1974-014AN ORDINANCE AMENDING CHAPTER 26, ARTICLE IV, SECTION 26-55 OF THE CODE OF ORDINANCES OF THE CITY OF DENTON WHICH SETS FORTH AND IN- CORPORATES A TAXICAB MAP SYSTEM FOR THE CITY OF DENTON, TEXAS, AMENDING RATES TO BE CHARGED PURSUANT TO SAID MAP SYSTEM, DELINE- ATING OTHER CHARGES AND FEES FOR APPROPRIATE SERVICES, AND DECLAR- ING ~N EFFECTIVE DATE WHEREAS, the Czty Counczl, recognzzzng the need to re-evaluate the taxzeab rates wzthln the City of Denton, Texas, zn order to con- tznue to provzde the cztzzens of Denton the best taxi servzce possz- ble, and WHEREAS, zn an effort to re-evaluate sazd rate and/or service zt zs desirable to change the existing taxzcab zone system wzthzn the Czty of Denton, Texas, and WHEREAS, the rate increases, addztzonal charges and changes recormnended by the company seem to be reasonable, and necessary zn order to provzde a reasonable rate of return to the company, and WHEREAS, the Czty Council has determzned that the zncreases contazned herezn are the mtnim%~n requzred to assure cont~nued, ade- quate and safe servxce of the company and to provzde for necessary expanszon to meet future requzrements, and WHEREAS, the zncrease will achzeve the mznzmum rate of return or profzt margin needed to attract capital at reasonable cost, so as not to impair the credit of the public utzlzty, and WHEREAS, the zncrease in the opznzon of the City Counczl zs cost based and does not, reflect future znflatzon expectatzons all of whzch determznatzons have been made in conszderatzon of rules and regulatzons enumerated by the Wage and Price Commxsszon, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS s ,C ION Tha~ Article IV of Chapter 26, Sectzon 26-55 of the Code of Ordinances of the City of Denton be deleted zn zts entzrety and that the following sectzon be substztuted therefor "It shall be unlawful for any person to charge more for transporting passengers for hire withzn the c~ty than hereznafter provzded, (a) Fares shall be determined based upon a map system, by distance traveled The dmstance traveled from the pzckup poznt to the poznt of destination shall be determzned by drawzng a strazght lzne on a City of Denton, Texas map, copyrzght 1972 by Denton County Mapping Company, as publzshed by the Denton Chamber of Commerce, Denton, Texas The scale of said map shall be one inch equals approximately 1900 linear feet A map of such scale shall be on file with the City Secretary and shall be zncorpo- rated and made a part of this Section for all pur- poses (b) Passengers wzll be charged as determined by the taxzcab radzo dispatcher, a minimum fare of ezghty- five (85¢) cents plus fifteen (15¢) cents for each three-quarters inch from the poznt of pickup to destination, determined by drawzng a straight line on the standard map with a ruler (c) There shall be a charge of fifty (50¢) cents for each additional passenger or passengers where the additional passenger or passengers are picked up and dropped at the same poznt Strazght per person fares shall be charged to or from the bus statzon to the universzty campus (d) There shall be no charge for children under slx (6) years of age zf accompanzed by a full fare passenger There shall, however, be a m±nzmum charge of one full fare on each trip (e) Anyone that desires excluszve use of cab wzll be charged the strazght per person fare plus fifty (50¢) cents There shall be a mznlmum charge of twenty-fzve (25¢) cents plus the regular cab fare for deliveries Two items per passenger are transported free of charge, but there wzll be a charge of ten (10¢) cents for each addztzonal ztem (1 e packages, suztcases, grocery sacks, etc ) Trunks are transported for a charge of three ($3 00) dollars Foot lockers are transported for a charge of one dollar fifty cents ($1 50) (f) An "zn route stop" shall be defzued as "not departing more than two (2) blocks or equivalent from the most direct route between pickup point and final destination Waiting t~me shall be charged at the rate of fifteen (15¢) cents for the first three minutes and ten (10¢) cents for each additional mznute On a roku~d trip, or zf two fares are charged, there shall be no in route stop charge But walting tzme wzll be charged for all time over the fzrst three mznutes" SECTION II That all ordinances or parts of ordinances zn force when the provlszons of this ordznance become effective which are lnconszstent or zn conflict wzth the terms or provzszons contained zn thzs ordzn- ance are hereby repealed to the extent of any such conflzct However, the Council in amending these rates, makes such amendment subject to future revocatzon and/or ad3ustment, as deemed necessary by sazd Counczl upon future study and evaluatIon of a taxicab service pro- vzded in sazd City SECTION III That zf any sectzon, subsectzon, paragraph, sentence, clause, phrase or word zn thzs ordznance or applzcatzon thereof to any per- son or circumstances zs held lnvalzd by any court of competent 3ur- zsdzctzon, such holding shall not affect the valzdity of the remain- lng portions of this ordinance, and the Czty Counczl of the City of Denton, Texas, hereby declares it would have enacted such remaznlng portzons despzte any such invalidity SECTION IV ~ ~ ~ That this ordznance shall become effectzve the ~day of /~~ , 1974 P~SED ~D
