1978-047 NO AN ORDINANCE AMENDING THE ZONING MJ~P OF THE CITY OF DENTON, TEXAS, AS SAME WAS ADOPTED AS AN APPENDIX TO THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS~ BY ORDINANCE NO 69-1, AND AS SAID MAP APPLIEq TO APPROXIMATELY 4 9 ACRES OF LAND, AS SHOWN THIS D~TE ON THE OFFICIAL TAX MAP OF THE CITY OF DENTON, TEXAS, AND MORE PARTI- CULARLY DESCRIBED THEREIN, AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS SECTION I That the Zonang Map of the Caty of Denton, Texas, adopted the 14th day of January, 1969, as an Appendax to the Code of Ordinances of the City of Denton, Texas, under provasaons of Ordinance No 69-1, be, and the same ~s hereby amended as follows All the hereanafter deserabed property ls hereby removed from the Agricultural "A" Distract as shown on said Zon- ing Map, and all provisions of Ordinance No 69-1, adopted the 14th day of January, 1969, as amended, shall hereafter apply to said property as General Retail "GR" Dl~trlct in the same manner as other property located in the General Retail "GR" District, All that certaan lot, tract or parcel of land lying and be- lng situated in the John McGowan Survey, Abstract No 797, Denton County, Texas, being part of a tract of 11 91 acres deeded by V R Clearman, et al, to J Homer Kerley, re- corded in Volume 441, Page 658, Deed Records of Denton County, Texas, this tract lying south of U S Highway 35E and being more partacularly described as follows- BEGINNING at a fence corner at the southwest corner of a tract conveyed by John I. Sublett to Ida Lee Collier by deed recorded in Volume 306, Page 475, Deed Records of Denton County, Texas, saad corner beang also the south- west corner of said 11 91 acre tract, sald beginning corner beang 1252 0 feet west of the east lane of said McGowan Survey, THENCE north 0° 05' west with a fence on the west line of saad tract 863 2 feet to a corner on the southwest right of way of sa~d U S Hlghway 35E. THENCE south 39° 02' east with saad r~ght of way 68 6 feet to an angle therein, THENCE south 47~ 27' east with saad r~ght of way 344 7 feet to a steel pin for corner, THENCE south 0° 27' east with a fence 580 3 feet to a steel pin at a fence corner on the south l~ne of saad tracts, THENCE north 89" 23' west with a fence on said south lane 300 4 feet to the place of beglnnang and containing in all 4 900 acres of land SECTION II That the Clty Council of the Clty of Denton, Texas hereby finds that such change is in accordance w~th a comprehensive plan for the purpose of promoting the general welfare of the Caty of Denton, Texas, and with reasonable consideration, among other things for the character of the dastract and for ~ts peculaar suitability or particular uses, and with a view to conserving the value of the bulldangs, protectang human laves, and encouraging the most appro- priate uses of land for the maximum benefit to the Caty of Denton, Texas, and its c~tazens SECTION III That thas ordanance shall be an full force and effect ammeda- ately after ats passage and approval, the requared public hearangs havang heretofore been held by the Plannang and Zonang Commassaon and the C~ty Councal of the C~ty of Denton, Texas, after givanq due notace thereof PASSED and APPROVED Thas the 19th day of September, A D 1978 ~Ty~ITCHEL~ / MAYOR OF DENTON, TEXAg ATTEST APPROVED AS TO LEGAL FORM PAUL C ISHAM, CITY ATTORNEY CITY OF DENTON, TEXAS
