1979-051AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR THE CLOSING AND VACATING OF A PORTION OF THE UTILITY EASEMENT IN LOT 6, BLOCK E, GRANT ESTATES ADDITION TO THE CITY AND COUNTY OF DENTON, TEXA~; PRO- VIDING FOR THE REVERSION OF THE FEE TO SAID LAND, AUTHORIZING NECES- SARY LEGAL DOCUMENTS TO BE PREPARED AND SIGNED, AND PROVIDING AN EFFECTIVE DATA WHEREAS, the Czty Council of the Czty of Denton, acting pursuant to law, and upon the request and petition of the Grantee herein, deems it advisable to abandon and convey the hereinafter described utility easement to Grantee and is of the opinion that said portion of the utility easement hereinafter described is not needed for public use, and WHEREAS, the City Council of the City of Denton is of the opinion that the best interest and welfare of the public will be served by abandoning and conveying the same back to Grantee, NOW, THEREFORE, THE COUNCIL COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS. SECTION I That the hereinafter described public utility easement in Lot 6, Block E, Grant Estates Addition to the City and County of Denton, Texas, be and the same is, hereby estlngulshed, vacated and permanently aban- doned as an easement for public utilities insofar as the right, title and easement of the public are concerned All that certain lot, tract or parcel of land lying and being situated in the City and County of Denton, State of Texas, and being part of the R Beaumont Survey, Abstract No 31 and being part of Lot No 6, Block E of the Grant Estates Addition, an addition to the City and County of Denton, and also being part of a tract of land as conveyed from Grant Estates to Hardy F Burke III by deed dated October 19 , 1978 and re- corded in Volume 918, Page 973 of the Deed Records of Denton County, Texas, and more particularly described as follows BEGINNING at a point in the east boundary line of sa~d tract, same be- lng the west raght of way lane of Alleen Street, said point of beginn- ing beang 6 0 feet south 0° 12' 45" east of the northeast corner of said traot, THENCE south 0° 12' 45" east along the east boundary l~ne of said tract same being the west right of way line of Alleen Street a distance of 4 0 feet to a point for a corner; THENCE south 89° 46' 51" west 10 0 feet south of and parallel with the north boundary lane of saad tract a distance of 150 19 feet to a point for a corner saad poant beang 15 0 feet east of the west boundary line of said tract, THENCE ~ft~° 23' 14~ west 15 0 feet east of and parallel with the west boundary lane of saad tract a d~stance of 4 0 feet to a point for a corner, THENCE north 89° 46' 51" east 6 0 feet south of and parallel wath the north boundary line of said tract a d~stance of 150 20 feet to the place of beginning and contaan~ng 600 78 square feet of land, more or less SECTIgN II That the abandonment and conveyance provided for hereln shall extend to the r~ght, t~tle, easement and ~nterest of the C~ty of Denton, and shall be construed to extend only to that interest the governing body of the C~ty of Denton may legally and lawfully abandon and vacate SECTION III That this abandonment and conveyance is made subject to all present zoning and deed restrictions, ~f the latter ex~st, and ~s subject to all existing easement r~ghts of others, if any, whether apparent or nonapparent, aerial, surface, underground or otherwise S .C ION IV That the City Attorney ls hereby authorized to prepare and deliver whatever legal documents are required w~th regard to the area abandoned and conveyed herein, should such be requested by Grantee hereunder, the same to be executed by the Mayor on behalf of the C~ty of Denton, and attested by the City Secretary SECTION V That the C~ty Secretary ~s hereby authorized to certify a copy of this ord~nanoe for recordation ~n the Deed Records of Denton County, Texas, and a certified copy of same shall be delivered to Grantee upon recelpt of the fee for publishing th~s ordinance SECTION VI Thls ordlnance shall take effect immediately from and after ~ts passage and publication ~n accordance w~th the provisions of the Charter of the C~ty of Denton PASSED AND APPROVED th~s the 17th day of July, A D 1979 CITY OF DENTON, TEXA~ BROOKS ~ CITY OF DENTON, TEXAS APPROVED AS TO LEGAL FORM.
