1978-024AN ORDINANCE AMENDING CHAPTER 25 OF THE CODE OF ORDINANCES OF THE
CITY OF DENTON, TEXAS, PROVIDING NEW WATER AND SEWER TAPPING FEES
AND NEW SERVICE RATE CHARGES FOR WATER AND SE~R SERVICE REPEALING
CONFLICTING ORDINANCES PROVIDING A SEVERABILITY CLAUSF AND
DECLARING AN EFFECTIVE DATE
THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS
PART I
That the Code of Ordinances of the Czty of Denton, Texas, is
hereby amended and changed zn the followzng partzculars
(1) Chapter 25, Artzcle I, Sectzon 25-7 zs hereby amended
by providing new rates for "Water Tappzng Fees",
"Water Meter Loops" and "Sewer Tappzng Fees" as follows

(2) Chapter 25, Article III, Division 2 "Service Rates"
Section 25-49 is hereby amended by amending the following
subsections
"Section 25-59 - SCHEDULE
The rates to be charged by the City of Denton for sanitary
sewer service shall be based on water consumption and are
hereby amended as follows
(a) RESIDENTIAL RATE (S-i)
(1) New Monthly Rate
0-2,000 gallons $2 95
above 2,000 gallons 53 per 1,000
gallons
Billing based on 98% of water consumption
Maximum billing of April through October shall be
based on second highest non irrigation month
(November through March) water consumption
(3) Payment Billing for service hereunder will be at
the net monthly rate, payment of which zs due on
or before the due date shown on the statement After
the due date shown on the statement, a penalty for
non-payment of the b~ll will be assessed and charged
The penalty shall be the net amount multiplied by
ten (10) per cent, and a gross amount will be shown
on the statement as the net amount plus the ten (10)
per cent penalty Service to users having overdue
bills may be discontinued, at the discretion of the
utility, w~thout not~ce to the customer There
shall be a charge of seventy ($70 00) dollars for
reconnecting such discontinued service
(b) COMMERCIAL AND INDUSTRIAL (S-2)
(1) Net Monthly Rate
0-4,000 gallons $5 00
above 4,000 gallons 60 per 1,000
gallons
B~ll~ng based on 80% of water consumption
In addition to the above charge for cormnerczal and
industrial, there will be added to the net monthly
rate an industrial surcharge based on the following
formula
Cu = Vu [(Bu - 260) B + (Su - 260) SI
Where Cu zs the surcharge for user X
Vu zs the billing volume for user X
Bu zs the tested BOD level for user X or
260 mg/1, whichever zs greater
B is the unmt cost factor for treating one
unit of BOD per 1,000 gallons ($ 000393)
Su zs the tested SS level for user X or
260 mg/1, whichever ~s greater
S is the unit cost factor for treating one
unit of SS per 1,000 gallons ($ 000397)
(c) SALES FOR RESALE (S-3) $ 58 per 1,000
gallons
(d) SALES TO CITY ACCOUNTS (S-4) 58 per 1,000
gallons
(e) EFFLUENT SALES TO STEAM GENERATING
PLANT (S-5) 12 per 1,000
gallons
(f) CUSTOMERS OUTSIDE CITY LIMITS
Customers outside the city llmzts shall be charged the
appropriate rate schedule as lzsted above multiplied by
one hundred fifteen (115) per cent except for (S-3) above
(3) Chapter 25, Article IV, Section 25-60 zs hereby amended by
amendzng the following subsections
"Section 25-60 - RATE SCHEDULE
The rates to be charged by the C~ty of Denton for water servzces
are hereby amended as follows
(a) RESIDENTIAL USERS (W-l)
(1) Monthly rate
Customer Charge $2 10 per month
0-10,000 gallons 90 per 1,000 gallons
10,000-50,000 gallons 75 per 1,000 gallons
above 50,000 gallons 70 per 1,000 gallons
(3) Payment Bzllzng for service hereunder wzll be at
the net monthly rate, payment of whzch ~s due on or
before the due date shown on the statement After
the due date shown on the statement, a penalty for
non-payment of the bmll will be assessed and charged
The penalty shall be the net amount multlplzed by
ten(10) per cent, and a gross amount wzll be shown
on the statement as the net amount plus the ten (10)
per cent penalty Servzce for users havzng overdue
bills may be discontinued, at the dzscretzon of the
utzlity, wzthout notice to the customer There
shall be a charge of four ($4 00) dollars for recon-
necting such discontznued service
(b) COMMERCIAL AND INDUSTRIAL (W-2)
Customer Charge $5 00 per month
Volume Charge 68 per 1,000 gallons
(c) SALES FOR RESALE (W-3)
Customer Charge $93 00 per month
Volume Charge 61 per 1 000 gallons
(d) UTILITY OPERATIONS (W-4)
Customer Charge $3 35 per month
Volume Charge 90 per 1,000 gallons
(e) SALES TO CITY ACCOUNTS (W-5)
Customer Charge $6 95 per month
Volume Charge 90 per 1,000 gallons
(f) SALES TO STEAM GENERATING PLANT (W-6)
Volume Charge $ 12 per 1 000 gallons

(g) FIRE SERVICE (W-7)
(1) Rate and monthly charge Each commercial or
industrial establishment requlrzng a standby fire
servzce lmne (unmetered) to serve sprznklers or
other private fire-fzghting equipment shall pay
for this service each month as follows
For each six-inch fire service lzne $3 65
For each ezght-inch fzre service lzne $4 20
(2) Availabzlity Each fire servzce line is not to be
used for any purpose other than fzre fightzng
(h) CUSTOMERS OUTSIDE CITY LIMITS
Customers outszde the czty lzm~ts shall be charged the
appropriate rate schedule a~ lf~ted above multiplzed by
one hundred f~fteen (115) per cent except for (W-3) above
PART II
That is any sectzon, subsection, paragraph, sentence, clause,
phrase or word in thzs ordinance, or applzcatzon thereof to any
person or circumstances is held invalzd by any court of competent
0urisdzction, such holding shall not affect the valzdity of the
remazning portions of thzs ordznance, and the Czty Counczl of the
C~ty of Denton, Texas, hereby declares zt would have enacted such
remaznzng portzons despite any such invalidzty
PART III
That this ordinance shall become effectzve on the 1st day of
July, 1978, and the City Secretary is hereby d~rected to cause the
captzon of this ordinance to be publzshed twice zn the Denton Record-
Chronzcle, the official newspaper of the Czty of Denton, Texas,
within ten (10) days of the date of its passage
