1979-052 NO AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DENTON, TEXAS, CREATING A NEW SECTION 20-2 OF CHAPTER 20, ARTICLE I ENTITLED "SALE AND DISPOSAL OF SURPLUS REAL PROPERTY OF THE CITY", PRO- VIDING A SEVERABILITY CLAUSE AND DECLARING AN EFFECTIVE DATE WHEREAS, the Legaslature of the State of Texas has dele- gated to local polltacal subdlvaslons the authority to d~spose of surplus real property, and WHEREAS, the City of Denton as a political subdav~s~on of thls State has, on occaslon, surplus real property whach as not needed or unusable for the purpose or~ganally antended; and WHEREAS, the C~ty Couno~l of the City of Denton believes it to be an the best interest of lts cltazens to dispose of such surplus real property by competitive bidding whenever practicable and allowable by the laws of th~s State, NOW~ THEREFORE, THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS PART I That the Code of Or~dnances of the Caty of Denton, Texas, be and the same is hereby amended by adding a new Section 20-2 of Chapter 20, Article I to be entitled Sale and D~sposal of Surplus Property of the C~ty, which shall hereafter read as follows SECTION 20-2 SALE AND DISPOSAL OF SURPLUS REAL PROPERTY OF THE CITY All sales and d~sposal of surplus real property belonging to the Clty of Denton shall be dasposed of by the City by an ordinance duly passed by a majority vote of the City Councll The C~ty Council may provlde by a majority vote an opportunaty for competataon for all sales and disposal of real property excluded from such requirements under the laws of the State of Texas ~f at determines after a review of all avaalable anforma- t~on and pertinent data that such property should be advertased for bids before disposal Compet~tlve bad procedures for all such sales of real property belongang to the Clty shall be in accordance wath the general laws of the State of Texas governing the sale and disposal of real property by a political subdivi- sion and the ordinances of the C~ty of Denton PA,RT II That ~f any section, subsection, paragraph, sentence, clause, phrase or word ~n th~s ordinance, or application there- of to any person or c~rcumstances Ks held lnvalld by any court of competent jurlsd~ctlon, such holding shall not affect the validity of the remaining portions of th~s ~d~nance, and the C~ty Council of the Clty of Denton, Texas, hereby declares ~t would have enacted such remalnlng portlons desplte any such ~nval~d~ty PART III Th~s ordinance shall become effective ~mmedlately upon its passage and approval PASSED AND APPROVED th~s the ~_~day of July, A D 1979 BILE NA~H, 'MAYOR CITY OF DENTONt TEXAS ATTES~~ CITY OF DENTON, TEXAS APPROVED AS TO LEGAL FORM: BUR~ R.
