AN ORDINANCE AMENDING CHAPTER 25 OF THE CODE OF ORDINANCES OF THE
CITY OF DENTON, TEXAS, BY AMENDING SECTION 25-59 (a) RESIDENTIAL
RATE (S-l) TO PROVIDE A NEW METHOD FOR COMPUTING MAXIMUM BILLING,
PROVIDING A SEVERABILITY CLAUSE, AND DECLARING AN EFFECTIVE DATE
THE COUNCIL OF THE CITY OF DENTON , TEXAS, HEREBY ORDAINS
PART I
That the Code of Ordinances of the City of Denton, Texas,
hereby m/nended and changed so that Chapter 25, Article III, Division
2 "Service Rates", Section 25-59 reads as follows
"SectIon 25-59" - SCHEDULE
The rates to be charged by the City of Denton for sanitary
sewer servloe shall be based on water consumption and are hereby
amended as follows
(a) RESIDENTIAL RATE (S-l)
(1) New Monthly Rate
0-2,000 gallons $2 95
above 2,000 gallons 53 per 1,000 gallons
B~lllng shall be based on 98% of water consumption
but shall not exceed a maxmmum of 20,000 gallons
Monthly bmllings for the permod March thru November
shall be based on the second h~ghest monthly rate
of water oonsumptmon during the mmmedmately prmor
months of December thru February Bill~ngs for the
months of December thru February shall be based on
actual consumption
New residential customers that do not have a full
prior non-~rr~gatlonal history (December through
February) w~ll have a maximum b~ll based on 98% of
water consumption or 7,000 gallons of water con-
sumption, whichever ~s less
PART II
That If any section, subsection, paragraph, sentence, clause,
phrase or word ~n th~s ordinance, or application thereof to any
person or c~rcumstances ~s held ~nval~d by any court of competent
jurisdiction, such hold~ng shall not affect the validity of the
remaining port~ons of th~s ordinance, and the C~ty Council of the
C~ty of Denton, Texas, hereby declares ~t would have enacted such
rema~n*ng portions despite any such ~nvahd~ty
PART III
That th~s ordinance shall become effective w~th the customer
ut~hty statements sent by the C~ty of Denton on or after March
1979, and the C~ty Secretary ~s hereby d~rected to cause the caption
of th~s ordinance to be published twice ~n the Denton Record-Chronicle,
the official newspaper of the C~ty of Denton, Texas, w~th~n ten (10)
days of the date of ~ts passage
