AN ORDINANCE AMENDING TEE ZONING MAP OF THE CITY OF DENTON, TEXAS, AS SAME WAS ADOPTED AS AN APPENDIX TO THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS, BY ORDINANCE NO 69-1, AND AS SAID MAP APPLIES TO APPROXIMATELY 1 8 ACRES OF LAND, MORE PARTICULARLY DESCRIBED HEREIN, AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS SECTION I The Zoning Classif~catlon and Use designation of the following descrlbed property, to-w~t All that certain lot, tract or parcel of land lying and being situated in the City and County of Denton, State of Texas, and being part of the B B B & C R R Company Survey, Abstract No 141, and more particularly described as follows BEGINNING at the intersection of the centerllne of Interstate H~ghway 35, with the centerline of FM 1173, THENCE south 89° 39' west along the centerllne of said FM 1173 a distance of 500 feet to a point for a corner said corner lying on the exlstlng city limits boundary line as established by Ordinance No 69-40, THENCE north 0° 44' west along the ex~stlng city l~m~ts boundary line passing at 50 feet the south l~ne of a tract of land as conveyed to J E Corbln and w~fe to Roy A Cunnlngham by deed dated February 24, 1956 and recorded ~n Volume 419, Page 369 of the Deed Records of Denton County, Texas and continuing north a total d~stance of 299 feet to a point for a corner lying in the north l~ne of said Cunnlngham Tract, THENCE north 89° 39' east along the north line of sa~d Cunningham tract passing the east l~ne of sa~d Cunnlngham Tract at 317 5 feet and continuing north 89° 39' east a total dlstance of 500 feet to a point for a corner lying in the centerllne of Interstate Highway 35, THENCE south 0© 44' east along the centerl~ne of sa~d Interstate H~ghway 35 a distance of 299 feet to the place of beginning and containing 3 4 acres of land, more or less, which ~ncludes street right of way adjacent to a 1 8 acre tract of land ~s hereby changed from Agricultural "A" D~strlct Classlf~cat~on Use to Commercial "C" D~strlct Classification and Use under the Comprehensive Zoning Ordinance of the City of Denton, Texas The Zoning Map of the C~ty of Denton, Texas, adopted the 14th day of January, 1969, as an Appendix to the Code of Ordlnances of the City of Denton, Texas under Ordinance No 69-1, be, and the same ~s hereby amended to show such change ~n D~strict Classification and Use SECTION II That the C~ty Council of the City of Denton, Texas hereby flnds that such change is in accordance with a comprehensive plan for the purpose of promoting the general welfare of the City of Denton, Texas, and with reasonable consideration, among other things for the character of the district and for ~ts peculiar suitability or particular uses, and with a view to conserving the value of the Z-1471-FRED W VAUGHAN buildings, protecting human lives, and encouraging the most appropriate uses of land for the maximum benefit to the City of Denton, Texas, and 1ts citizens SECTION III That this ordinance shall be in full force and effect 1mmed~ately after ~ts passage and approval, the required public hearings having heretofore been held by the Planning and Zoning Commlss~on and the City Council of the City of Denton, Texas, after giving due notice thereof /7~ day of ~&~ , D 1901PASSED AND APPROVED this the '0 CIT~OF D~NTON, TEXAS ATTEST /~OOKS HOLT, ~ CITY OF DENTON, TEXAS APPROVED AS TO LEGAL FORM C J TAYLOR, JR , CITY ATTORNEY CITY OF DENTON, TEXAS Z-1471-FRED W VAUGHAN
