AN ORDINANCE ABANDONING AND VACATING THE WEST 71 07 FEET OF
PUBLIC UTILITY PASEMENT IN THE M E P ~ P R R SURVEY, ABSTRACT
NO 927, DENTON COUNTY, TEXAS, AND PROVIDING FOR AN EFFECTIVE
DATE
WHEREAS, the City Council of the City of Denton, Texas, has
been requested by the owners of ad3oln~ng property to vacate
and abandon a public utility easement over a portion of the
hereinafter described tract of land, and
WHEREAS, the City Council of the City of Denton, Texas, is
of the opinion that the best interest and welfare of the public
will be served by vacating and abandoning said public utility
easement over the hereinafter described tract of land, NOW
THEREFORE,
THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS
SECTION I
The west ?1 07 feet of the £ollowlng described public
utility easement is hereby abandoned and vacated as a public
utility easement, to-wit
All that certain lot, tract or parcel of land lying and being
situated in the City and County of Denton, State of Texas,
being a part of the M E P ~ P R R Survey, Abstract No 927,
and being a part o£ a certain 51 4ql-acre tract of land
conveyed by Colonial Savings and Loan Association to Clinton W
Twaddle, John L Dawson and Hubert G Drlggs by deed dated
October 18, 1968, and recorded in Volume S75, Page 656 of the
Deed Records of Denton County, Texas, and being more
particularly described as follows, to-wit
BEGINNING at a point for corner in the east boundary line of
said Twaddel et al tract, said line also being the west right
of way line of State Highway Loop No 288, said point being
south 5° 45' west 922 0 feet from the northeast corner of
said Twaddell et al tract,
THENCE south 89o 55' west, 922 0 feet south of and parallel
with the north boundary line of said tract, a total distance of
560 0 £eet to a point for a corner,
THENCE north 0° 05' west, 15 0 feet to a point for a corner,
THENCE north 89° SS' east S60 feet, more or less, to a point
for a corner in the west right of way line of Loop 288,
THENCE south 5° 54' west, with the east boundary line, iS 0
feet, more or less, to the place of beginning and containing
0 19 acres of land, more or less
is hereby abandoned and permanently vacated as a public utility
easement of any kind or character forever
SECTION II
That the easement over that portion of said tract of land
herein described is hereby abandoned and released and will
revert to the ad3acent owner or owners as provided by law
SECTION III
That port~on of the public utility easement here~n
described being vacated, abandoned, and closed ~s made sub3ect
to all existing zoning regulations and deed restrictions, ~f
any, and suboect to all existing easement rights of others, ~f
any, whether apparent or not
SECTION IV
This ordinance shall take effect and be ~n full force and
effect from and after the date of xts passage, and ~t is so
ordained
