1976-053AN ORDINANCE OF THE CITY OF DENTON, TEXAS, AMENDING ORDINANCE
NO 75-13 WHICH CREATED THE "COMMUNITY ETHNIC RELATIONS BOARD",
PROVIDING FOR STAGGERED TERMS OF BOARD MEMBERS, PROVIDING
FUNCTIONS FOR SAID BOARD, PROVIDING A SEVERABILITY CLAUSE, AND
DECLARING AN EFFECTIVE DATE
WHEREAS, the City of Denton previously created a Community
Ethnic Relations Board in order for the City to research, plan
and promote racial understanding which would be to the benefit
of the entire community, and
WHEREAS. the City desires for the Board to function per-
manently, now, therefore
THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS
PART I
That Chapter 2 "Administration" of the Code of Ordinances
of the Clty of Denton, Texas, is hereby amended to create a new
Article III "CommL%nlty Ethnic Relations Board" and it shall read
as follows
ARTICLE III
COMMUNITY ETHNIC RELATIONS BOARD
SECTION 2-26 Creation of the Board
(a) There is hereby created a Community Ethnic Relations
Board to be composed of nine (9) members, appointed by the City
Council for three year terms, provided that the Board shall be
composed of an equal number of the following racial or ethnic
groups Whites, Blacks and Mexican-Americans The Board members
shall have staggered terms with three members being appointed
each year Members of the Board may be removed by the City Council
for cause Vacancies shall be filled ~n the same manner as pro-
vlded for regular appointments
(b) The City Manager or his designee shall be an ex off.cio
member of the Board He shall attend all meetings of the Board
and shall have the r~ght to discuss any matter that is under con-
slderatlon by the Board but shall have no vote
(c) Members of the Board shall be citizens of the City of
Denton
(d) At the first meeting each year after new members have
been sworn in, the Board shall select from its own membership a
chairman, vice-chairman and secretary Any five (5) of the re-
gularly appointed members shall constitute a quorum The Board
shall determine its own rules and order of business The Board
shall meet at least once each month, all meetings shall be open
to the public and a permanent record of proceedings malntalned
SECTION 2-27 Powers & Duties of the Community Ethnic
Relations Board
(a) It shall be the duty of the Board to act in an advisory
capacity to the C~ty Council, with authority to hold public hear-
lngs and to study and recommend pollcles relating to the promotion,
planning, research, and other such matters involving racial rela-
tions, and understanding for the City of Denton
(b) To receive and consider information of racial matters
which would lead the C~ty towards improved racial relations and
racial understanding
(c) To recommend to the City Council actions for lmplemen-
tarpon that would improve raclal relations and racial understand-
lng The Board shall not have responsibility or authority over
public officIals or employees of the C~ty
PART II
That if any section, subsection, paragraph, sentence, clause,
phrase or word in this ordinance, or application thereof to any
person or circumstances ~s held ~nvalld by any court of competent
jurisdiction, such holding shall not affect the validity of the
remaining portions of this ordinance, and the City Council of the
C~ty of Denton, Texas, hereby declares it would have enacted such
remaining portions despite any such invalidity
