1976-044AN ORDINANCE AMENDING THE ZONING ORDINANCE (ORDINANCE NO 69-1) OF
THE CITY OF DENTON, TEXAS, BY CREATING A NEW RESTRICTED MULTI-FAMILY
(MF-R) ZONE AND REDEFINING THE ~gJLTI-FAMILY DWELLING DISTRICT-1 (MF-
1) ZONE, PROVIDING FOR CONDITIONS, PROVIDING A PENALTY, AND DECLARING
AN EFFECTIVE DATE
THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS
SECTION I
That the Zonang 0rdlnance of the City of Denton, Texas, adopted
January 14, 1969, as an appendax to the Code of Ordanances of the Caty
of Denton~ Texas as Ordanance No 69-1, as amended, be, and the same
as hereby amended as follows
(1) That "ARTICLE II ZONING DISTRICTS ESTABLISHED" as amended
to show the Caty of Denton, Texas beang davaded anto eaghteen (18)
zonang dastr~cts by addang a Restrzcted Multa-Famaly Zone desagnated
as MF-R
(2) That "ARTICLE VII USE OF REGULATION DISTRICTS, USE OF LAND
AND BUILDINGS" as amended to show a MF-R Zone and that zone will per-
mzt the same designated type uses as as presently shown for the Multa-
Famaly Dwelling Distract-1 Zone exoept that a "Day Nursery or Kander-
garten School" used an such distract would requare a speclfac use per-
mat
(3) That "ARTICLE XIII AREA REGULATIONS" shall be amended to
show the same area regulataons for a Restracted Multa-Famaly Zone as
the present Mult~-Famaly Dwellang Dastrlct-1 Zone
(4) That "ARTICLE XII DEFINITIONS AND EXPLANATIONS NOTED IN
USE REGULATIONS" shall be amended by addang a new defanatzon number
(61) as follows
"(61) Bedroom - any room in an apartment other than a
katchen, dlnang room, living room, bathroom or
closet Extra k~tchens, game rooms, lzvzng or
danang rooms, dens, sun rooms or samllar extra
rooms shall be conszdered as bedrooms an com-
putang density standards for apartment bualdangs"
(5) That "ARTICLE XIII AREA REGULATIONS" shall be amended by
adding a new subsection (2) to D "Lot Coverage and Floor Area Ratio"
as follows
"(2) The maxzmum number of apartment unzts that can be
constructed on a szte, whlle observzng area regu-
latlons concerning setbacks and parklng, shall be
zn accordance wzth the followzng schedule
a Unit density standards for the MF-R Zone
A one bedroom unit requires a minimum land
area of 2300 square feet For each addztlonal
bedroom an additional 300 square feet of land
area ~s requzred
b Unit density standards for MF-1, U, O, NS, GR,
C, CB, LI for a Mllltl-Famlly dwelling three
stories or less zn height
A one bedroom unzt requires a m~mlmum land
area of 900 square feet For each add~tlonal
bedroom an additional 300 square feet of land
area ~s requzred
c Unit den~sty standards for U, C, CB, LI for a
Multi-Family dwelling unit four or more stories
~n height
Each unit requires a mzm~mum of 300 square feet
of land area"
SECTION II
Any person v~olatzng thls artzcle shall be guzlty of a mzsdemeanor
and upon conviction shall be punished by a fzne not to exceed Two Hun-
dred ($200 00) Dollars and each day of such violation shall constitute
a separate offense
SECTION III
That ~f any section, subsectzon, paragraph, sentence, clause,
phrase or word in th~s ordinance, or applzcat~on thereof to any person
or circumstances zs held znval~d by any court of competent jurisdiction,
such hold~ng shall not affect the val~dlty of the remaining portions of
thls ordlnance, and the City Council of the City of Denton, Texas, here-
by declares zt would have enacted such remaining portions despite any
such znval~dzty
SECTION IV
That the Clty Council of the C~ty of Denton, Texas, hereby finds
that such changes are ~n accordance with a comprehenszve plan for the
purpose of promoting the general welfare of the Czty of Denton, Texas,
and wzth reasonable consideration, encourages the most appropriate uses
of land for the maximum benefit to the Czty of Denton, Texas, and zts
citizens

SECTION V
That thls ordlnance shall be an full force and effect immediately
after its passage and approval, the requlred public hearlngs having
heretofore been held by the Planning and Zoning Commission and the City
Council of the C~ty of Denton, Texas, after g~vlng due not~ce thereof
