AN ORDINANCE PROVIDING THAT THE FOLLOWING PORTION OF AN
EASEMENT FOR STREET RIGHT OF WAY AND PUBLIC UTILITIES BE
VACATED, ABANDONED AND CLOSED, AND PROVIDING THAT THIS
ORDINANCE SHALL BECOME EFFECTIVE IMMEDIATELY
WHEREAS, the City Council of the City of Denton, Texas has
been requested by the owners of ad3olnlng property to vacate,
abandon and close that portion of public street hereinafter
described, and
WHEREAS, the C~ty Council of the C~ty of Denton, Texas ~s
of the opinion that the best interest and welfare of the public
will be served by vacating, abandoning, and closing the port,on
of said street hereInafter described, now, therefore,
THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS
SECTION I
That the portions of a public street and utility easement
described below
All that certain lot, tract or parcel of land lying and being
situated in the C~ty and County of Denton out of the J McGowan
Survey, Abstract No 797, and more particularly described as
follows
BEGINNING at a point ~n the east line of Lot No 3 of Block No
1 of the J W Erwln Subdivision located ~n the J McGowan
Survey, Abstract No 797 as conveyed by 3 W Erw~n to Henry W
Erwln, Jr by deed dated the 30th day of July, 19g2, and
recorded in Volume 384, Page 538 of the Deed Records of Denton
County, Texas Sa~d point being 85 66 feet south 0° 03' west
from the intersection of the east line of said Lot No 3 and
the present southwest right of way l~ne of Interstate Highway
35E and also being 28 14 feet north 0° 03' east from the
southeast corner of Lot No 3, Block No 1 of the 3 W Erw~n
SubdivisIon,
THENCE south 0° 03' west 28 14 feet to the southeast corner
of sa~d Lot No 3, a point for a corner,
THENCE north 89° 59' west w~th the south line of sa~d Lot No
3 a distance of 25 76 feet, a point for a corner,
THENCE north 42° 33' east a d~stance of 58 15 feet to the
place of beginning
be and the same is hereby closed, abandoned and permanently
vacated as a street or public thoroughfare of any kind or
character forever
SECTION II
That the easement over that portion of said street herein
described is hereby released and will revert to the ad3acent
owner or owners as provided by law
SECTION III
That the Mayor of the City of Denton be, and he is hereby
authorized, to execute on behalf of the C~ty of Denton, Texas a
Quitclaim to the interest of the City of Denton which are
vacated, abandoned and closed by th~s ordinance, provided,
however, the City of Denton shall not be responsible for any
closing costs whatsoever
SECTION IV
Thls ordinance shall take effect and be ~n full force and
effect from and after the date of ~ts passage, and ~t ~s so
ordained
