shall be permitted from Riverside Drive only The Zoning Map of the City of Denton, Texas, adopted the 14th day of January, 1969, as an Appendix to the Code of Ordinances of the City of Denton, Texas under Ordinance No 69-1, be, and the same is hereby amended to show such change in District Classfflcatlon and Use promoting the general welfare of the City of Denton, Texas, and with reasonable consideration, among other th~ngs for the character of the d~str~ct and for ~ts peculiar suitability or particular uses, and w~th a wew to conserwng the value of the buildings, protecting human l~ves, and encouraging the most appropriate uses of land for the maximum benefit to the C~ty of Denton, Texas, and ~ts c~tlzens designed to provide opportunities for c~tlzen ~nvolvement and comment Following submission of an application for a zoning change, a public hearing is scheduled before the Planning and Zoning Commission This Commission ls composed of seven members appointed by the City Council whose role is to make recommendations to the Council on zoning requests Property owners w~thln two hundred feet of the s~te in the zoning petition are notified to participate at the public hearing The hearing fellows an orderly procedure during which the petitioner explains h~s proposal and then is followed by other persons who have the opportunity to speak ~n support or in opposition to the request After the public h~ar~ngprocess is com- pleted, the Planning Commission votes to recommend e~ther approval or denial of the request If the Planning Commsslon recommends approval, then the case is forwarded to the City Councll for its consideration If the Planning Commission recommends denial, then the petitioner must f~le an appeal to have the case heard by the City Council Prior to the public hearing before the City Council, property owners within two hundred feet are again notified by mall and all persons have the opportunity to address the Council concerning the case The C~ty Council makes the final decision on all zoning petitions
