1978-073AN ORDINANCE OF THE CITY OF DENTON, TEXAS, AMENDING CHAPTER 15
"PARKS AND RECREATION" BY ADDING A NEW ~ECTION 15-10 PROHIBITING
POSSESSION OR CONSUMPTION OF ALCOHOLIC BEVERAGES WITHIN 100 FEET
OF A PLAYING FIELD; DESIGNATING THE POSTING OF ~IGNS, CALLING FOR
ENFORCEMENT, DECLARING A PENALTY, PROVIDING A SEVERABILITY CLAUSE
AND DECLARING AN EFFECTIVE DATE
THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS:
SECTION I
That Chapter 15 "Parks and Recreation" is hereby amended by
addang a new Sectaon 15-10 "Possession and Consumption of Alcohol
Prohabated" which hereafter shall read as follows:
"Sectaon 15-10 POSSESSION AND CONSUMPTION OF ALCOHOL
PROHIBITED
(1) wlthan the limits of any public park wlthzn the Czty
of Denton, at shall be unlawful for any person or persons to possess
or consume any alcoholic beverage within 100 feet of any portmon of
any playing field except if such possessmon or consumptmon is ~nslde
a motor vehicle located upon a designated parking area Playzng
fmeld as hereby defaned as a marked f~eld area or the enclosure
surroundlng or settang apart a designated field area, lncludang but
not lamlted to a fence, for the purpose of conducting or engaging
an an athletac qame or actlvaty Such activities would znclude but
not be lamated to football, baseball, softball, soccer, rugby,
lacrosse, faeld hockey, tennms and basketball
(2) The Director of Parks and Recreation shall cause s~qns
to be erected at the playing fmelds within the varmous publmc parks
notifying the public of the provlsaons of this ordinance
(3) The Director of Parks and Recreation, Parks Attendants
designated by the Dmrector, and the Polmce Department, shall, mn
connectzon with their dutaes mmposed by law, dllmgently enforce the
provlsaons of thas ordanance, and they shall have the authority to
elect from the park any person acting in v~olatzon of thzs ordinance
~ECTION II
Any person who vaolates any prov~smon of this ordinance shall
be deemed gualty of a misdemeanor, and, upon convmctmon, shall be
punished by a fane not to exceed Two Hundred Dollars ($200 00) Each
day such a violation shall continue or be permitted, shall be treated
as a separate offense
SECTION III
That if any section, subsection, paragraph, sentence, clause,
phrase or word an this ordinance, or appllcatzon thereof to any person
or czrcumstances Ks held invalid by any court of competent ]urlsdlctzon,
such holding shall not affect the validity of the remaining portions
of this ordinance, and the City Council of the Czty of Denton, Texas,
hereby declares zt would have enacted such rema~n~n~ portions desplte
any such invalidity
SECTION IV.
That this ordinance shall become effective fourteen days from
the date of its passage, and the City Secretary zs hereby dzrected to
cause the caption of this ordinance to be published twice an the
Denton Record-Chronicle, the official newspaper of the City of Denton,
Texas, within ten (10) days of the date of its passage
