1981-022AN ORDINANCE PROVIDING THAT ALL RIGHT, TITLE, AND INTEREST OF THE
CITY OF DENTON IN LAND HERETOFORE DEDICATED AS A PUBLIC UTILITY
~ASEMENT BE VACATED AND ABANDONED, AND PROVIDING THAT THIS ORDINANCE
SHALL BECOME EFFECTIVE IMMEDIATELY
WHI~REAS, the City Council of the City of Denton, Texas, has
been requested by the owners of adoo~nlng property to vacate and
abandon a public utility easement over a portion of the
hereinafter described tract of land, and
WHEREAS, the City Council of the City of Denton, Texas,
of opinion that the best interest and welfare of the public will
be served by vacating and abandoning said public utility
easement over the hereinafter described tract of land, NOW,
THEREFORE,
THE COUNCIL OF THE CITY OF DENTON, TEXAS, H~REBY ORDAINS
SECTION I
That the right, t~tle, and interest of the C~ty of Denton,
Texas, in and to the following described public utility easement
to-wit
All that certain lot, tract or parcel of land lying and being
situated in the City and County of Denton, State of Texas,
being part of the M Yoachum Survey, Abstract No 1442, and
being a part of an $ 815 acre tract conveyed by Wood Street
Church of Christ to Singing Oaks Church of Christ by deed dated
June 11, 1968, and recorded in Volume 567, Page 559 of the Deed
Records of Denton County, Texas, and being more particularly
described as follows, to-wit
BEGINNING at a point in the west boundary hne of said Singing
Oaks Church of Christ tract 142 0 feet north 2o 04' east of
the southwest corner of said Singing Oaks Church of Christ
tract,
THENCE north 2° 04' east with the west boundary line of said
Singing Oaks Church of Christ tract, 16 0 feet to a point for a
corner,
THENCE south 89° 00' east 250 0 feet to a point for a corner,
THENCE south 2° 04' west 16 0 feet to a point for a corner,
THENCE north 89° 00' west 250 0 feet to the place of
beginning and containing 0 092 acres of land, more or less,
is hereby abandoned and permanently vacated as public utility
easement of any kind or character forever
SECTION II
That the easements over that port~on of sa~d tract of land
here~n described are hereby abandoned and released and w~ll
revert to the adjacent owner or owners as prowded by law
SECTION III
That port~on of the public utility easement here~n
described being vacated, abandoned, and closed ~s made subject
to all ex~st~ng zoning regulations and deed restrictions, ~f
any, and subject to all ex~st~ng easement r~ghts of others, ~f
any, whether apparent or not
SECTION IV
Th~s ordinance shall take effect and be ~n full force and
effect from and after the date of ~ts passage, and ~t ~s so
ordained
