AN ORDINANCE AMENDING ORDINANCE NO 76-21 WHICH AMENDED THE ZONING
ORDINANCE (ORDINANCE NO 69-1) OF THE CITY OF DENTON, TEXAS, TO PER-
MIT THE ON-PREMISE SALE OF BEER AND/OR WINE AT THE NORTH TEXAS FAIR
GROUNDS, PROVIDING FOR CONDITIONS, PROVIDING A PENALTY, AND DECLARING
AN EFFECTIVE DATE
THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS
S~CTION I.
(1) That Section I (1) of Ordinance No 76-21 and the Zoning
Ordinance of the City of Denton, Texas adopted January 14, 1969, as
an Appendix to the Code of Ordinances of the C~ty of Denton, Texas,
as Ordinance No 69-1, as amended, be, and the same ~s hereby amended
as follows
"ARTICLE VII USE OF REGULATION DISTRICTS, USE OF LAND
AND BUILDINGS
A Legend for ~nterpret~ng schedule of use
The Tables in 7H shall be amended to ~nclude 'On-Premise
Sale of Beer and/or W~ne' ~n the following dlstr~cts
General Retail Service Dlstr~ct (GR)
Commercial D~str~ct (C)
Central Business D~str~ct (CB)
Light Industrial D~str~ct (LI)
Heavy Industrial D~strlct (HI)
Planned Development D~strxct (PD)
and to ~nclude 'On-Premise Sale of Beer and/or Wine'
,n a University D~strlct by Speclflc Use Permit, and
to permit the 'On-Premise Sale of Beer and/or W~ne'
at the property owned by the North Texas State Fair
Association and more fully described ~n the deed to
the Denton County Agricultural Fair Association and
recorded ~n Volume 546, Page 199 of the Deed Records
of Denton County, Texas That the on-premise sale
of beer and/er w~ne on the fair property w~ll be pur-
suant to the other conditions ~n th~s ordinance and
the Texas L~quor Control Act xnclud~ng the issuance
of a temporary permit for the on-premise sale of beer
and/or w~ne
SECTION II
Any person v~olatlng th~s article shall be guilty of a m~s-
demeanor and upon conv~ct~on shall be punished as provided by the
Texas L~quor Control Act, ~n the event ~t should be held that such
penalty does not apply to th~s article, then such persons shall be
f~ned not less than One Hundred ($100 00) Dollars nor more than Two
Hundred ($200 00) Dollars and each day of such violation shall con-
stltute a separate offense
SECTION III
That if any section, subsection, paragraph, sentence, clause,
phrase or word in th~s ordinance, or application thereof to any per-
son or circumstances is held ~nvalld by any court of competent ~ur-
~sd~ct~on, such holding shall not affect the validity of the rema~n-
lng portions of this ordinance, and the C~ty Council of the C~ty of
Denton, Texas, hereby declares ~t would have enacted such remaining
portions despite any such ~nval~d~ty
SECTION IV
That the C~ty Council of the C~ty of Denton, Texas, hereby
f~nds that such changes are ~n accordance w~th a comprehensive plan
for the purpose of promoting the general welfare of the C~ty of
Denton, Texas, and w~th reasonable consideration, encourages the
most appropriate uses of land for the maximum benefit to the C~ty of
Denton, Texas, and ~ts citizens
sECTION V
Th~s ordinance shall be declared an emergency and shall be-
come effective immediately after ~ts passage and approval
