1978-030AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF DENTON, TEXAS,
AS SAME WAS ADOPTED AS AN APPENDIX TO THE CODE OF ORDINANCES OF
THE CITY OF DENTON, TEXAS, BY ORDINANCF NO 69-1, AND AS SAID MAP
APPLIES TO 117 77 ACRES OF LAND MORE PARTICULARLY DESCRIBED HERE-
IN, AND DECLARING AN EFFECTIVE DATE
THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS
SECTION I
That the Zoning Map of the City of Denton, Texas, adopted the
14th day of January, 1969, as an Appendix to the Code of Ordxnances
of the City of Denton, Texas, under provisions of Ordinance No 69-1,
be, and the same ~s hereby amended as follows
Ail the herexnafter described property is hereby removed from
the Planned Development "PD" District as shown on said Zoning
Map, and all provisions of Ordinance No 69-1, adopted the
14th day of January, 1969, as amended, shall hereafter apply
to said property as L~ght Industrxal "LI" Dlstrxct in the same
manner as other property located in the Light Industrial "LI"
Dlstrxct,
BEING all that certain tract or parcel of land situated in the
M E P & P R R Survey, Abstract No 927, Denton County, Texas,
consisting of a called 55 acre tract conveyed by B H Williams,
et ux, to B H Williams, Jr , on September 12, 1907, recorded
in Volume 101, Page 582 and a (called) 5b acre tract conveyed
by Mony A Snxder et vlr to B H Williams, Jr , on September
2, 1907, recorded xn Volume 106, Page 299 and a (called) 20 acre
tract conveyed by George Morrow, et ux to B H Williams on
September 8, 1919, recorded in Volume 167, Page 144, Deed re-
cords of said County except certain right of way for Highway 288
deeded off the west s~de of said 55 acre tract and except for a
21 foot wide strip sold off the south end of the 55 acre tract
and the 50 acre tract, the remaining acreage being more parti-
cularly described as follows
BEGINNING at a fence corner at the existing southwest corner
of saxd 55 acre tract on the east rxght of way of said Highway
288 and on the north line of said 21 foot wxde strmp sold off
the south end of the original tracts, said beginning corner be
lng 120 feet east and 21 feet north of the original southwest
corner of the 55 acre tract, said corner having been on the west
line of said M E P & P R R Company Survey, Abstract No 927,
THENCE north 2 degrees 25 mxnutes east with the east r~ght of
way of said H~ghway 1728 0 feet to an angle therein,
THENCE north 5 degrees 29 minutes east wxth said right of way
200 0 feet to a right of way post for corner,
THENCE north 2 degrees 25 minutes east with said right of way
227 2 feet to a right of way post for corner,
THENCE down the middle of Pecan Creek north 77 degrees 54 min-
utes east 538 4 feet to a corner,
THENCE down the middle of Pecan Creek east 348 0 feet to a
corner,
THENCE down the middle of Pecan Creek south 87 degrees 21 m~n-
utes east 817 8 feet to the southwest corner of said 20 acre
tract on the north line of said 50 acre tract,
THENCE north 2 degrees 10 minutes east with a fence on the east
line of sa~d 20 acre tract 1320 0 feet to a corner on the south
rxght of way line of FM Road 426 (Old McKlnney Road),
THENCE south 74 degrees 48 minutes east w~th sa~d right of way
660 2 feet to an angle there~n,
THENCE south 46 degrees 43 m~nutes east w~th a fence 55 3 feet
to a corner on the east l~ne of said M E P & P R R Company
Survey, Abstract No 927 ~n Mayh~ll Road,
THENCE south 3 degrees 17 minutes west w~th sa~d survey line and
crossing said road 928 5 feet to a corner ~n a fence on the east
side of sa~d road,
THENCE south 5 degrees 54 m~nutes west with sa~d fence 226 2 feet
to a corner,
THENCE south 3 degrees 01 m~nutes west w~th sa~d fence on the east
line of sa~d road 2218 5 feet to the southeast corner of sa~d
tract and again on the east line of said survey,
THENCE north 89 degrees 29 m~nutes west along and near a fence on
the north l~ne of a 21 foot w~de str~p 2027 1 feet to the place
of beginning
SECTION II
That the City Council of the C~ty of Denton, Texas, hereby f~nds
that such change is ~n accordance w~th a comprehensive plan for the
purpose of promoting the general welfare of the City of Denton, Texas,
and w~th reasonable consideration, among other th~ngs for the character
of the d~str~ct and for ~ts peculiar suitability or particular uses,
and w~th a view to conserving the value of the buildings, protecting
human l~ves, and encouragmg the most appropriate uses of land for the
maximum benefit to the C~ty of Denton, Texas, and its citizens
SECTION III
That this ordinance shall be ~n full force and effect ~mmed~ately
after ~ts passage and approval, the required public hearings having
heretofore been held by the Planning and Zoning Commission and the C~ty
Council of the City of Denton, Texas, after g~vlng due notice thereof
