AN ORDINANCE A~ENDING CHAPTER 3~ "TRAFFIC", ARTICLE II~ OF THE
CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS BY ADDING A NE~
SECTION 24-67 PROHIBITING TRUCK TRAFFIC ON A CERTAIN PORTION OF
BELL AVENUE, PROVIDING FOR EXCEPTIONS, PROVIDING A PENALTY, AND
DECLARING AN EFFECTIVE DATE
THE COUNCIL OF THE CITY OF DENTON, TEXAS HEREBY ORDAINS
SECTION I
That Chapter 24 "Traffic", Article II "Operation of Vehicles
Generally", is hereby amended by adding a new Section 24-67 which
will hereinafter read as follows
"Section 24-67 TRAFFIC PROHIBITED ON BELL AVENUE
(a) Unless otherwise provided herein, no motor vehicle, truck-
tractor, farm-tractor, road-tractor, commercial motor vehicle or
motor bus shall be operated over, on, or upon Bell Avenue between
Sherman Drive and Withers Street if such vehicle has a gross vehicle
weight in excess of 12,000 pounds As used ~n th~s section, "gross
vehicle weight" means the manufacturer's recommended gross vehicle
weight or the total gross weight for which the vehicle is registered,
whichever is greater
(b) The provisions of this ordinance shall not apply to any
emergency vehicle of the city or state, or to any motor vehicle,
truck-tractor, farm-tractor, road-tractor, commercial motor vehicle
or motor bus making deliveries and/or taking loads to destinations
on Bell Avenue between Sherman Drive and Withers Street or in the
immediate area of a street which intersects Bell Avenue between
Sherman Drive and Withers Street which requires travel over Bell
Avenue between Sherman Drive and Withers Street
S~CTION II
Any person who v~olates any provision of this ordinance shall
be deemed guilty of a misdemeanor, and, upon conviction, shall be
punished by a fine not to exceed Two Hundred Dollars ($200 00)
Each day such a violation shall continue or be permitted, shall be
treated as a separate offense
SECTION II,I
That this ordinance shall become effective fourteen days from
the date of its passage, and the City Secretary is hereby d~rected
to cause the caption of this ordinance to be published twice ~n the
Denton Record-Chronicle, the official newspaper of the C~ty of
Denton, Texas, within ten (10) days of the date of ~ts passage
