AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR THE
CLOSING AND VACATING ALL OF THE UTILITY EASEMENT DESCRIBED IN A
CERTAI~ EASEMENT DATED MAY 4, 1971, AND FILED OF RECORD IN
VOLUME 621, PAGE 453 OF THE DEED RECORDS OF BENTON COUNTY,
TEXAS FROM CRAWFORD BUILDING CORPORATION TO THE CITY OF DENTON,
TEXAS,[ PROVIDING FOR THE REVERSION OF THE FEE TO SAID LAND,
AUTHOR[IZING NECESSARY LEGAL DOCUMENTS TO BE PREPARED AND
SIGNED,, AND PROVIDING AN EFFECTIVE DATE
WHEREAS, the City Council of the Ctty of Denton, Texas,
actingI pursuant to law, and upon the request and pettt~on of
the Grantee heretn, deems it advtsable to abandon and convey
the helre~nafter described utlltty easement to Grantee and ~s of
the op~nton that the original uttltty easement herelnafter
described ~s not needed for publtc use, and
WHEREAS, the City Council of the Ctty of Denton ts of the
opinion that the best tnterest and welfare of the publtc wtll
be served by abandontng and conveytng the same back to Grantee
tn order to adopt a new easement for the benefit of the Ctty
and Grantee,
NOw, THEREFORE, THE COUNCIL OF THE CITY OF DENTON, TEXAS,
HEREBYiORDAINS
SECTION I
That the hereinafter described publtc uttltty easement be
and the same ts, hereby est~ngu~shed, vacated and permanently
abandoned as an easement for public uttl~ttes ~nsofar as the
rtght, tttle and easement of the public are concerned
Ail th,at certatn lot, tract or parcel of land lying and betng
sxtuated ~n the C~ty and County of Denton, State of Texas, and
bexng ,part of the R Beaumont Survey, Abstract No 31, and
being part of a tract of land conveyed by Jack Sktles to
Crawfotd Butldtng Corporation by Deed as recorded ~n Volume
574, P~ge 191 of the Deed Records of Denton County, Texas, and
more particularly descrtbed as follows
BEGINNING at a potnt ~n the south boundary ltne of said tract,
satd p0~nt of beg~nntng ly,ng tn the north r~ght of way l~ne of
State 'Htghway 24 and bexng 256 0 feet east of the southwest
corner~of said tract,
THENCE north 54o 14' west, passing at 107 0 feet the
northeast corner of a building and continuing north 52° 14'
west a,total distance of 111 0 feet to a point for a corner,
THENCE south 79° 26' west 4 0 feet north of and parallel with
the north wall of said building, a distance of 57 0 feet to a
point for a corner,
THENCE north 10o 34' west a d~stance of 16 0 feet to a point
for a corner,
THENCE~ north 79o 26' east 20 0 feet north of and parallel
with the north wall of said building, a distance of 75 0 feet
to a point for a corner,
THENCE south 32o 14' east a distance of 127 0 feet to a point
for a corner in the south boundary l~ne of said Crawford
Bmldl~g Corporation tract, said line also being the north
right of way line of State Highway 24,
THENCE south 71° 01' west along the south boundary line of
said boundary line of said Crawford Building Corporation tract,
same being the north right of way l~ne of State Highway 24, a
distance of 16 0 feet to the place of beginning and containing
2,944 0 square feet of land, more or less
S~CTION II
That the abandonment and conveyance provided for herein
shall extend to the right, title, easement and interest of the
City of Denton, and shall be construed to extend only to that
interest the governing body of the City of Denton may legally
and lawfully abandon and vacate
S~CTION III
That this abandonment and conveyance is made sub0ect to
all present zoning and deed restrictions, if the latter ex~st,
the dedication of new easements, and ~s sub0ect to all existing
easement rights of others, if any, whether apparent or non-
apparent, aerial, surface, underground or otherwise
SBCTION IV
That the City Attorney is hereby authorized to prepare and
del~ver whatever legal documents are required with regard to
the ~rea abandoned and conveyed herein, should such be
requested by Grantee hereunder, the same to be executed by the
Mayor on behalf of the City of Denton, and attested by the City
Secretary
