1976-030AN ORDINANCE AMENDING THE ZONING ORDINANCE (ORDINANCE NO 69-1)
OF THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS BY AMEND-
ING CERTAIN ARTICLES, PROVIDING FOR A SEVERABILITY CLAUSE, AND
DECLARING AN EFFECTIVE DATE
THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS
PART I
That Zoning Ordinance (Ord3nance No 69-1) of the Code of
Ord3nances of the City of Denton, Texas, 3s hereby amended and
changed 3n the following particulars
(1) Article 7B (Zoning Dlstr3ct Table) is hereby amended
to delete the classification for "Tra31er, Modular House or
Mobile Home as a F~xed Dwelling"
(2) Article 7C (Zoning District Table) is hereby amended
to allow for a "Day Nursery or Kindergarten School" by specific
use permit in an SF-16 one-family dwelling dlstrlct
(3) Article 7G (Zoning District Table) is hereby amended
to delete the classification for "Commercial Auto Parking Lot"
(4) Article 12A (14) "Kindergarten or Nursery" 3s hereby
deleted and amended by adding a new (14) which shall hereafter
read as follows
"(14) Kindergarten or Nursery - An establishment where
more than slx (6) children are housed for care or
training during the day or portion thereof"
(5) Article 12A be amended to add a new definition (61)
which shall hereafter read as follows
"(67) Licensed Private Club - A private club, l~censed
by the State of Texas, which sells or serves
beverages to the membership ~n accord w~th State
regulation "
(6) Article 22D is hereby deleted and amended by adding a
new Article 22D which shall hereafter read as follows
"D No nonconforming use may be expanded or ~ncreased
on the lot or tract upon which the nonconforming
use ~s located or on an adjoining lot or tract as
of the effective date of this ordinance except to
prowde off-street parking or off-street loading
space upon approval of the Board of Adjustment"
PART I I
That if any section, subsection, paragraph, sentence, clause,
phrase or word in th~s ordinance, or application thereof to any
person or c~rcumstances ~s held ~nvalld by any court of competent
jurisdiction, such holding shall not affect the validity of the
remaining port~ons of this ordinance, and the C~ty Council of the
C~ty of Denton, Texas, hereby declares ~t would have enacted such
remaining portions despite any such ~nvalldlty
PART I I I
That th~s ordinance shall become effective fourteen (14) days
from the date of its passage, and the C~ty Secretary ~s hereby
d~rected to cause the caption of this ordinance to be published
twice in the Denton Record-Chronicle, the offlclal newspaper of
the City of Denton, Texas, w~th~n ten (10) days of the date of
its passage
