1979-069 ORDINANCE NO AN ORDINANCE OF THE CITY OF DENTON, TEXAS, DISANNEXING CERTAIN PORTIONS OF LAND AS A PART OF THE CITY OF DENTON, AND DECLARING AN EFFECTIVE DATE WHEREAS, it has been proposed to the City Council of the C~ty of Denton, Texas, that it is desirable and to the best ~nterest of the City of Denton, Texas, that the property described here~n be d~sannexed as a part of said City, and WHEREAS, the City of Denton has not been able to and does not foresee being able to provlde governmental and proprletary services to the property w~thln the next three years which is substantially equivalent to the standard of governmental and proprletary services furnished by the C~ty to other areas s~mllar in topography, patterns of land utilization, and population density of the property, and WHEREAS, ~t appears that the ma]orlty of the owners of the land more particularly described below are desirous of being d~sannexed from the C~ty of Denton, Texas, All that certain lot, tract or parcel of land, lylng and being situated ~n the C~ty and County of Denton, State of Texas, and being all of a called 71 73 acre tract of land as conveyed by deed dated June 20, 1956, from Terrell W King, Jr and Terrell Wh~teman K~ng, III, to Genella Elizabeth K~ng, as shown of record · n Volume 424, Page 136 of the Deed Records of Denton County, Texas, all being out of the James Severe Survey, Abstract No 1164, and being more particularly described as follows BEGINNING at a steel pin at the northwest corner of the above mentioned called 71 73 acre tract, same being the northwest corner of the James Severe Survey, Abstract No 1164, sa~d point of beginning being 20 feet west of the centerl~ne of a north and south public road whose width is 60 feet, sa~d beginning point being in what was the west boundary l~ne of a public road whose w~dth at that time was 40 feet, THENCE north 89 degrees 34 minutes 11 seconds east along the north boundary line of said James Severe Survey, and the north boundary l~ne of said called 71 73 acre tract, same belng a fence line, 2085 00 feet, to a steel p~n and railroad crosstle fence corner post for the northeast corner of sa~d 71 73 acre tract, and being in the west boundary l~ne of the Texas and Pacific Railroad r~ght of way, THENCE southwesterly, along the arc of a curve to the left and the west boundary l~ne of the Texas and Pacific Railroad, (the chord of this part of curve being south 29 degrees 40 minutes 14 seconds west), 450 00 feet to a steel p~n for the pc of said curve, THENCE south 26 degrees 17 m~nutes west along the fence line and the west boundary l~ne of the Texas and Pacific Railroad, 650 00 feet to a steel pin for corner, THENCE south 27 degrees 24 m~nutes west along the west boundary l~ne of sa~d Texas and Pacific Railroad, 500 00 feet to a steel pin for a corner, THENCE south 28 degrees 02 minutes west along fence line and the west boundary line of sad Texas and Pacific Railroad, 2782 63 feet to a steel pin for the south corner of the King 71 73 acre tract and being in the west boundary l~ne of the James Severe Survey, Abstract No 1164, and being 20 feet west of the centerl~ne of public road running north whose w~dth ls 60 feet, THENCE north 00 degrees 32 mlnutes 30 seconds west along the west boundary l~ne of said James Severe Survey, 3858 38 feet, to a point of beginning and containing 88 083 acres of usable land, or net acreage, and 4 429 acres ~n public road making a total d~stance of 92 512 acres of land, more or less NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS SECTION I (1) That the matters and facts reclted herein in the preamble of this ordinance are hereby found and determined to be true and correct, (2) That, pursuant to Articles 970a and 1175(2), Vernon's Texas C~v~l Statutes, the above described property ~s hereby d~scont~nued as a part of the C~ty of Denton, Texas (3) That the C,ty Secretary ~s hereby authorized and directed to enter this Ordinance on the m~nutes and records of the C~ty of Denton, Texas, to the effect that sa~d property ~s d~sannexed as a part of the C~ty of Denton, Texas, and after the entry of th~s ordinance the sa~d property shall cease to be a part of the City of Denton, Texas SECTION II That th~s ordinance shall become effective ~mmedlately after ~ts passage and approval PASSED AND APPROVED this the 4th day of September, A D 1979 BI~ NASH, MAYOR CITY OF DENTON, TEXAS ATTEST t'BROOKS }{OLT, CITY SECRETARY CITY OF DENTON, TEXAS APPROVED AS TO LEGAL FORM NS, ACTING CITY ATTORNEY, CITY OF DENTON, TEXAS
