1979-044 NO AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DENTON, TEXAS PROVIDING FOR THE ABANDONMENT AND SALE OF CERTAIN PROPERTY HERETOFORE PURCHASED FOR STREET RIGHT-OF-WAY PURPOSES, BUT NOT USED OR NEEDED FOR SUCH PURPOSES ANY LONGER, AUTHORIZING THE SALE OF SUCH PROPERTY TO THE HIGHEST BIDDER, AND DECLARING AN EMERGENCY WHEREAS, the City of Denton heretofore purchased a parcel of land bounded by West Praarle on the South and Carroll Blvd on the West consastlng of 7,794 24 sq ft more or less, for street raght-of-way purposes, and WHEREAS, the saad property is not now suitable for street purposes and the Community Development Department of the C~ty of Denton has recommended that such property not be used for street purposes because the same is not now useable or suitable, and WHEREAS, the Clty Council of the City of Denton desires to go on record as abandonang any ~ntent~on of ever usang such property for street purposes, and to evadence the fact that such property has not heretofore been used for street purposes and as not a part of the street system of the C~ty of Denton, and that such property should be sold in order that the proceeds from the same might be used by the C~ty of Denton for street purposes, NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS SECTION I That the followang described property, to wit All that certain lot, tract or parcel of land lying and being s~tuated In the C~ty and County of Denton, State of Texas, and being part of the Wm Loving Survey, Abstract #759, and belng part of two tracts of land, hereinafter referred to as "tract two" beang conveyed to City of Denton by Deed dated October 29, 1969 and recorded in volume 598, Page 27 of the Deed Records of Denton County, Texas and "tract two" belng conveyed to Clty of Denton by Deed dated August 19, 1969 and recorded an volume 590, page 108 of the Deed Records of Denton County, Texas and more partIcularly described as follows BEGINNING at the southwest corner of sa~d "tract one" said polnt of beglnnlng lying in the north raght-of-way l~ne of Prairie Street, THENCE west along south boundary l~ne of "tract one", same beang the north right-of-way lane of Pra~rae Street, a d~s- tance of 61 feet to a point for a corner, THENCE north l°18'43'' east passlng at 56 01 feet the north boundary l~ne of sald "tract one" same beang the south boundary lane of sa~d "tract two" and continuing north 1° 18'43" east a total dlstance of 131 03 feet to a point for a corner in the north boundary lane of said "tract two", THENCE east, along the north boundary line of said "tract two", a distance of 58 feet to a point for a corner, be- lng the northeast corner of said "tract two", THENCE south along the east boundary line of said "tract two", passing at 75 0 feet the southeast corner of said "tract two", same being the northeast corner of said "tract one", a total d~stance of 131 0 feet to the place of beginning and containing 7,794 24 square feet of land, more or less be, and the same is, hereby abandoned insofar as said property may be used for street purposes by the City of Denton SECTION II That the above described property, not being su~t- able or useable for street purposes, and not having been used for street purposes, be, and the same is hereby declared to be, surplus property of the City of Denton, and upon recommendatlon of the Com- munity Development Department of the City of Denton should be disposed of as surplus and unuseable property in accordance with the Charter of the City of Denton and the laws of the State of Texas SECTION III That the Clty of Denton has officially advertised said property for sale and received sealed bids, and that such prop- erty be, and the same ~s hereby authorized to be, sold to the highest bidder, for the highest cash consideration SECTION IV That the funds reaelved from the sale of such prop- erty, after deducting necessary expenses, may be used for street pur- poses only SECTION V The fact that the above described property is not needed or useable for street purposes and the Community Development Department of the City of Denton has recommended that it not be used for street purposes, because it ~s unsuitable for such purposes, and that such property should be sold in order to permit the proceeds from the sale to be used for streetlpurposes, creates an urgency and an emergency in the preservatlon of the public health, safety and welfare, and ~t requires that this ordinance shall take effect mediately from and after its passage, as the law ~n such cases pro- vldes PASSED AND APPROVED BY THE CIT~Y COUNCIL OF THE CITY OF DENTON, TEXAS, on this the ,~- day of~/~-- , 1979 ~LL ~N-As~, ~0R CITY OF DENTON, TEXAS ATTEST~~, ~ CITY OF DENTON, TEXAS APPROVED AS TO LEGAL FORM BURT R SOLOMONS, ASST CITY ATTORNEY, CITY OF DENTON, TEXAS
