1978-008AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF DENTON, TEXAS, AS SAME WAS ADOPTED AS AN APPENDIX TO THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS, BY ORDINANCE NO 69-1, AND AS SAID MAP APPLIES TO A 13 2 ACRE PORTION OF LOT 20, BLOCK 136-B, AS SHOWN THIS DATE ON THE OFFICIAL TAX MAP OF THE CITY OF DENTON, TEXAS, AND MORE PARTICULARLY DESCRIBED THEREIN, AND DECLARING AN EFFEC- TIVE DATE THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS SECTION I That the Zoning Map of the City of Denton, Texas, adopted the 14th day of January, 1969, as an Appendix to the Code of Ordinances of the C~ty of Denton, Texas, under provisions of Ordinance No 69-1, be, and the same is hereby amended as follows All the hereinafter described property ~s hereby removed from the Agricultural "A" D~strict as shown on sa~d Zon- ing Map, and all provisions of Ordinance No 69-1, adopted the 14th day of January, 1969, as amended, shall hereafter apply to said property as Planned Development "PD" Distr~ct in the same manner as other property located in the Planned Development "PD" DistriCt, All that certain lot, tract or parcel of land lying and be- lng situated ~n the City and County of Denton, State of Texas, and being a 13 2 acre portion of land out of Lot 20, Block 136-B, and being located generally between Stuart Road and Bell Avenue ~n the C~ty of Denton, Texas That this zoning change is sub3ect to the follow~ng conditions 1 No more than 100 units shall be developed on the multi- family site in this proposal The multi-family develop- ment, together with the recreational area~ shall require site plan approval and shall be designed in such a manner that will feasibly permit s~ngle family housing to be constructed on ad3oznlng properties as has been proposed 2 The proposal for detached s~ngle family homes on 40 by 100 foot lots will observe minimum setbacks provided for the SF-7 zone, except that one building wall may be con- structed on or near a side yard property line and the other side yard shall be a minimum of 10 feet Plat approval shall constitute site plan approval for this single family area 3 Approved plans for necessary drainage work will be re- quired at the plat approval stage The developers will provide necessary easements and will meet the requirements of the utility department concerning connection w~th the ex~stlng utility l~nes 4 The developer will provide a four foot w~de s~dewalk along his property on Stuart and W~ndsor at the t~me building constructlon takes place The developer w~ll be required to provide th~s walk ad3o~n~ng the area proposed for green- belt and recreation before the multi-family complex is developed 5 The drainage problem at the ~ntersect~on of Stuart and W~ndsor must be solved to the satisfaction of the C~ty, w~th the part~czpat~on of the developer, prior to the approval by the C~ty Council of the F~nal Plat SECTION II That the C~ty Council of the C~ty of Denton, Texas hereby f~nds that such change ~s ~n accordance with a comprehensive plan for the purpose of promoting the general welfare of the C~ty of Denton, Texas, and w~th reasonable consideration, among other th~ngs for the character of the d~str~ct and for ~ts peculiar suitability or par- t~cular uses, and w~th a v~ew to conserving the value of the build- ings, protecting human lives, and encouraging the most appropriate uses of land for the maximum benefit to the C~ty of Denton, Texas, and ~ts c~t~zens ~ECTION III That th~s ordinance shall be ~n full force and effect mmmedm- ately after ~ts passage and tract located generally between Stuart Road and Bell Avenue be changed from Agricultural {A} to Planned Development {PD) Devel- opment plans for the planned development propose the following uses A) 3 together with a detached single famtly development on small lots fronting Stuart Drtve Thts multi-family development ts proposed for a 5 8 acre tract and will have a maximum 100 untts, resultlnq in a unit density rouqhly comparable to that permitted under the Multl-Famtly Restrtcted {MF-R) zone The s~ngle family proposal is for detached houses on 40 by 100 foot lots and is propose: ~o be de e ~e~ in zero lot l~ne fashion This means that the bulldtngs are sited on the lot w~th one building wall on the lot line, leaving space for a usable side yard The untt dens,tv which is proposed for this s~ngle fam,~y development is between that permitted in a normal slngle faml,y (S~-7) and a duplex (2-F) zone It ~s the Planning Commission's feeling that the type of Intermediate housing proposed for this tract ts needed tn Denton and that the proposal ~s designed ~n a manner to be most compattble with adjoining development The multi-family complex is proposed for the center of the tract and is proposed to be surrounded by single family housing The planned devel- opment also proposes a recreation area and a greenbelt along the drainage- way that will act as a buffer between the multi-family complex and the ex~stlng subd~ws~ons There ~s good traffic access to the property Windsor is to be extended through the s~te by the c~ty as a very wide four lane drive and there are several nearby arterial streets that lead into town.
