1974-043AN ORDINANCE AMENDING CERTAIN PROVISIONS OF CHAPTER 12, ARTICLE I,
AS HEREIN DESIGNATED, PROVIDING A SAVINGS CLAUSE, AND DECLARING AN
EFFECTIVE DATE
THE CQUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS
PART I
That the below designated portzons of Chapter 12, Artzcle I
of the Code of Ordinances of the City of Denton, Texas are hereby
amended and changed as follows
(1) The Section 12-5 (b) figure of $0 75 is herewith changed
to read $1 00
(2) The Section 12-5 (c) figure of $1 25 is herewzth changed
to read $1 75
(3) The Section 12-5 (d) figure of $2 50 is ~ncreased to read
$3 50
(4) The Section 12-5 (e) figure of $5 00 zs increased to read
$7 50
(5) Section 12-9 (c) shall read 104 bags each year per in-
dzvldual family unit
(6) The charges lusted in Sectzon 12-19 (b) for single unzt
collection is herewith increased from $2 75 to $3 25 per month, and
from $2 50 to $3 00 per unit if there are from two (2) to four (4)
unxts inclusive
(7) The mznimum charge lzsted in Section 12-20 (a) is changed
to read $4 00 per month
(8) Section 12-20 (e) zs amended to read as follows
"Buildings or connected ser~es of buildings contaznzng more
than four (4) dwelling unzts havzng ezther water or electrzczty bill-
ed through a single meter will be bzlled as a szngle charge along
wzth the szngle water or electric charge regardless of the occupancy
of such multiple dwelling unzt Multzple dwellzng units classzf~ed
as fraternities, sororltzes, boarding houses and domztorles shall be
charged as a commercial or instztutlonal service Any multzple dwell-
lng units or con~ercial establzshment which requzres more than the
mlnzmum service descrzbed herein is sub3ect to having the charges
creased by the City Sanztation Divzszon based upon the additzonal
servzce required Any multiple dwellzng unit having zndzvidual
water and electric meters shall be bzlled ~ndzvtdually at the
reszdential rate of $3 00 per unit
The charge for collectzng garbage, trash and rubbish from
apartment houses conszsting of more than four (4) unzts, havzng
a szngle water or electrzc meter shall be $2 50 per unzt per month"
(9) Section 12-22 (d) is amended to read as follows
"Charges for containers furnzshed by Czty shall be the actual
cost to the City plus ten (10%) percent of such cost Such cost
shall zn¢lude amortzzatlon of the contemners, mazntenance of the
contazners, emptying and disposal of garbage, trash and rubbzsh
placed zn contazner, and such other costs zncurred by City in con-
nectzon with the operation of the container system
Where more than one (1) commerczal establzshment uses the same
contazner, the charges shall be pro-rated accordzng to use, but in
no case shall be less than $4 00 per month
The charges for contazners shall apply to all types of approved
use except apartment houses and residences served by containers Such
apartment houses and residences shall be charged the regular rate
lzsted zn this Chapter"
(10) Section 12-23 (f) shall hereafter read as follows
"There shall be an annual permit fee of $100 00 Dollars per ve-
hzcle payable in advance for the calendar year durzng whzch zt is
to be zn force This fee shall not be pro-rated for partzal years"
(11) Section 12-24 (a) first paragraph only zs changed to read
as follows
"Ail vehzcles used by licenses przvate haulers, non resident
haulers and resident haulers shall meet the mznzmum requzrement
stated under the below described class whzch is most applzcable The
Czty Secretary shall make, or cause to be made such vzsual znspectzons
and checks as may be requzred to ascertazn that each vehzcle meets the
mznzmum requirements descrzbed for that class"
PART II
That if any section, subsection, paragraph, sentence, clause,
phrase or word in this ordinance, or applicatzon thereof to any per-
son or czrcumstances is held invalid by any court of competent our-
zsdzctlon, such holding shall not affect the validity of the remain-
lng portions of this ordinance, and the Cmty Counczl of the Czty of
Denton, Texas, hereby declares it would have enacted such remaining
portzons despite any such invalidity
PART III
That this ordznauce shall become effective
and the City Secretary zs hereby directed to cause the captzon of
this ordinance to be publzshed in the Denton Record-Chronicle with-
zn ten (10) days of the date of its passage
