1979-031AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF DENTON, TEXAS, CALL-
ING AND ORDERING A SPECIAL RUN-OFF ELECTION TO BE HELD ON THE 21ST
DAY OF APRIL, 1979, THE SANE BEING THE FOURTEENTH DAY AFTER THE PRE-
CEDING E~ECTION FOR THE PURPOSE OF ELECTING ONE (1) COUNCILPERSON TO
PLACE TWO (2), AND ONE (1) COUNCILPERSON TO PLACE THREE (3) FOR THE
CITY OF DENTON, TEXAS, IN ACCORDANCE WITH THE PROVISIONS OF ARTICLE
III, SECTION 3 04 (b) OF THE CHARTER, ESTABLISHING THE HOURS AND
PLACE FOR THE SAID ELECTION, PROVIDING FOR PUBLICATION OF THIS ORDIN-
ANCE ANDi POSTING IN THREE PUBLIC PLACES IN THE CITY OF DENTON, TEXAS
AS NOTICE OF SAID ELECTION, DIRECTING THE CITY SECRETARY TO MAKE UP
THE OFFICIAL BALLOTS, CAUSING THE SAME TO BE PRINTED AND DELIVERED
TO THE PRESIDING OFFICER, PROVIDING FOR THE CANVASSING OF THE RETURNS
OF SAID ELECTION AND DECLARING THE RESULTS OF SANE BY THE CITY COUNCIL,
AND DELCARING AN EFFECTIVE DATE
WHEREAS, it ~s necessary to hold a special run-off elect~on to
f~ll Place Two (2) and Place Three (3) by electing one (1) Council-
person to each place for the City of Denton, Texas, now, therefore,
THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS
SECTION I
That a special elect~on shall be held ~n the Community Building
in the Civic Center on McKinney Street, ~n the C~ty of Denton, Texas,
between the hours of seven o'clock (7 00) A M and seven o'clock
(7 00) P N on the 21st day of April, A D 1979, the same being the
fourteenth day following the preceding elect~on, for the purpose of
electing One (1) Counc~lperson to fxll Place Two (2) and One (1)
Counc~lperson to fill Place Three (3) for the City of Denton, xn
accordance with the provisions of Article III, Section 3 04 (b) of
the Charter of the C~ty of Denton, Texas
SECTION II
That One (1) Councllperson shall be elected for a term of two
(2) years to fill Place Two (2), and the candidate who receives the
ma3ority of the votes cast for such place shall be declared elected
to that place on the City Council of the Czty of Denton, Texas, and
One (1) Councilpersen shall be elected for a term of two (2) years
to fill Place Three (3), and the candidate who receives the majority
of the votes cast for such place shall be declared elected to that
place on the City Council of the City of Denton, Texas In the
event of a tie vote at the special elect~on, the candxdates who t~e
shall cast lots in the presence of the City Secretary to determine
which one shall be declared elected, and sa~d lots shall be cast
w~thin five (5) days of the election
SECTION III
That Lee G Knox is hereby appointed presiding Judge of sa~d
election, and Robert A Miller is hereby appointed as his alternate,
and the said presiding Judge shall appoint such assistants as may
be necessary to properly conduct said elect~on, as provided by the
election code
SECTION IV
That the City Secretary shall prepare an official ballot for
such special election bearing the names of the two (2) candidates
who received the highest number of votes cast for Place Two (2)
and the names of the two (2) candidates who received the highest
number of votes cast for Place Three (3) at the regular election
SECTION V
That immediately after the counting of the votes the presiding
judge and/or alternate judge shall deliver the official returns of
the election to the City Secretary
SECTION VI
That on the Tuesday next following the election, the City Council
shall canvass the returns and declare the results which shall be re-
corded in the Minutes of the City Council
SECTION VII
That immediately after the election results have been declared
the Mayor shall deliver a certificate of election to the successful
candidates The Counc~lpersons so elected shall take the oath of
office as soon thereafter as practicable at which time his term of
off~ce shall begin
