1977-018NO -7 7-/8 AN ORDINANCE ANNEXING A TRACT OF LAND CONTIGUOUS AND ADJACENT TO THE CITY OF DENTON, TEXAS, BEING ALL THAT LOT, TRACT OR PARCEL OF LAND CONSISTING OF 201 38 ACRES OF LAND LYING AND BEING SITU- ATED IN THE COUNTY OF DENTON, STATE OF TEXAS AND BEING IN THE M E P AND P R R COMPANY SURVEY, ABSTRACT NO 950 DENTON COUNTY, TEXAS, CLASSIFYING THE SAME AS "A" AGRICULTURAL DISTRICT PROPERTY, AND DECLARING AN EFFECTIVE DATE WHEREAS, the request for annexation was introduced at a re- gular meeting of the City Council of the City of Denton, Texas, on the petition of Richard Smith of Denton State School, and WHEREAS, an opportunity was afforded, at a public hearing held for that purpose on February 15, 1977 for all interested per- sons to state their views and present evidence bearing upon the annexation provided by this ordinance, and WHEREAS, this ordinance has been published in full at least one time in the official newspaper of the City of Denton, Texas, prior to its effective date, and after the public hearings, NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS SECTION I That the hereinafter described tract of land be, and the same is hereby annexed to the City of Denton, Texas, and the same is made hereby a part of said City and the land and the present and future inhabitants thereof shall be entitled to all the rights and privileges of other citizens of said City and shall be bound by the acts and ordinances of said City now in effect or which may here- after be enacted and the property situated therein shall be subject to and shall bear its pro-rata part of the taxes levied by the City The tract of land hereby annexed is described as follows, to-wit All that certain lot, tract or parcel of land, lying and being situ- ated in the County of Denton, State of Texas, being the south 100 acres of a certain 254.7 acre tract of land, as conveyed by Warranty Deed dated May 16, 1957, from Harold L Goodman and wife, Tillie L Goodman and C P Smith and wife, Gwendolyn Smith to G A Godfrey and wife, Sue R Godfrey, and a 101 38 acre tract out of a certain 142 18 acre tract of land as conveyed by Warranty Deed dated July 24, 1956 from O L. Sargant and wife, Susie S Sargent, and Tom Starr, a single man (being the same person as T M Starr) to Alfred F Sellmeyer, all be- ing out of the M E P and P.R R Company Survey, Abstract No 950, and being more particularly described as follows BEGINNING at a steel pin at the southwest corner of the past men- tioned 254 7 acre tract of land, now in the name of G A Godfrey, and steel pin being in the southwest corner of the M E P and P R R Company Survey, Abstract No 950, THENCE north along the west boundary line of the above mentioned 254 7 acre tract, 2454 feet to a steel pin for the northwest corner of the tract herein described, THENCE east across the above mentioned G A Godfrey 254.7 acre tract 1885.35 feet to a steel pin for corner in the east boundary line of said tract said corner being the northeast corner of what is desig- nated herein as the south 100 acres out of said G A Godfrey tract, said corner being in the west boundary line of the past mentioned 142 18 acre tract now in the name of Alfred F Sellmeyer, THENCE north 20' 5' east along the west boundary line of the Sellmeyer Tract, and the east boundary line of the G A Godfrey tract, 862 09 feet to a steel pin for corner on tract herein described, THENCE east 1311 88 feet to a steel pin for corner, said corner being 50 feet west of a north and south fence, along the west boundary line of a public road, THENCE north 20 3' east 50 feet west of and parallel with said fence line, 740 65 feet, to a steel pin in the south boundary line of a certain 18 6 acres of land, as conveyed by Warranty Deed dated August 61 1957 from Alfred F Sellmeyer to I A Miller and wife, Clemmie Miller, THENCE south 880 3' east along the south boundary line of the I A Miller Tract 50 feet to a steel pin for corner on tract herein des- cribed in a north and south fence line on the west boundary line of the past mentioned public road, same being the southeast corner of the I A Miller tract, THENCE north 20 3' east along existing fence line and the west boun- dary line of said road, and the east boundary line of said I A Miller tract, 124 9 feet to a concrete monument in the south boundary line of U S Highway 77, THENCE south 490 57' east along the west boundary line of U S High- way 77, 33.5 feet to a steel pin in the center line of public road for corner; said corner being an original corner on the past mentioned 0 L Sargent, et al to Alfred F Sellmeyer 142 16 acre tract, THENCE south 2° 3' west along the center line of said public road and the east boundary line of the Alfred F Sellmeyer 142 18 acre tract 822 feet to a point for corner, same being an inner ell corner on the past mentioned 142 18 acre tract, THENCE east 28 feet to a steel pin for corner in the east boundary line of said public road, same being the east boundary line of said 142 18 acre tract, said corner being a corner on said 142 18 acre tract, THENCE south 10 54' west along the east boundary line of public road and fence line, 3017 33 feet to a steel pin on tract herein described same being the southeast corner of the past mentioned 142 18 acre tract and being in the south boundary line of the M E P and P R R Company Survey, Abstract no 950, Denton County, Texas, THENCE south 840 19' west along the south boundary line of the M E P and P R R Company Survey same being a fence line, and the south boun- dary line of the Alfred F Sellmeyer 142 18 acre tract and passing his -2- I~ southwest corner at 1438 19 feet same being the southeast corner of the past mentioned G A Godfrey 254 7 acre tract continuing along the south boundary line of said MEP and PRR Company Survey, Abstract No 950 and along fence line and the south boundary line of the G A Godfrey tract a total distance of 3249 71 feet to point of beginning and containing in all 100 acres of land off the south end of the G A Godfrey 254 7 acre tract, and 101 38 acres of land out of the Alfred F Sellmeyer 142 18 acre tract making a total of 201 38 acres of land, as surveyed on the ground by R G Milliken, County Surveyor, Denton County, Texas, on the 6th day of December, A D 1957 SECTION II The above described property is hereby classified as "A" Agri- cultural District and shall so appear on the official zoning map of the City of Denton, which map is hereby amended accordingly SECTION III This ordinance shall be effective immediately upon its passage PASSED AND APPROVED this the /f' day of April, A D 1977 ELI OR HUGHES, M R8 R CITY OF DENTON, TEXAS ATTEST /J 1.7 MKS HOLT, CITY SECRETARY ITY OF DENTON, TEXAS APPROVED AS TO LEGAL FORM PAUL f S'HAMr CITY AT - ]E'-- CITY OF DENTON, TEXAS -3- n r NO. 7 7 - I,? Goodman and wife, Tillie L. Goodman and C. P. Smith and wife, Gwendolyn Smith to G. A. Godfrey and wife, Sue R. Godfrey, and a 101.38 acre tract out of a certain 142.18 acre tract of land as conveyed by Warranty Deed dated July 24, 1956 from 0. L. Sargant and wife, Susie S. Sargent, and Tom Starr, a single man (being the same person as T. M. Starr) to Alfred F. Sellmeyer; all be- ing out of the M.E.P. and P.R.R. Company Survey, Abstract No. 950, and being more particularly described as follows: BEGINNING at a steel pin at the southwest corner of the past men- tioned 254.7 acre tract of land, now in the name of G. A. Godfrey; and steel pin being in the southwest corner of the M.E.P. and P.R.R. Company Survey, Abstract No. 950; THENCE north along the west boundary line of the above mentioned 254.7 acre tract,.2454 feet to a steel pin for the northwest corner of the tract herein described; THENCE east across the above mentioned G. A. Godfrey 254.7 acre tract 1885.35 feet to a steel pin for corner in the east boundary line of said tract said corner being the northeast corner of what is desig- nated herein as the south 100 acres out of said G. A. Godfrey tract, said corner being in the west boundary line of the past mentioned 142.18 acre tract now in the name of Alfred F. Sellmeyer; THENCE north 20' 5' east along the west boundary line of the Sellmeyer Tract, and the east boundary line of the G. A. Godfrey tract, 862.09 feet to a steel pin for corner on tract herein described; THENCE east 1311.88 feet to a steel pin for corner, said corner being 50 feet west of a north and south fence, along the west boundary line of a public road; THENCE north 20 3' east 50 feet west of and parallel with said fence line, 740.65 feet, to a steel pin in the south boundary line of a certain 18.6 acres of land, as conveyed by Warranty Deed dated August 6, 1957 from Alfred F. Sellmeyer to I. A. Miller and wife, Clemmie Miller; THENCE south 880 3" east along the south boundary line of the I. A. Miller Tract 50 feet to a steel pin for corner on tract herein des- cribed in a north and south fence line on the west boundary line of the past mentioned public road, same being the southeast corner of the I.A. Miller tract; THENCE north 20 3' east along existing fence line and the west boun- dary line of said road, and the east boundary line of said I. A. Miller tract, 124.9 feet to a concrete monument in the south boundary line of U. S. Highway 77; THENCE south 490 57' east along the west boundary line of U. S. High- way 77, 33.5 feet to a steel pin in the center line of public road for corner; said corner being an original corner on the past mentioned 0. L. Sargent, et al to Alfred F. Sellmeyer 142.16 acre tract; THENCE south 20 3' west along the center line of said public road and the east boundary line of the Alfred F. Sellmeyer 142.18 acre tract 822 feet to a point for corner, same being an inner ell corner on the past mentioned 142.18 acre tract; THENCE east 28 feet to a steel pin for corner in the east boundary line of said public road, same being the east boundary line of said 142.18 acre tract, said corner being a corner on said 142.18 acre tract; THENCE south 10 54' west along the east boundary line of public road and fence line, 3017.33 feet to a steel pin on tract herein described same being the southeast corner of the past mentioned 142.18 acre tract and being in the south boundary line of the M.E.P. and P.R.R. Company Survey, Abstract no. 950, Denton County, Texas; THENCE south 840 19' west along the south boundary line of the M.E.P. and P.R.R. Company Survey same being a fence line, and the south boun- dary line of the Alfred F. Sellmeyer 142.18 acre tract and passing his -2- !8 t~ southwest corner at 1438.19 feet same being the southeast corner of the past mentioned G. A. Godfrey 254.7 acre tract continuing along the south boundary line of said MEP and PRR Company Survey, Abstract No. 950 and along fence line and the south boundary line of the G. A. Godfrey tract a total distance of 3249.71 feet to point of beginning and containing in all 100 acres of land off the south end of the G. A. Godfrey 254.7 acre tract, and 101.38 acres of land out of the Alfred F. Sellmeyer 142.18 acre tract making a total of 201.38 acres of land, as surveyed on the ground by R. G. Milliken, County Surveyor, Denton County, Texas, on the 6th day of December, A. D. 1957. SECTION II. The above described property is hereby classified as "A" Agri- cultural District and shall so appear on the official zoning map of the City of Denton, which map is hereby amended accordingly.
