1981-011AN ORDINANCE AMENDING SECTION 25-21 OF CHAPTER 25, CODE OF ORDINANCES PROVIDING FOR ELECTRIC UTILITY RATES, PROVIDING A SEVERABILITY CLAUSE AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS PART I That Section 25-21 of Chapter 25 of the Code of Ordinances of the C~ty of Denton, Texas ~s hereby amended to read as follows ARTICLE II ELECTRIC SERVICE Section 25-21 Rate Schedule The rates to be charged by the c~ty for electricity are hereby estabhshed as follows (A) RESIDENTIAL SERVICE RATE (Schedule R-I) (1) Net Monthly Rate B~lllng months of June through September Ail kwh a 4 6S~ per kwh Billing months of October through May All kwh @ 4 3S¢ per kwh Energy billed during each o£ the months of December through February whxch is ~n excess of 1000 kwh ~n a s~ngle family unit or 1000 kwh t~mes the number of un,ts ~n a multiple famly unit w~ll be supphed at 4 15~ per kwh ~f the entire home electrically heated-heat pump or resistance (2) Customer Facility Charge $2 50 per month (3) Ava~lablllty Rate Schedule R-1 ~s applicable to all electric serwce reqmred for single family residential purposes where usage ~s not ~n excess of 700 kwh per month during the billing months of June, July, August, or September In any such month ~f usage exceeds 700 kwh, bzlling w~ll be rendered that month under Rate Schedule R-2 and thereafter for a period extending through the 12 billing months of the next f~scal year ending September 30 In ~nstances where multiple dwelling un~ts (family or housekeeping un,ts) are being served through the same meter as of the effective date of th~s rate schedule and the kwh ~n the billing months of June, July, August or September exceeds 700 kwh t~mes the number of dwelling units, the billing for that month and thereafter w~ll be rendered under Rate Schedule (4) Serwce At the ut~l~ty's available szngle phase secondary voltage (5) Payment B~lllng for serwce hereunder will be at the net monthly rate, payment of which ~s due when b~lls are ~ssued B~lls which are not paid w~thln ten (10) calendar days from the date of ~ssuance thereof will be considered overdue (6) Energy Cost Ad3ustment All charges of the net monthly rate w~ll be increased or decreased according to the current energy ad3ustment clause (7) Special Facilities Ail services which require special facilities in order to meet the customer's serwce requrrements shall be prowded subject to special facilities r~der (B) RESIDENTIAL SERVICE RATE (Schedule R-2) (1) Net Monthly Rate B~lhng Months of June through September All kwh @ 4 6S¢ per kwh Billing months of October through May All kwh @ 4 55~ per kwh Energy billed during each of the months of December through February which is in excess of 1000 kwh for a s~ngle family unit or 1000 kwh times the number of un,ts ~n a multiple family unit w~ll be suppl~ed at 4 15~ per kwh ~f the entire home ~s electrically heated-heat pump or resistance (2) Customer Facility Charge S~ngle Phase @ $4 50 per month Three Phase @ $8 00 per month (5) Availability Applicable for s~ngle family residential use (4) Serwce At the ut~l~ty's available secondary voltage and phase (5) Payment Billing for C (1) Net Monthly Rate Demand Charge Primary Service $1 80 per month per kW for all kW of billing demand Secondary Service $2 10 per month per kW for all kW of billing demand Bnergy Charge Billing months of June through September Primary Service All kwh @ 4 10¢ per kwh Secondary Service All kwh @ 4 15¢ per kwh Billing months of October through May Primary Service All kwh @ 3 804 per kwh Secondary Service All kwh @ 5 $54 per kwh (2) Customer Facility Charge Primary Service @ $46 00 per month Secondary Service 5~ @ $ 8 00 per month Secondary Service 14 @ $ 4 50 per month (3) Availability Available to commercial and ~ndustrlal users except that service hereunder is not available for resale, breakdown or standby power (4) Billing Demand Equal to the kW load metered during the iS-minute period of maximum use during the current monthly billing period, or in cases where the connected load is constant, the city may, at its option, estimate the kW demand For neon type s~gns one volt ampere shall be considered the equlvllent of 3/4 watt (5) Minimum Charge An amount equal to the demand charge as calculated above but not less than fifty percent (50%) of the maximum monthly demand charge for any month during the preceding 11 months (6) Payment Billing for services hereunder will be at the net monthly rate, payment of which is due when bills are issued Bills which are not paid within ten (10) calendar days from the date of issuance thereof will be considered overdue (7) ~nergy Cost Ad3ustment All charges of the net monthly rate will be ~ncreased or decreased according to the current energy ad3ustment clause (8) Power Factor Requirements ~ Ad3ustments PAGE 5 The utlllty reserves the r~ght to make tests to determCne the power factor of the user's ~nstallat~on served hereunder during per~ods of maxmum demand or by measurement of the average power factor for the monthly b~ll~ng per¢od Should the power factor so determined be below n~nety (90%) percent, the demand for b~ll~ng purposes w~ll be determined by multiplying the uncorrected kW B~lllng Demand by n~nety (90 %) percent and d~wd~ng by the determined power factor (9) Alternate Primary Serwce ~ D~scount (Transformation Equipment Owned by the User) Primary serwce w~ll, upon request, be made available to users w~th a twelve (12) month average monthly demand of 7S0 kW or greater Primary serwce w~ll be rendered at one point on the user's premises at a nominal voltage of 15,200 volts or 59,000 volts three-phase, at the option of the utility When the alternate primary serwce ~s suppl~ed, the user shall own, operate and maintain all fac~llt~es necessary to receive primary service and all transformation facilities required for conversion to utilization voltage The utility shall own, operate and maintain all metering facilities (e~ther primary or secondary metering at the ut~l~ty's option) Where the user owns, operates and maintains the transformation equipment and where the utility elects to apply ~ts metering facilities on the ~ voltage s~de of such transformation equipment, the user w~ll be allowed a f~fteen (15%) percent reduction from the monthly Demand Charge Where the user owns, operates and maintains the transformatzon equipment and where the utility elects to apply ~ts metering fac~l~tzes on the low voltage s~de of such transformation equipment, the user w--q-il be allowed a thirteen (15%) percent reduction from the monthly Demand Charge, the dzfference between f~fteen (15%) percent and thirteen (1~%) percent being the allowance for losses ~n the user's facilities (10) will be considered overdue (4) Energy Cost Adjustment All changes of the net monthly rate w~ll be ~ncreased or decreased according to the current energy adjustment clause (F) STREET LIGHTING ~ TRAFFIC SIGNALS Schedule (1) Net Monthly Rate All kwh @ 5 65~ per kwh {2) Availability Available to State and local government agencies that install and maintain their own street lights and traffic signals thxs schedule Where necessary for proper xllum~nat~on or where ex~stxng poles are xnadequate the cxty wxll install or cause to be xnstalled one (1) pole for each xnstalled l~ght, at a dxstance not to and deliver electric service to automatically controlled, mercury/sodium vapor l~ght~ng f~xtures conforming to the ut~l~ty's standards and subject to ~ts published rules and regulations (4) Payment B~ll~ng for serwce hereunder w~ll be at the monthly rate, payment of which ~s due when b~lls are ~ssued B~lls which are not pa~d w~th~n ten (10) calendar days from the date of ~ssuance thereof w~ll be considered overdue (S) Energy Cost Adjustment The energy cost adjustment applxcable to the monthly dusk-to-dawn l~ght~ng charge shall be the amount equal to "X" cents multiplied by following factor municipal utxl~t~es bxll In the event that a customer desires the removal of the unxt or dxscontxnuance of the serwce prxor to completion of two years, the remainder of the contract per~od shall become due and payable After the end of the initial two year contract, service shall continue on a month to month bas~s and may be cancelled by e~ther party upon thirty (50) days notxce (7) Special September All kwh @ 4 1~ per kwh Blllxng months of October through May All kwh @ 5 8~ per kwh (2) Net Monthly Rate for Interrupt~ble Load When the Electric Department requests a customer to interrupt load and the customer elects not to interrupt his load then the following rates shall apply for all kW and kwh the Electric Department requests to be interrupted PAGE 10 (5) Demand Charge The actual cost of all kW purchased by the Electric Department necessary to service the customer's load adjusted for losses (4) Minimum Charge An amount equal to the demand charge as calculated above but not less than fifty percent (50%) of the maximum monthly demand charge for any month during the preceding 11 months (S) Energy Charge The actual cost of all kwh purchased by the Electric Department necessary to serve the customer's load adjusted for losses (6) Customer Facility Charge $46 00 per month (7) Availability Available for all customers taking primary service at a firm power load exceeding S,000 KVA during the months of June, July, August or September (8) Billing Demand The kW load metered during the iS-minute period of ma×lmum use during the current monthly billing period (9) Conditions of Interruption The Electric Department shall notify the customer by telephone at least thirty (50) minutes prior to the time at which the load is required to be curtailed The request shall be for all or part of the customer load exceeding S,000 KVA The maximum period of interruption shall be for six hours The interruption shall be at the request of the Electric Department during the periods when a potential forced outage could deny power to other customers or when available spinning reserves are threatened The customer shall respond by stating he will or will not comply with the Electric Department's request within fifteen (15) minutes after notification (10) Payment Billing for service hereunder will be at the net monthly rate, payment of which is due when the bills are received Bills which are not paid within ten (10) calendar days from the date of issuance thereof will be considered overdue (11) Energy Cost Adjustment All charges of the net monthly rate will be increased or decreased according to the current energy adjustment clause (12) Power Factor Requirements ~ Adjustments The utility reserves the right to make tests to determine the power factor of the user's installation served hereunder during periods of maximum demand for the monthly billing perloa Should the power factor so determined be below ninety (90%) percent, the demand for billing facll~t~es {K) SPECIAL FACILITIES RIDBR (1) Applicability All service shall be offered from available facll~t~es If a customer service characteristic requires facilities and devices which are not normally and readily available at the location at which the customer requests serwce, then the Electric Department shall provide the serwce subject to paragraph 2 of this schedule {2} The total cost of all fac~llt~es required to meet the customer's load characteristics which are incurred by the Electric Department shall be subject to a special contract entered into between the Electric Department and the customer Th~s contract shall be signed by both part~es prior to the Electric Department providing serwce to the customer PAGE 12 P~T II That if any section, subsection, paragraph, sentence, clause, phrase or word in this ordinance, or application thereof to any person or circumstances is held invalid by any court of competent 3urlsd~ction, such holding shall not affect the validity of the remaining portions of this ordinance, and the City Council of the City of Denton, Texas, hereby declares it would have enacted such remaining portions despite any such invalidity P~T III That this ordinance shall become effective ~y (~ days from the date of ~ts passage, and the C~ty Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton
