1981-039 NO #81-B9 AN ORDINANCE GRANTING A SPECIFIC USE PERMIT AND AMENDING THE ZONING MAP OF THE CITY OF DENTON, TEXAS, AS SAME WAS ADOPTED AS AN APPENDIX TO THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS, BY ORDINANCE NO 69-1, AND AS SAID MAP APPLIES TO BLOCK 4 OF THE VILLAGE PHASE I ADDITION AS SHOWN ON THE TAX RECORDS OF THE CITY OF DENTON, TEXAS, AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS SECTION I The Zoning Classification and Use designation of the followxng described property, to-w~t West side of Stuart Road approximately 54 feet north of Manhatten Street, Block 4 of the V~llage Phase I Addltxon as shown on the Tax Records of the C~ty of Denton, Texas sxtuated xn the C~ty of Denton, Denton County, Texas, whxch is classified as Sxngle~Fam~ly "SF-7" D~str~ct Classxfx- cat~on Use under the Comprehensive Zoning Ordinance of the C~ty of Denton, Texas ~s hereby changed and a Specific Use Permit is hereby granted for the use of sa~d property for a day care center, subject to the following special conditions and restrictions, to-wit 1 The number of chxldren to be accommodated xs l~m~ted to a maxxmum of e~ghty-n~ne (80) children, 2 Adequate off-street parking shall be prowded, 5 Adequate maneuvenng area shall be prowded ~n the parktng lot xn order to prevent the necessity of backing out onto Stuart Road, 4 No detached s~gns are permitted, S The design of the structure shall be consistent w~th the renderings submtted ~n addition to all uses authorized ~n a S~ngle-Fam~ly "SE-7" D~str~ct The development of the property shall be ~n substantial compliance w~th the s~te plan attached hereto and made a part hereof for all purposes The Zoning Map of the City of Denton, Texas, adopted the 14th day of January, 1960, as an Appendix to the Code of Ordinances of the City of Denton, Texas under Ordinance No 69-1, be, and the same ~s hereby amended to show such change ~n D~str~ct Classification and Use SECTION II That the City Council of the C~ty of Denton, Texas hereby f~nds that such change ~s ~n accordance w~th a comprehensive plan for the purpose of promoting the general welfare of the C~ty of Denton, Texas, and w~th reasonable consideration, among other th~ngs for the character of the d~strlct and for ~ts peculiar suitability or particular uses, and w~th a view to conserwng the value of the buildings, protecting human l~ves, and encouraging the most appropriate uses of land for the maximum benefit to the C~ty of Denton, Texas, and ~ts c~t~zens S-151-SAUNDRA JONES-PAGE SECTION III That this ordinance shall be ~n full force and effect ~mmedlately after ~ts passage and approval, the required public hearings having heretofore been held by the Planning and Zoning Commission and the C~ty Council of the City of Denton, Texas, after g~wng due not~ce thereof 1981PASSBD ~D APPROVBD th~s the 7~aay of __~, / , 'CIT~ OF DE~TO~ TEXAS CITY OF DENTON, TEXAS APPROVED AS TO LEGAL FORM C J TAYLOR, JR , CITY ATTORNEY CITY OF DENTON, TEXAS I S- 1 S1- SAUNDRA JONES- PAGE 2
