AN ORDINANCE AUTHORIZING THE DIRECTOR OF ENGInEERInG A~D DE'~3~LOP-
AND THOROUGHFARES, PROVIDING A SEVERABILITY CLAUSE, PROVIDING A
PENALTY; AND DECLARING AN EFFECTIVE DATE
THE COHNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS
SECTION I
(1) The Director of Engineering and Development of the C~ty
of Denton, Texas is authorized to temporarily prohibit or restrict
the parking of vehicles on the streets and thoroughfares of the
City for the purpose of fac~l~tatlng street construction, recon-
struction, or repairs and for the safe and prompt movement of
traffic at the construction slte
(2) The temporary or emergency restrictions shall take effect
at such time as the appropriate trafflc control sign, signal or
device is ~n place as required under the traffic ordinances of the
City Temporary or emergency restrictions shall remain ~n effect
for a period of time not to exceed n~nety (90) days unless other-
wise provided in th~s ordinance
(3) That ~f the Director of Engineering and Development de-
termines that a hazardous condition st~ll exists after the exp.-
ration of the n~nety (90) day period due to street construction,
reconstruction, or repairs and an extension of temporary restric-
tions is necessary for the peace, safety and general welfare, then
the D~rector of Engineering and Development ~s empowered, upon
approval by the City Manager, to extend the temporary restrictions
governing parking at the construction site, until the completion
of the pro3ect
(4) The Dlrector of Englneerlng and Development shall keep
a record of the temporary and emergency restrictions on parking,
and these records w~ll reflect the location at which the traffic
control sign, signal or devlce was ~nstalled and the date that the
traffic control s~gn. s~gnal or device was installed and removed
SECTION II
That if any section, subsection, paragraph, sentence, clause,
phrase or word in this ordinance, or application thereof to any
person or circumstances ~s held ~nval~d by any court of competent
jurlsd~tlon, such holding shall not affect the valldlty of the
remaining port~ons of th~s ordinance, and the City Council of the
City of Denton, Texas, hereby declares it would have enacted such
remaining portions despite any such ~nvalld~ty
SECTION III
Any person who violates any provision of this ordinance shall
be deemed guilty of a misdemeanor, and, upon conviction, shall be
punished by a flne not to exceed Two Hundred Dollars ($200 00) Each
day such a v~olat~on shall continue or be permitted, shall be treated
as a separate offense
SECTION III
That this ordinance shall become effective fourteen days from
the date of ~ts passage, and the C~ty Secretary ~s hereby directed
to cause the caption of thls ordinance to be published twice ~n the
Denton Record-Chronlcle, the official newspaper of the Clty of
Denton, Texas, wlth~n ten (10) days of the date of its passage
