1979-026AN ORDINANCE OF THE CITY OF DENTON, TEXAS, AMENDING CHAPTER 15 "PARKS AND RECREATION" BY ADDING A NEW SECTION 15-10 PROHIBITING POSSESSION OR CONSUMPTION OF ALCOHOLIC BEVERAGES WITHIN 100 FEET OF A PLAYING FIELD, DESIGNATING THE POSTING OF SIGNS, CALLING FOR ENFORCANENT, DECLARING A PENALTY, PROVIDING A SEVERABILITY CLAUSE AND DECLARING AN EFFECTIVE DATE THE coUNCIL OF THE CITY OF~ENTON, TEXAS, HEREBY ORDAINS SECTION I That Chapter 15 "Parks and Recreation" is hereby amended by adding a new Section 15-10 "Possession and Consumption of Alcohol Prohibited" which hereafter shall read as follows "Section 15-10 POSSESSION AND CONSUMPTION OF ALCOHOL PROHIBITED (1) Within the limits of any public park within the City of Denton, it shall be unlawful for any person or persons to possess or consume any alcoholic beverage within 100 feet of any portion of any playing field where the participants are under the age of eighteen (18), except ~f such possession or consumption ~s inside a motor vehicle located upon a designated parking area Playing f~eld is hereby defined as a marked f~eld area or the enclosure surrounding or setting apart a designated field area, including but not limited to a fence, for the purpose of conducting or engag- ing in an athletic game or activity Such actlvmtles would include but not be limited to football, baseball, softball, soccer, rugby, lacrosse, field hockey, tennis and basketball (2) The Director of Parks and Recreation shall cause signs to be erected at the playing f~elds within the various public parks not~fyi~g the p~blic of the Drovlsions of this ordinance (3) The Director of Parks and Recreation, Parks Attendants designated by the Director, and the Police Department, shall, in connection w~th their duties impose by law, diligently enforce the provisions of this ordinance, and they shall have the authority to eject from the park any person acting in violation of this ordinance SECTION II Any person who violates any provision of this ordinance shall be deemed guilty of a m~sdemeanor, and, upon conviction, shall be punished by a fine not to exceed Two Hundred Dollar~ ($200 00) Each day such a violation shall continue or be permitted, shall be treated as a separate offense SECTION III That if any section, subsection, paragraph, sentence, clause, phrase or word ~n th~s ordinance, or application thereof to any per- son or circumstances ~s held ~nval~d by any court of competent juris- diction, such holding shall not affect the validity of the remaining portions of this ordinance, and the C~ty Council of the C~ty of Denton, Texas, hereby declares it would have enacted such remaining portions despite any such ~nvalld~ty SECTION IV That this ordinance shall become effective fourteen days from the date of ~ts passage, and the C~ty Secretary ~s hereby d~rected to cause the caption of this ordinance to be published twice in the Denton Record-Chronicle, the official newspaper of the City of Denton, Texas, wlthln ten (10) days of the date of ~ts passage PASSED AND APPROVED This the 20th day of March, A D 1979 ~y ~ITCtrEnL'; MAYOR ~TY OF DENTON, TEXAS ATT~ ~ ~BROOKS HOLT, CITY SECRETARY CITY OF DENTON, TEXAS APPROVED AS TO LEGAL FORM PAUL C ISHAM, CITY ATTORNEY CITY OF DENTON, TEXAS
