1976-061AN ORDINANCE VACATING, CLOSING AND ABANDONING AS A PUBLIC STREET
A PORTION OF WAINWRIGHT STREET AS PER %~AP OR PLAT OF SAID AREA
RECORDED IN THE DEED RECORDS OF DENTON COUNTY, TEXAS, SAID TRACT
OF LAND BEING FURTHER DESCRIBED HEREIN IN FULL, AFTER FINDING THAT
THE PUBLIC CONVENIENCE AND NECESSITY NO LONGER RFQUIRE ITS CON-
TINUED EXISTENCE, AUTHORIZING THE MAYOR TO SIGN A QUIT CLAIM DEED,
AND DECLARING AN EMERGENCY
WHEREAS, the City of Denton has completed improvements on the
Bell-Blo~nt-Industraal Street project, and
WHEREAS, it was necessary to close off a portaon of Waanwraght
Street a~ 1ts southern most end to avoad a hazardous antersect~on
wath the new Bell Avenue, and
W~EREAS, the Caty Councal hereby fands and determanes that the
publa¢ convenience and necessary no longer requare the continued
existence of a portaon of Walnwri~ht ~treet, and
WHEREAS, the Caty Council determanes that the port~on of Waan-
wright Street closed by this ordinance should be conveyed to Thomas
E Noel an exchange for raght of way granted by Thomas E Noel to
the Caty of Denton for the improvement of Bell Avenue,
NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON, TEXAS,
HEREBY ORDAINS
SECTION I
That the followang descrabed parcel of land contaan~ng
3,329 75 square feet, more or less, satuated an the Caty of Denton,
Denton County, Texas, and more partacularly described by metes and
bounds as follows
Ail that certaan lot, tract or parcel of land lying and beang
situated an the C~ty and County of Denton, State of Texas, bean~
part of the Wm Lovang Survey, Abstract No 759, and beang part
of Lot 8, Block A and Lot 8, Block B of the Blount Addltaon, an
addataon to the Caty and County of Denton and also beang part of
three tracts of land hereinafter described as Tract One, Tract Two
and Tract Three, Tract One beang the street rlght of way known as
Waanwr~ght as shown on the Plat of the Blount Addatlon as recorded
an Volume 75, Page 54 of the Deed Records of Denton County, Texas,
Tract Two beang conveyed by Thomas E Noel to the Caty of Denton
by deed dated October 18, 1968, and recorded an Volume 574, Page
104 of the Deed Records of Denton County, Texas, Tract Three beang
conveyed by Claude Miller to the C~ty of Denton by deed dated
December 1, 1970 and recorded an Volume 611, Page 640 of the Deed
Records of Denton County, Texas, and beang more partlcularly des-
crabed as follows
BEGINNING at a point in the west right of way line of Wainwright
Street, said point of beginning lying in the east boundary line
of Lot 9, Block B of the Blount Addition 82 5 feet north of the
intersection of the west right of way line of Wainwright Street
and the north right of way line of Eagle Drive,
THENCE north along the west right of way lane of Wainwright Street,
a distance of 82 5 feet to a point for a corner, same beln~ the
southeast corner of said Tract Two and also being the southeast
corner of Lot 8, Block B of the Blount Addition,
THENCE west along the south boundary line of said Tract Two a dis-
tance of 8 0 feet to a point for a corner, same being the southwest
corner of Tract Two,
THENCE north along the west boundary lane of said Tract Two a dis-
tance of 50 0 feet to a point for a corner, same being the northwest
corner of said Tract Two,
THENCE east passing at 8 0 feet the northeast corner of said Tract
TwO, continuing east and passing at 33 0 feet the west boundary line
of said Tract Three, same being the east right of way line of Wain-
wright Street, and continuing east a total distance of 41 0 feet
to a point for a corner in the east boundary line of said Tract Three,
~NCE south, along the east boundary line of said Tract Three, a dis-
tance of 17 0 feet to a point for a corner, same being the southeast
corner of said Tract Three,
THENCE west along the south boundary line of said Tract Three a dis-
tance of 8 0 feet to a point for a corner in the east right of way
line of Wainwright Street, same being the southwest corner of said
Tract Three,
THENCE south along the east right of way line of Wainwright Street
a distance of 90 0 feet to a point for a corner,
THENCE south 44° 25' 58" west a distance of 35 71 feet to the place
of beginning and contaIning 3,329 75 square feet of land, more or
less
be, and the same is hereby vacated, closed and abandoned insofar as
any right, title or interest may be vested in the public as a public
right of way, and the City Co.nell hereby authorizes the title and
interest an and to the above described tract of land to vest in
Thomas E Noel, as the abutting owner, in exchange for right of
way granted by Thomas E Noel to the City of Denton, Texas, for the
improvement of Bell Avenue
SECTION II
That the Mayor of the City of Denton, Texas Ks hereby authorized
to sign a quit claim deed conveying the above described tract of land
to Thomas E Noel
SECTION III
This ordinance is passed as an emergency measure, and shall
take effect and be in full force from and after its passage
