1979-006 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF DENTON, TEXAS,
ESTABLISHING A POLICY WITH RESPECT TO CALLING AN ELECTION WHERE
THE CITY HAS THE RIGHT TO APPROVE OR DISAPPROVE A GENERATING
PROJECT PROPOSED TO BE UNDERTAKEN BY THE TEXAS MUNICIPAL POWER
AGENCY, AND PROVIDING AN EFFECTIVE DATE
WHEREAS, the Cmty of Denton, Texas, has heretofore executed
a Power Sales Contract with the Texas Munmc~pal Power Agency (said
contract being dated September 1, 1976) whmch ms mdentmcal mn mrs
terms with contracts executed between the Agency and the Cmtmes
of Bryan, Garland and Greenvmlle, Texas, and
WHEREAS, the said Power Sales Contract provmdes, mn part, that
before the Agency may mssue bonds to provmde for the construction
eor acquismtmon of any power generatmng facmlmty (or mnterest there-
mn) and transmissmon facility requmred to connect or interconnect
such generating facmlmty with a cmty or others (all of whmch is
hereafter referred to as a "Generating Project"), the same must be
approved (in manner provmded in Sectmon 13 of the samd Power Sales
Contract) by the Cmty of Denton, and
WHEREAS, mt appears that the Texas Munmcmpal Power Agency may
hereafter seek the approval of an addmtmonal Generatmng Project and
thms governmng body desmres to establmsh a polmcy for the future
approval thereof by thms Cmty,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DENTON, TEXAS,
HEREBY ORDAINS
SECTION I
(1) In the event the Texas Munmcipal Power Agency hereafter
requests that the Cmty of Denton approve a Generatmng Project, then
the City Council of the City of De~ton, Texas, shall call and order
that an election be held wlthzn the Czty of Denton on the proposi-
tion of whether such Generating Pro3ect shall be approved If a
majority of the particlpatzng qualzfled electors vote in favor of
such Generating Project, then the Czty Council of the Czty of Denton
shall be authorized to approve the same
(2) That the City of Denton has previously approved the Texas
Munzcipal Power Agency electrzc generatzng pro3ect known as "Bryan
Lignite Number One" and the project that permits Texas Municipal
Power Agency to partzczpate in the ownership and operation of the
"Comanche Peak Nuclear Steam Electric Generating Project", the
approval of those pro3ects is hereby reaffzrmed
(3) The provislons of paragraph 1 of this Section shall not
be applicable to approval of System Development and Relzabzlzty
Expenditures, to Developmental Projects (as those terms are defzned
zn the said Power Sales Contract), nor to those projects described
in paragraph (2) of th~s Section
SECTION II
That th~s ordinance shall become effective fourteen days from
the date of ~t$ passage, and the City Secretary is hereby d~rected
to cause the caption of this ordInance to be published twice in the
Denton Record-Chronicle, the official newspaper of the C~ty of
Denton, Texas, within ten (10) days___.of the date~ .~f its passage
