1976-029AN ORDINANCE AMENDING CHAPTER 24, ARTICLE V OF THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS PROVIDING FOR CURB LOADING ZONES, REPEAL- ING CONFLICTING ORDINANCES, PROVIDING A SAVING CLAUSE AND DECLARING AN EFFECTIVE DATE THE CITY COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS SECTION I Sections 24-127 through 24-129 2 of Chapter 24, Article V of the Code of Ordmnances of the City of Denton are hereby repealed and shall hereafter be amended to read as follows Section 24-127 LOADING AND UNLOADING OF FREIGHT TRUCKS Ail fremght trucks shall be, and are hereby requzred, to be loaded and unloaded from the alley entrance, mf practmcable Where condmtmons are such as to make the loading or unloadmng thereof from an alley mmpracticable, such trucks shall be parked on the street in accordance with all applicable proviszons of thzs artmcle Sectmon 24-128 PERMIT REQUIRED, APPLICATION, WHEN AUTHORIZED (a) Loading zones may be granted to any busmness where sazd loadzng zone ms necessary for the conduct of the buszness, subject to the provisions provided below (b) The owner or manager of a busmness deszrzng a loadzng zone shall make wrmtten application to the Traffzc Safety Support Commmsszon The applicatmon shall state (1) The name and address of the business (2) The types of goods and/or servzces provzded by the business (3) The types and number of commercmal vehicles operated by the business (4) The types of commercial vehzcles makzng delmveries to the busmness and the frequency of the delzvermes made by sazd vehicles (5) A statement of the specific use to be made of the proposed loading zone (c) If the applicatzon for the loadmng zone ms approved by the Traffmc Safety Support Commzssmon they shall cause the loadzng zone to be mnstalled upon recezpt of an advance payment of One Hundred Fmfty Dollars ($150 00) (d) Loadmng zone applzcations shall be revmewed annually by the Traffmc Safety Support Commissmon who shall determzne whether a need for each loading zone still exists If the Traffic Safety Support Commission determznes such a need still exzsts, the loadzng zone shall be renewed upon the recezpt of Seventy Five Dollars ($75 00) renewal fee prior to October 1st of each year Failure to pay the renewal fee prior to October 1st will result in the need for reappll- cation at the cost of One Hundred Fifty Dollars ($150 00) (e) The denial of a loading zone or loading zone renewal may be appealed to the City Council (f) Loading zones shall be non-transferable unless authorized by the Traffic Safety Support Commmssion (g) Loading zones may only be used for the actual loading and unloadzng of commercial vehicles except that the owner of the load- lng zone may register with the Traffmc Safety Support Commlsszon and Chzef of Polzce each vehicle with very properly affixed signs identm- fyzng zt as a commercial vehicle Such vehzcle may remain parked wzthin the loading zone between deliveries Section 24-129 LOADING ZONES - MARKING Every loading zone shall have painted on the curb adoacent there- to and/or signs adoacent thereto, the words "Loadzng Zone" Section 24-129 1 LOADING ZONES - PARKING RESTRICTIONS (a) No commercial vehicle marked zn accordance wzth Sectzon 24- 128 (g) shall be parked in any loading zone for a longer contznuous time than is reasonably necessary to load or unload goods or merchan- dzse for the business for which such loading zone is reserved except ~n accordance with Section 24-128 (g) (b) It shall be unlawful to park a vehicle not having properly affixed signs attached thereto mdentmfyzng the vehicle as a com~nerczal vehicle within a loading zone at any time for any purpose SECTION II That if any sectzon, subsection, paragraph, sentence, clause, phrase or word in this ordinance, or applzcatzon thereof to any person or circumstances is held invalid by any court of competent 3urzsdictzon such holding shall not affect the valzdity of the remaining portions of this ordinance, and the City Council of the Czty of Denton, Texas, here- by declares it would have enacted such remaznzng portions despite any such znvalidity ~ECTION III That this ordznance shall become effective fourteen (14) days from the date of zts passage, amd the City Secretary is hereby directed to cause the caption of thzs ordznance to be publzshed zn the Denton Record-Chronicle withzn ten (10) days of the date of its passage PASSED and APPROVED this the f~ day of ~ A D 1976 ~.LiN'OR HUGHES~ CITY OF DENTON, TEXAS ATTEST B~KS HOLT, CITY SEC~TARY ' CITY OF ~NTON, ~XAS APPROVED AS TO LEGAL FO~ PAUL C iSM, cITY ATTO~?'
