AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF DENTON, TEXAS
CALLING AND ORDERING AN ELECTION TO BE HELD ON THE 7TH DAY OF
APRIL, 1979, THE SAME BEING THE FIRST SATURDAY IN SAID MONTH
FOR THE PURPOSE OF ELECTING THREE (3) COUNCILPERSONS FOR THE
CITY OF DENTON, TEXAS, IN ACCORDANCE WITH THE PROVISIONS OF
ARTICLE II, SECTION 2 01 OF THE CHARTER OF THE CITY OF DENTON,
TEXAS, ESTABLISHING THE HOURS AND PLACE FOR THE SAID ELECTION,
PROVIDING FOR PUBLICATION OF THIS ORDINANCE AND POSTING IN
THREE PUBLIC PLACES IN THE CITY OF DENTON AS NOTICE OF SAID
ELECTION, DIRECTING THE CITY SECRETARY TO MAKE UP THE OFFICIAL
BALLOTS, CAUSING THE SAME TO BE PRINTFD AND DELIVERED TO THE
PRESIDINC OFFICER, PROVIDING FOR THE MAKING OF OFFICIAL RETURNS
OF THE SAID ELECTION AND DECLARING THE RESULTS OF SAME BY THE
CITY COUNCIL, AND DECLARING AN EFFECTIVE DATE
WHEREAS, it ls necessary that nominations for election to
C~ty Council be f~led not later than thirty (30) days prior to
the date of election, now, therefore,
THE COUNCIL OF THE CITY OF DENTON, TEXAS HEREBY ORDAINS
SECTION I
That an elect~on shall be held ~n the Community Building, ~n
the Cmvlc Center on East McKlnney Street, in the C~ty of Denton,
Texas, between the hours of seven o'clock (7 00) a m and seven
o'clock (7 00) p m on the 7th day of April, A D 1979, the same
being the first Saturday of sa~d month, for the purpose of electing
three (3) Counc~lpersons for the C~ty of Denton, in accordance w~th
the provisions of Article II, Section 2 01 of the Charter of the
C~ty of Denton, Texas
SECTION II
(a) That three Counc~lpersons shall be elected to f~ll three
places, places one (1) two (2) and three (3) and the candidate who
receives the majority of the votes cast for each place shall be
declared elected to that place on the C~ty Council of the C~ty of
Denton for two (2) year terms
SECTION III
That not~ce of said election shall be given by the posting
of true cop~es of th~s ordznance, signed by the Mayor and attested
by the C~ty Secretary, ~n three public places of the said C~ty,
one of whzch places shall be at the Municipal Building, for thirty
(30) consecutive days prior to the date of sa~d election and th~s
ordinance shall be published in full one t~me in the Denton Record-
Chronicle at least thirty (30) days prior to said elect~on
SECTION IV
That ~- /~z~ is hereby appointed presiding
judge of sa~d electIon, and /~ ~'~LL~-~'~ ~s hereby
appointed as h~s alternate, and the sa~d presiding judge shall
appoint such assistants as may be necessary to properly conduct sa~d
elect~on, as provided by the elect~on code
SECTION V
That the C~ty Secretary shall make up the official ballot from
the names presented to h~m by application or nominating petitions as
provided by Article III, Section 3 02 and 3 03 of the Charter of the
C~ty of Denton, Texas, and he ~s hereby authorized and d~rected to
have the ballots to be used ~n such elect~on printed and delivered
to the sa~d presiding judge
SECTION VI
That ~mmedlately after the counting of the votes the presIding
judge shall deliver the official returns of the election to the C~ty
Secretary
SECTION VII
That on the Tuesday next following the elect~on, the City
Council shall canvass the returns and declare the results which
shall be recorded ~n the Minutes of the Council
SECTION VIII
That the candidate who receives the majority of the votes cast
for each place shall be declared elected and the Mayor shall deliver
certificates of elect~on to the successful candidates If two or
more candidates shall tie with the h~ghest number of votes or ~f no
candidate receives a majority of the votes cast for that place, the
Council shall order a second elect~on to be held on the fourteenth
day after the first elect~on at which only the names of the two
candidates who receive the h~ghest number of votes for that place
or the candidates who t~ed w~th the h~ghest number of votes at the
first elect~on shall be printed on the ballot In the event of a
t~e at the second election, the t~ed candidates shall cast lots to
determine which one shall be declared elected to that place
