1981-060 NO 81 - 60 AN ORDINANCE PROVIDING THAT PORTION OF PATSY STREET FROM JANIE STREET TO HETTIE STREET BE VACATED, ABANDONED AND CLOSED, AND PROVIDING THAT THIS ORDINANCE SHALL BECOME EFFECTIVE IMMEDIATELY WHMREAS, the City Council of the City of Denton, Texas has been requested by the owners of ad3olnlng property to vacate, abandon and close that portion of Patsy Street hereinafter described, and WHMREAS, the C~ty Council of the City of Denton, Texas is of the opinion that the best ~nterest and welfare of the public w~ll be served by vacating, abandoning, and closing the portion of sa~d street hereinafter described, now, therefore, THM COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS SECTION I That those portions of Patsy Street from Janle Street to Hett~e Street described as follows Ail that certain lot, tract or parcel of land lying and being situated in the C~ty and County of Denton, State of Texas, and being part of the J Brock Survey, Abstract No SS, of the Sunrise Addition, an addition to the City and County of Denton, recorded in Volume 407, Page 499 of the Deed Records of Denton County, Texas, and more particularly described as follows BEGINNING at the ~ntersect~on of the west r~ght-of-way hne of Jan~e Street with the north r~ght-of-way l~ne of Patsy Street, sa~d point also being the southeast corner of Lot 9, Block D, Sunrise Addition, THENCM west along the north right-of-way line of Patsy Street and the south boundary line of said lot a d~stance of 514 5 feet to the ~ntersect~on of the east right-of-way line of Hett~e Street w~th the north r~ght-of-way l~ne of Patsy Street, THMNCE south a distance of S0 feet to the ~ntersectlon of the east right-of-way lxne of Hettle Street w~th the south right-of-way line of Patsy Street, THENCE east along the south r~ght-of-way line of Patsy Street a d~stance of 514 5 feet to the ~ntersectlon of the west r~ght-of-way lxne of Janle Street with the south r~ght-of-way line of Patsy Street, THENCE north a d,stance of 50 feet to the place of beginning and containing 1S,725 square feet of land, more or less be and the same ~s hereby closed, abandoned and permanently vacated as a street or public thoroughfare of any kind or character forever SECTION II That the easement over that port~on of said street herein described is hereby released and will revert to the ad3acent owner or owners as prowded by law SECTION III That port~on of the street here~n described being vacated, abandoned and closed ~s made sub3ect to all ex~st~ng zoning regulations and deed restrictions, ~f any, and sub3ect to all ex~st~ng easement rights of others, ~f any, whether apparent or not SECTION IV That the Mayor of the C~ty of Denton be, and he ~s hereby authorized, to execute on behalf of the C~ty of Denton, Texas a Qmtcla~m to the ~nterest of the C~ty of Denton which are vacated, abandoned and closed by th~s ordinance, prowded, however, the C~ty of Denton shall not be responsible for any closing costs whatsoever SECTION V Th~s ordinance shall take effect and be ~n full force and effect from and after the date of ~ts passage, and ~t ~s so ordained PASSED AND APPROVBD bM. the C~tyf-~Counc~l of the C~ty of Denton, Texas, th~s the ~_~_~J~day of ~4CI~RD 0 ~TE~A~, MA¥OR'~' CITY'OF DE~TON, TEXAS ATTEST BILL ANGELO, DEPUTY ~t~=MO~, CITY SF.
