ORDINANCE DIRECTING THE ISSUANCE OF
NOTICE OF SALE OF BONDS
THE STATE OF TEXAS
COUNTY OF DENTON
CITY OF DENTON
THE CITY COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
1 That the City Secretary is directed to issue a Notice
of Sale of Bonds in substantlally the following form
"OFFICIAL NOTICE OF SALE

GENERAL OBLIGATION PARK IMPROVEMENT BONDS,

The City Council of the City of Denton, Denton County,
Texas, will receive sealed bids at the Municipal Build-
lng in the City of Denton until

for the purchase of

Sealed bids, plainly marked "Bid for Bonds", should be
addressed to "Honorable Mayor and City Council, City of
Denton, Texas", and must be submitted on the "Official
Bid Form" to be made available by the Cl~y Council prior
to the date of sale
All sealed bids w~ll be publicly opened and tabulated
before the Council
Copies of the "Official Statement" and "Official Bid
Form" are being prepared and will be mailed to prospec-
tive b~dders on or about March 15, 1976, and will be
furnished to any prospective bidder upon request, by
F~rst Southwest Company, Mercantile Bank Building, Dallas,
Texas, 75201, Financial Advisors to the City
The City reserves the rlght to reject any and all bids
and to waive any and all Irreqularltles

special elections, which shall be held as nearly
as practl¢able according to the provisions for
a regular election The hours and places for
holding all clty elect~ons shall be determined
by the C~ty Council
(b) Three councllpersons shall be elected on
the first Saturday in April, 1977 At this
election the candidate who receives the majority
of the votes cast for each place shall be declared
elected to that place The places to be filled
shall be Places One, Two and Three The two carry
over mer~bers shall fill Places Four and Five and
shall serve the balance of their term until their
successors are elected and qualified Thereafter,
three ¢ounc~lpersons shall be elected in each odd-
numbered year for Places One, Two and Three and
two councllpersons shall be elected in each even-
n~mbered year to Places Four and Five
SECTION 3 04 - CANVASS ELECTION RETURNS, RESULTS
(a) I~medlately after counting the votes the
presldlng 3udge shall deliver the official re-
turns of the election to the City Secretary On
the next Tuesday following the election, the City
Council shall canvass the returns and declare the
results The returns of every municipal election
shall be recorded in the Minutes of the Council
(b) The oandldates receiving the majority of the
votes cast for each place shall be declared
elected If no candidate receives a majority, or
if there is a t~e, for any one place, the Council
shall order a second elect~on to be held on the
fourteenth day after the first election to f~ll
that place Only the names of the candidates who
tie for the highest number of votes cast for that
place, or the two candidates who receive the high-
est number of votes with neither having a majority
of votes cast for that place, shall be printed
on the ballot for each such election In the
event of a tie vote at the second election, the
candidates who tie shall cast lots in the presence
of the C~ty Secretary to determlne which one shall
be declared elected, and said lots shall be cast
within five days of the second election
AMENDMENT NO TWO
[ ] FOR SECTION 2 04 - VACANCIES IN COUNCIL
[ ] AGAINST Where a vacancy in any place on the council shall
occur, the vacant place shall be filled by a
special election, and, where necessary, by a run-
off election, in the same manner as provided in
this charter for the regular election of the
councllperson Such special election shall be
held on a Saturday within sixty days following
the creation of the vacancy, and the run-off
election, where necessary, shall be held on the
fourteenth day after the preceding election, pro-
vlded, however, that where a vacancy shall occur
within one hundred and twenty days of a regular
election, no special election to fill the vacancy
shall be called, unless more than one vacancy
occurs

at the Mun~clpal Building (City Hall), and the roll was called of
the duly constituted officers and members of sa~ ~l~ounc~l,

and read ~n full It was then duly moved and seconded that sa~d
Ordinance be passed, and, after due dlseuss~on, sa~d motion,
carrying with it the passage of sa~d Ordinance, prevailed and
carried by the following vote ~

2 That a true, full, and correct copy of the aforesaid
Ordlnance passed at the Meeting described ~n the above and fore-
going paragraph is attached to and follows this Certificate,
that said Ordinance has been duly recorded in sa~d C~ty Council's
minutes of said Meeting, that the above and foregoing paragraph
is a true, full, and correct excerpt from sa~d City Council's
minutes of sa~d Meeting pertaining to the passage of said Ordi-
nance, that the persons named ~n the above and foregoing paragraph
are the duly chosen, qualified, and acting officers and members of
said C~ty Council as indicated there~n, that each of the officers
and members of sa~d C~ty Council was duly and suff~clently not~-
fled officially and personally, in advance, of the t~me, place,
and purpose of the aforesaid Meeting, and that said Ordinance
would be Introduced and considered for passage at said Meeting,
and each of said officers and members consented, in advance, to
the holding of sa~d Meetlng for such purpose, and that said Meet-
·ng was open to the public, and public notice of the time, place,
and purpose of said meeting was given, all as required by Vernon's
Ann C~v St Article 6252-17
3 That the Mayor of sa~d City has approved, and hereby
approves, the aforesaid Ordinance, that the Mayor and the C~ty
Secretary of said C~ty have duly s~gned said Ordinance, and that
the Mayor and the City Secretary of said City hereby declare that
their signing of th~s Certificate shall constitute the signing of
the attached and following copy of said Ordinance for all pur-
poses
