1974-019 NO AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS, AMENDING THE W~ED ABATEMENT AND ASSESSMENT ORDINANCE TO PROVIDE THAT THE CITY MANAGER OR HIS DESIGNEE ENFORCE SAME, REPEALING ALL ORDINANCES AND PROVISIONS OF THE CODE IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS PART I That the Code of the City of Denton is hereby amended by enacting the following enumerated changes to Chapter 12, Article V, Sections 12-26 through 12-30, said changes to be as follows (a) The term City Health Officer, City Health Officer or his deputy, or other designated reference to City Health Officer in this particular article, shall hereinafter read the Cmty Manager or hms designee It being the mntent of thms article that the City Manager, or any person actmng under and through the authority of the City Manager shall hereinafter assume the responsibilities of the Cmty Health Offmcer for purposes of enforce- ment of this particular article (b) That the term "by contract" be deleted from Sec- tmon 12-28 of said artmcle PART II That this ordinance shall repeal every prior ordinance and provmsmon of the City of Denton Code of Ordinances in con- flmct herewmth, but only insofar as the portion of such prior ordinance or provmsmon shall be mn confmct and as to all other ordinances or provisions of the Code of Ordmnances of the City of Denton not in dmrect conflict herewmth, this ordinance shall be and is hereby made cumulative PART III That if any sectmon, part of section or provision of any section of this ordinance shall be held to be void, lneffectmve or unconstitutional by any court of competent 3urlsdlctmon, the holding of such sectmon, part of a sectmon or provision of any sectmon to be void, ineffective or unconstitutmonal for any cause whatsoever shall mn no way affect the valmdity of the re- maining sections and provisions of this ordinance, which shall remamn mn full force and effect The Cmty Council would not have passed any section, parts of sectzons or proviszons of any sectzon of this ordinance that were unconstltutzonal, void or ineffective if zt had known that they were unconstltUtzonal, void or zneffective at the time of adopting thls ordinance PART IV That this ordznance shall be effectmve i~nedzately upon zts passage PASSED and APPROVED thzs the 21st day of May, A D 1974 NEU, I~YOR CITY OF DENTON, TEXAS ATTE S T BRQ~K~ HOLT, CITY SECRETARY CITY OF DENTON, TEXAS APPROVED AS TO LEGAL FORM
