AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR ThE
SUBMISSION OF CERTAIN PROPOSED CHARTER ~{ENDMLNTS ~O ThE VOTERS AT
A SPECIAL MDNICIPAL LLLCTION TO BE HELD ON JANUARY 19, 1980, DESIGNA-
TING THE POLLING PLACES AND THE HODRS OF VOTING, APPOINTING ELECTION
JDDGES AND PROVIDING THE F~NNER IN WHICH NOTICE OF SUCh ELECTION
SHALL BE GIVEN
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
S~CTION 1 That in accordance with the provisions of Article
1170 of Vernon's Revised Civil Statutes of the State of ~exas, there
shall be submitted to the voters of the City of Denton at a special
municipal election to bc hel~ on January 19, 1980, the following
proposed ~endments to the Home Rule Charter of the City of Denton
S~CTION 2 That said amendments to the Home Rule Charter to
be subm%tted to the qualified voters are as follows
AMENDMENT NDbIBER 1
That Sectlon 2 01 be amended so as to hereafter provide as
follows, to-wit
"Section 2 01 Number, Selection and Term
(a) The City Cou~'cii ~hall have seven ~--members, slx
(6) councllpersons and a Mayor The manner of their
election is prescribed herein Each councllperson shall
be elected to and occupy a place on the Council, such
places being numbereu one, two, three, four, five ano
slx The Mayor's position on the Council shall be place
seven
(b) ~our (4) members of the Council whose positions shall
be places one, two, three an~ four, shall be residents of
and elected by the quallfled~voter~ of single-member geo-
graphlca~dlstrlcts of the City, known as districts one,
two, thr~e and four, as such districts may from time to
time be determined by the City Council in accordance with
Section 2 01(d), and created and described by ordinance
Two (2) members of the Council and the hayor shall be
(elected by the qualified voters of the entire Clt}, coF~tonly)
known as at large One (1) at large member, place five
shall be a resident of district one or two, and one (1)
at large member, place s~x, shall be a resident of dlstrlct
three or four
(c) All members of the Council and the Mayor shall be elected
for two (2) year terms and shall not be eligible fo~ election
to more than three (3) consecutive two (2) year terms, such
terms to conm%ence with the first two (2) year term to which
such member or Mayor is elected after the adoption of this
section
(d} The Coh~ncll shall from time to time create and
descrabe by ordanance election districts known as
distracts one, two, three and four Such dastracts
shall be created so that each will contain, as nearly
as possable, a populataon equavalent to the others,
according to the latest available census data "
That Sectaon 3 01(b) shall be amended and Sectaons 3 01(c),
(d) and (e) shall be added, so as to hereafter provide as follows,
to-w~t
"Section 3 01 Munacapal Elect~ons
(b) On the farst Saturday in Apral a~edlately following
adoptaon of Sectaon 2 01, and the drawang of election
distract boundaries by the Council, the voters shall
elect
(1) The Mayor, place 7, for a term of two (2)
years
(2) Two councalmembers, places 5 and 6, for
terms of two (2) years each
(3) One councllmen~er for an interim term of
one (1) year Th~s posltaon shall be denomi-
nated for such Interim term as place 4 and
such councalmember shall be elected from the
Caty at large and may be a resident of any
dastract
At the next followang regular annual munacapal elect~on
after the one referred to above ~n this section, the d~s-
trlct and at large system provaded an Sectaon 2 01 shall
take full effect
(c) Councllmembers holding office at the tame the charter
amendments to Section 2 01 are adopted (places 1, 2 an~ 3)
shall serve the remaanuer of their unexpired terms as at
large members of the Council
(d) If any councalmember whose term would not otherwise
expire at the tame of the canvass of the results of the
electaon speeafaed an Sectlon 3 01(b) shall enter sald
electaon, such councllmember~s term shall be deemed to
have been vacated at the time of the canvass of sa~d
electaon results, whether the candidacy of saad council-
member is successful or not
(e) Neither the Mayor nor any member of the Councal
shall become a candadate for election to any posataon
on the Councal, other than for re-election to the
same seat, unless such candadate shall first submat
to the Caty Secretary h~s written reslgnataon from the
Councal to be effectave at the time of the canvass of
the results of the next regularly scheduled election
If such candadate's unexpired term would otherwise
extend beyond the date of such canvass, the C~ty Secre-
tary shall notify the Council and an elect~on shall be
held on the ~ate of the next regularly scheduled election
to fall the unexpared term of saad resagnang council-
member "
That Sectaon 2 06(a) be amended so as to hereafter provade
as follows, to-w~t
"(a) A majority of the men~ers of the Council shall
constatute a quorum for the transaction of bus~ness,
and the afflrmatlve vote of a ma3oraty of the Council
shall be necessary to repeal any ordinance or take
any offacaal actaon ~n the name of the Caty, except
as othew~se provided an th~s Charter or by the general
laws of the State of Texas "

AMENDMENT NUMBLR 2
That Section 9 01 be amended so as to add subsection (d)
to read as follows, to-wit
"(d) No revenue bond ~ssue in excess of One Million Dollars
shall be ordered by the City Council until a non-binding
referendum election has been held to determine approval
or disapproval of such issue by a majority of the quail-
fled voters voting at such election"

That Section 2 02(a) (5) be amended so as to hereafter pro-
vide as follows, to-w~t
"(a) (5) Shall not be interested in the emoluments of
any contract, job, work or service of or with the city,
or interested in the sale to or by the city of any
articles, materials, supplies or equipment, and"

That Section 2 03 be amended so as to hereafter provlae as
follows, to-wlt
"Section 2 03 Presiding officer Mayor and Mayor
Pro Tem
The Mayor sha-~-~- preside at the meetings of the
Council and shall be recognized as head of the C~ty
government for all ceremonial purposes and by the
Governor for purposes of martial law, but shall not
interfere with the managerial ~ut~es and responsi-
bilities of the City Manager The Mayor shall have
all the same powers and privileges as any other
councllmember, including entlClement to vote upon all
matters considered by the Council, but shall have no
veto power The Council shall, as soon as possible
after the annual election, elect from its membership
a Mayor Pro Tem The Mayor Pro Tem shall act as Mayor
during the absence or disability of the Mayor and if
a vacancy occurs shall become Mayor for the completion
of the unexpired term"

That Section 2 08, subsections (b) ann (s), be amended so
as to hereafter provide as follows, to-wit
"(b) Appoant and remove the City Attorney and the Muna-
clpal Court Judge

That Section 3 04(b) shall hereafter provade that runoff

That Sectlon 4 13(a) be amended so as to hereafter provade
as follows, to-wit
"(a) All papers comprising a recall petition shall be
assembled and filed w~th the City Secretary as one
instrument Within seven (7) days after a petition
is f~led, the Clty Secretary shall determine whether
each paper bears the names of five (5) electors who
constitute a cormulttee of the petatloners, and the
required affldavlt of the c~rculator thereof, and
whether the petition as sagned by qualified voters of
the constituency of the councllmember whose removal
ls sought equal ~n number to at least twenty-five
percent (25%) of the number of the votes cast for that
councllmember and all of h~s opponents an the last
preceding general municipal election in which he was a
candidate As used herein 'constituency' shall mean
the qualified voters eligible to vote for the councal-
member whose removal ls sought, either by geographical
district or at large, as the case may be"

That Section 4 16 be amended so as to hereafter provide as
follows, to-wit

and not removed thereby until at least slx (6) months
after such election Should a regular election occur

and Taxation" and that Section 7 16 be amended so as to hereafter

taxes as are allowed by State law and in such manner as
prescribed by btate law"

Upon fznal adoption, the budget shall be in effect for

shall constztute the offlcmal appropriation of the several

budget year A copy of the budget as finally a~opted
shall be flled with the city secretary, the county clerk
of Denton County and the state comptroller of public ac-
counts in Austln All appropriations that have not been
expended or lawfully encumbered shall lapse at the en~ of
the budget year"

In case of grave public necessity, emergency expendltures
to meet unusual and unforeseen conditions, which could not
by dlllgent thought and attention have been included in the
orlglnal budget, may be authorlzed by the affirmative vote
of at least five (5) of the members of the council as an
amendment to the orlglnal budget In every case where such
amendment is made, a copy of the ordinance adopting the
amendment shall be filed with the city secretary, published
in the next lssue of the official newspaper of the city, and
attachea to the budget originally adopted"

All public records collected, assembled, or maintained
by the City in accordance with the transaction of official
business shall be avallable to the public during norn~al
business hours, subject to the exceptions and regulations
authorized by applicable state law"

That Section 14 04 be amended so as to hereafter provide as follows,

"Section 14 04 Personal interest
No offlce~ or employee of the City of Denton shall have
a flnanc~al interest, d~rect or indirect, in any contract
wlth the Clty, or be flnanclally interested, directly or
directly, in the sale to or by the city of any land, materi-
als, supplies or services, except on behalf of the City as
an officer or employee Any willful vIolation of this section
shall constitute malfeasance in office, and any offler or
employee guilty thereof shall forfeit his office or position"

Members of such boards and commissions may be removed
by the Council only for cause and only after being
given not~ce by th~ council"

7 12, 7 13, 7 14, 7 15, 7 17, 7 18, 7 19, 7 20, 7 21, 7 22, 7 23,
10 01, 10 09, 11, 01, 12 06, 14 01, 14 08, and 14 09, and that be-
cause of such deletions, certain sections be renumbered, to-w~t

limits of the City" and mnsertmng therefor the woras "wmth~n the
area under the extraterrmtormal ]urzsdmctlon of the City"

SECTION 3 The pollmng places of samd electmon shall be located
in the Community Bumld~ng mn the C~v~c Center on East McK~nney Street,
Denton, Texas, and shall be open from 7 00 a m to 7 00 p m on the
day of the election
S_~ECTION 4 That said election for the adoption of amendments
to the Home Rule Charter shall be held in accordance with the re-
quirements of the Election Code of the State of Texas
~ECTION 5 None but legally qualified voters of the City of
Denton shall be entitled to vote at said election
S.ECTION 6 Notice of the election ~or the submission of the
amendments s~all be given by publication of this ordinance in the
official newspaper of the City of Denton on the safe day in each
of t%~o successive weeks, the date of the first publIcation to
be not less than fourteen (14) days prior to the date set for the
election Notice of said election shall also be posted in three
(3) public places within the limits of the City at least thirty
(30) days before the elect~on date The return of such posting
shall be made by affidavit of the City Secretary
SFCTION 7 That Lee Kno~ be, and he is hereby, appointed
presiding Judge of sald election at the polling place and that
Bob ~lller be, and he is hereby, appolntea alternate presiding
Judge of said election at the polling place, and the presiding
Judge shall appoint as iaany election clerks as are necessary for
the proper conduct of the election All Jud§es an~ clerks shall
be quallfle~ voters of the City nfter holding sala election, the
election Judge shall promptly make his return to the City Secre-
tary and to the Mayor, and the Secretary shall thereafter present
such returns to the City Council for canvassing of sala election
The presiding election Judge shall be paid the sum of ~_~
per hour, plus an additional sun of $ ~ for his services
in dellverlnc the returns of the election The alternate presiding
election Judge sh~ll be paid the sum of $ ~ ~ pe~ hour an~

not exceea the maxlmu~ amounts set out in Article 3 08, Texas

SECTION 8 Absentee voting for such election shall be hela
at the regular office of the City Secretary at the Denton City Hall
and said place of absentee voting shall remain open for at least
e~ght (8) hours on each day of absentee voting which ~s not a
Saturday, Sunday or an offlclal State holiday, beginning on the
twentieth (20th) day and continuing through the fourth (4th) day
preceding the date of said elect~on Sa~ place of absentee voting
shall remain open between the hours of ~0do'clock a m an~

SECTION 9 This ordinance shall take effect ~nmed~ately from
and after its passage as the law in such cases provides

A LOS VOTANTES EN UNA ELECCION MUNICIPAL ESPECIAL QUE TENGA
LUGAR EL 19 DE ENERO DE 1980, DESIGNANDO LOS LUGARES Y LAS HORAS
DE VOTACION, NOMBRANDO LOS JUECES DE ELECCION Y ESTIPULANDO LA
MANERA EN QUE SE DARA AVISO DE DICHA ELECCION
EL CONCEJO DE LA CIUDAD DE DENTON POR ESTF MEDIO DECRETA
SECCION 1 Que de acuerdo con las estipulaciones del
Articulo 1170 del Estatuto Civil Revisado de Vernon del Estado
de Texas, se presentara a los votantes de la Ciudad de Denton
en una eleccion municipal especial que tendra lugar el 19 de
enero de 1980, las siguientes enmiendas propuestas a la Carta
Constitucional de Gobierno Propio de la Ciudad de Denton
SECCION 2 Que dichas enmiendas a la Carta Constitucional de
Gobierno Propio que se presentara a los votantes calificados sean las
siguientes
ENMIENDA NUMERO 1
Que Seccion 2 01 se enmiende para que en adelante se estipule
lo siguiente, a saber
"Seccion 2 O1 Numero~ Seleccion y Periodo
(a) E1 ConceJo Municipal tendra siete (7) miembros, seis
(6) ConceJeros y un Alcalde La manera de su eleccion
esta dictada aqui dentro Se elegira cada Concejero y
el ocupara un puesto en el Conce3o, dichos puestos siendo
uno, dos, tres, cuatro, cinco y seis E1 puesto del Alcalde
en el ConceJo sera el puesto siete
(b) Cuatro (4) Conceoeros cuyos cargos seran
puestos uno, dos, tres y cuatro, seran residentes de y
elegidos pot los votantes calificados de distritos
geograficos de miembro singular de la Ciudad, conocidos
como distritos uno, dos, tres y cuatro, como se a determinado
dichos distritos de cuando en cuando por el ConceJo Municipal
de acuerdo con la Seccion 2 01 (d) y establecidos y
descritos por ordenanza Dos (2) conce3eros y el Alcalde
seran elegidos pot los votantes calificados de la Ciudad}
entera, comunmente conocidos como distritos sin limitaci~n
Un (1) miembro sin limitacion en el puesto cinco sera
residente del distrito uno o dos, y un (1) miembro sin
limitacion el el puesto seis, sera residente del distrito
tres o cuatro
(c) Todos los conceJeros y el Alcalde seran elegidos
para servir periodos de dos (2) a~os y no seran elegibles para
eleccion por mas de tres (3) periodos consecutivos de dos
(2) aSos, dichos periodos comenzaran con el primer
periodo de dos (2) a~os al cual dicho miembro o Alcalde
sea elegido despues de la aprobacion de esta seccion
(d) E1 ConceJo de cuando a cuando creara y describira
por ordenanza distritos de eleccion que se conozcan
como distritos uno, dos, tres y cuatro Se crearan dichos
distritos para que cada uno contenga, aproximadamente como
posible, una poblacion equivalence a los otros, de acuerdo
a ultimos datos accesibles del censo "
Que se enmiende la Seccion 3 O1 (b) y se aSadan Secciones
3 O1 (c), (d) y (e) para que aqui adelante se esttpule lo
siguienCe, a saber
"Secclon 3 01 Elecciones Municipales
(b) E1 primer sabado de abril inmediatamente siguiendo la
acceptacion de la Seccion 2 01, y el sorteo de limites del
disCrito de eleccion pot el Concejo, los votantes elegiran
(1) E1 Alcalde, puesto 7, para un periodo de dos (2)
(2) Dos conceJeros puesto 5 y 6, cada uno para periodos
de dos (2) aBos
(3) Un miembro del Concejo por un per~odo intermedio
de un (1) aHo Este puesto sera nombrado pot un
periodo intermed~o como pues~o 4 y se elegira dicho
conceJero pot la Ciudad sin limiCacion y puede ser
un residence de cualquler dis~riCo
En la siguiente anual eleccion regular municipal,
despues de la eleccion ya mencionada en esta seccion,
el distrito y el sistema sin lim±tacion estipulado en
la Seccion 2 01 sera completamente vigente
(c) Los ConceJeros desempe~ando un cargo cuando se acepten
las enmiendas de la CarCa Constitucional a la Seccion 2 O1
(puestos 1, 2 y 3) serviran el restante de los periodos
vigenCes como conceJeros sin limitaclon
(d) Si el conceJero cuyo periodo de otro modo no termine
cuando se examinen los resultados de la eleccion estipulados
en la Seccion 3 01 (b) se registre para dicha eleccion,
se Juzgara dicho periodo del conceJero vacante al escrutinio
de dichos resulCados de eleccion si de un modo u otto, la
candidatura de dicho conceJsro tenga exito o no
(e) Ni el Alcalde ni cualquier concejero sera candidato
para eleccion al puesCo en el Concejo, menos para re-elecclon
al mtsmo puesto, a menos que dicho candidato primeramente
presence al Secretario Municipal su resignacion a set
vigen:e al escrutinio de los resultados de la siguiente
regularmente fijada eleccion Si el periodo vlgente
4icho candidato de otra manera extendera mas alla de la fecha
de dicho escrutinio, el Secretario Municipal avisara al
ConceJo y una eleccion tendra lugar en la fecha de la
siguienCe eleccion regularmente fijada para ocupar el
periodo vigente de dicho conceJero que se renuncia "
Que la Seccion 2 06(a) se enmmende para que aqui adelante
se estipule como lo siguiente, a saber
"(a) La mayorla de los conceJeros constituzra un quorum
para la transaccion de negocio, y el voto afirmatzvo de
la mayoria del ConceJo sera necesario para la revocacion
de cualquier ordenanza o llevar a cabo cualquzer acczon
oficial en parts de la Ciudad, excepto como de otro modo
sea esCipulado por esta Carta Constitucional o por las
leyes generales del Estado de Texas "

ENMIENDA NUMERO 2
Que la Seccion 9 01 se enmiende para a~adir la subseccion
(d) para leerse como lo aiguiente, a saber
"(d) Ninguna emision de bono de lngreso en exceso de Un
Millon de Dolares sera decretado por el Concejo Municipal
basra que una eleccion de referendum de falta de llgazon
tenga lugar para determinar el apruebo o el desapruebo
de dicha emision pot la mayoria de los votantes calificados
votando en dicha eleccion "

ENMIENDA NUMERO 3
Que la Seccion 2 02 (a) (5) se enmlende para que aquz adelante
se estipule como lo smguiente, a saber
"(a) (5) No tendra un interes en los emolumentos de cualquier
contracto, empleo, traba3o, o servicio de o con la ciudad,
o un interes en la venta a o por la ciudad de cualquier artzculos,
materiales, abastecimiento o equipo, y"

ENMIENDA NUMERO 4
Que la Seccion 2 03 se enmiende para que aqu~ adelante se
estipule como lo siguiente, a saber
"Seccion 2 03 Oficial que preside Alcalde y Alcalde Pro
Tempore
E1 Alcalde presidira en las reuniones del Concejo y
sera reconocido como el principal del gobierno de la
Ciudad para todo proposito ceremonial y pot el Gobernador
para proposito de la ley marcial, pero no intervendra
en las obligaciones administrativas y responsabilidades
del Administrador Municipal E1 Alcalde tendra todos
los mismos poderes y privilegios como cuatquier otto
conceJero, tncluyemdo el derecho de votar sobre todos
los asuntos considerados pot el Conce3o, pero no tendra
el poder de poner el veto E1 ConceJo debera, lo mas
pronto posible despues de la eleccion anual, elegir
de sus miembros un Alcalde Pro Tempore E1 Alcalde Pro
Tempore desempe~ara el cargo de Alcalde durante la ausencia
o la incapacidad del Alcalde y si una vacancia ocurra
debera set el Alcalde para el fin del periodo vigente "

Que la Secclon 2 08, subsecciones (b) y (s), se enmienden para
que aqui adelante estipule como lo siguiente, a saber
"(b) Nombrar y destitulr al Procurador Municipal y el
Juez de la Corte Municipal
(s) Desempe~ar los cargos del dmstrito y el redistrito"

Que la Seccion 4 13 (a) se enmiende para que aqui adelante
estipule como lo eiguiente, a saber
"(a) Todas las hoJae de papel conteniendo una peticion de
estituyo deberan set arregladas y registradas con el
Secretario Municipal como un set total Dentro de siete
(7) dias despues de registrar una peticion, el Secretario
Municipal determinara si cada hoja de papel tiene los
mombres de cinco (5) electores quienes constituyen un
¢omite de los peticionarios, y el afidavit requerido del
4ietribuidor de eeo, y si la peticion esta firmada por
los votantes calificados del distrito electoral del concejero
de quien se solicite destituir igual en numero a lo menos al
veinticinco (25) porciento del numero de votos dados
para ese conce3ero y todos sus adversarios an la ultima
eleccion municipal general precedente en la cual el fue
candidato Como se use aqui dentro 'distrito electoral'
debera significar los votantes calificados elegibles a

Que la Seccion 4 16 se enmiende para que aqui adelante
se es~ipule como lo siguiente, a saber
"Seccion 4 16 Limitaciones de Destituyo
Ninguna peticion debera ser registrada en contra
un conceJero dentro de seis (6) meses despues de empezar
el desempe~o de su cargo ni en contra un conceJero que
sea presentado en una eleccion de destituyo y no
destituido pot este medio basra a lo menos seis (6)
meses despues de dicha eleccion Si ocurre una eleccion
regular durance el tiempo cuando una peticion de destituyo
sea corriente y si la(s) persona(s) siendo destituidas son
re-elegidas, la peticion de destltuyo sera nula y sin valor "

Que la Seccion 5 01 se enmiende para estipular que cualquzera
persona que sea nombrada Administrador Municipal debera tenet

eso

divisione$ con la concurrencia del ConceJo Municipal"

Quo el Articulo VII se enmiende para que se nombren
"Ingresos e Impuestos" y quo la Seccion 7 16 se enmiende para

E1 ConceJo Municipal esta autorizado a gravar y recaudar
dichos impuestos como sea permitido pot la L ey del E stado y de
modo como sea estipulado pot la Ley del Estado "

Quo la Seccion 8 06 se enmiende para que aqui adelante se
estipule como lo siguiente, a saber

el a~o de presupuesto Aceptacion final del presupuesto
pot el ConoeJo constituira la apropriacion oficial de las
varias cantldades establecidas alli dentro como gastos
propuestos para el a~o de presupuesto Se registrara una
copia del presupuesto finalmente aceptado con el secretario
municipal, el escribiente condal del Condado de Denton y
el contralor estatal de cuentas publicas en Austin Toda
apropiacion quo no ha sido gastada o legalmente sobrecargada
transcurrira al fin del aSo de presupuesto "

Quo la Seccion 8 08 se enmiende para que aqui adelante
estipule como lo sigulente, a saber
"Seccion 8 08 Enmendar el presupuesto
En el caso de necesidad grave, gastos de emergencia para
satisfacer condiciones extraordinarias e imprevistas quo
ni pot pensamiento ni atencion diligente se habra podido
incluido en el presupuesto original, se podra autorizar
pot el voto afirmativo a lo menos de cinco (5) concejeros
como una enmienda al presupuesto original En cada caso
donde dicha enmienda este hecha, una copia de la Ordenanza
aceptando la enmienda sera registrada con el secretario
municipal, publicada en la siguiente edicion del periodico
oficial de la Cludad, y adJuntado al presupuesto originalmente
aceptado "

Quo la Seccion 14 02 se enmlende para quo aqui adelante
estipule como lo siguiente, a saber

pot la Ciudad de acuerdocon la negociacion de negocios oficiales
sera accesible al publico durante las horas normales de
negocio, sujeto a las excepciones y regulaciones autorizadas
pot la ley aplicable del estado "

Que la Seccimn 14 04 se enmiende para que aqui adelante estipute
como lo siguiente, a saber
"Seccion 14 04 Interes personal
Ningun oficial o empleado de la Ciudad de Denton
tendra el interes financial, directo o indirecto, en
ningun contrato con la Ciudad, o set interesado financialmente,
directamente o indirectamente, en la venta a o por la Ciudad
de cualquier terreno, material, abastecimiento o servicio,
excepto de parte de la Ciudad como un oficial o empleado
Cualquier infraccton intencionada de esta seccion constituira
un acto ilegal en su cargo de oficio y cualquier oficial
o empleado culpable de eeo perdera su puesto o posicion

Que la Seccion 14 16 se enmiende para que aqui adelante
estipule como lo siguiente, a saber

serviran a voluntad del Concejo Miembros de dichas Juntas
y comisiones podran ser removados pot el Concejo solamente
pot cause y solamente despues de haber recibido aviso

Que se supriman ciertas secciones administrativas de la
Carte Municipal porque repiten la Ley Estatal, pueden set estipulados
por ordenanza o no son necesarias, dichas secciones siendo numeradas
5 06, 5 07, 6 04, 7 01, 7 02, 7 03, 7 04, 7 05, 7 06, 7 07, 7 08,
7 09, 7 10, 7 11, 7 12, 7 13, 7 14, 7 15, 7 17 7 18, 7 19, 7 20,
7 21, 7 22, 7 23, 10 01, 10 ~9, 11 01, 12 06, 14 01, 14 08 y
14 09, y que a cause de dichas supresiones ciertas secciones seen
renumeradas, a saber

Que la Seccion 2 05 (d) se suprira

Que la Seccion 10 08 se enmiende para conformar la Carta
Constitucional a la ley Estatal por la supresion de las palabras
"dentro de cinco (5) millas de los limites corporales de la Ciudad"
e tnsertando en vez de eso las palabras "dentro de la area baJo
la Jurisdiccion extraterritorial de la Ciudad "

SECCION 3 Los lugares de votacion para dicha eleccion estaran
situados en el Edificio Comun del Centro Civico en la Calle McKinney
Este, Denton, Texas, y estara abierto desde las 7 O0 de la
manana hasta las 7 O0 de la noche el dia de la eleccion
SECCION 4 Que dicha eleccion para la aceptacion de la enmienda
a la Carta Constitucional tenga lugar de acuerdo con los requisitos
del Codigo de E leccion del Estado de Texas
SECCION 5 Solamente votantes calificados de la Ciudad de
Denton tendran el derecho de votar en dicha eleccion
SECCION 6 Se dara aviso de la eleccion para la presentacion
de las enmiendas pot medio de la publicacion de esta ordenanza en el
periodico oficlal de la Ciudad de Denton el mismo dia en cada de
dos semanas sucesivas, la fecha de la primera publicacion a ser
no memos que catorce (14) dias antes de la fecha fi3ada para
la eleccion Se fiJara aviso de dicha elecc~on tamblen en tres
(3) lugares publicos dentro de los limites de la Ciudad no menos
que treinta dias antes de la fecha de eleccion Los resultados
de dicho fiJo sera dado pot afidavit del Secretario Municipal
~ECCION 7 Que Lee Knox sea, y este por este medio, nombrado
3uez que preside de dicha eleccion en el lugar de votacion y que
Bob Miller sea, y este pot este medzo, nombrado 3uez que preszde
suplente, de dicha eleccion en el lugar de votacion y el juez que
preside nombrara tantos oficiales de eleccion como sean necesarios
para el conducto apropiado de la eleccion Todos los Jueces y
oficiales seran votantes calificados de la Ciudad Despues de tenet
dicha eleccion, el Juez de eleccton lo mas pronto posible data su
resultado al Secretario Municipal y al Alcalde, y el Secretario
despues presentara dichos resultados al ConceJo Municipal para
el escrutinio de dicha eleccion Se pagara al Juez que preside
de la eleccion la suma de $~ ~ pot hora, y una suma adlcional
de $ 20~POr sus servicios en transmitir los resultados de la
eleccton Se pagara al Juez que preside suplente la suma de $ ~
por hora y se pagara a cada Juez de eleccion la suma de $
por hora pot sus servicios en el mantenimiento de dicha eleccion
Dichas recompensas no excederan las cantldades maximas fi]adas
en el Articulo 3 08, Codigo de Eleccion de Texas, a saber
$3 50 por hora para cada oficial de eleccion, y una cantidad
adictonal pagado al Juez que preside pot transmitir los resultados,
no excediendo veinte dolares ($20 00)
SECCION 8 Se daran los ¥otos en ausencia para dicha eleccion
en la oficina regular del Secretario Municipal en la Casa Municipal
de Denton y dicho lugar para votos en ausencia estara abierto
pot no menos que ocho (8) horas cada dia de los votos en ausencia,
el cual no sea sabado, domingo o un feriado oficial del Estado,
comenzando el dia vetnte (20) y continuando hasta el fin del dia
cuarto (4) antes de la fecha de dicha eleccion Dicho lugar de
votos en ausencia quedara abierto dentro de las horas de las
/~ de la manana y las 7 O~ de la noche
SECCION 9 Esta ordenanza sera vigente inmediatamente desde y
despues de su aceptacion como la ley estipule en dichos casos
