1974-011 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF DENTON, TEXAS CALLING AND ORDERING AN ELECTION TO BE HELD ON THE 2ND DAY OF APRIL, A D 1974, THE SAME BEING THE FIRST TUESDAY IN SAID MONTH, FOR THE PURPOSE OF ELECTING TWO (2) COUNCILMEN FOR THE CITY OF DENTON, TEXAS, IN ACCORDANCE WITH THE PROVISIONS OF ARTICLE 3, SECTION 3 01 (a) OF THE CHARTER OF THE CITY OF DENTON, TEXAS, ESTABLISHING THE HOURS AND PLACE FOR THE SAID ELECTION; PROVIDING FOR PUBLICATION OF THIS ORDINANCE AND POST- ING IN THREE PUBLIC PLACES IN THE CITY OF DENTON AS NOTICE OF SAID ELECTION, DIRECTING THE CITY SECRETARY TO MAKE UP THE OFFICIAL BALLOTS, CAUSING THE SAME TO BE PRINTED AND DELIVERED TO THE PRESIDING OFFICER, PROVIDING FOR THE MAKING OF OFFICIAL RETURNS OF SAID ELECTION, PROVIDING FOR THE CANVASSING OF THE RETURNS OF THE SAID ELECTION AND DECLARING THE RESULTS OF SAME BY THE CITY COUNCIL, AND DECLARING AN EFFECTIVE DATE WHEREAS, at as hereby offaclally found and determined that a case of emergency or urgent publac necessity exasts which re- quires the holdang of the meeting at which thas ordinance as passed, such emergency or urgent publac necessity beang that the nominations for electaon to saad offaces must be faled not later than tharty (30) days praor to the date of elect~on, and that saad meetang was open to the publac, and public notace of the tame, place and purpose of saad meetang was gaven, all as requared by Vernon's Annotated C~v~l Statutes, Article 6252-17 THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS SECTION I That an elect~on shall be held ~n the Community Bualdang, in the Cavlc Center on McKanney Street, an the City of Denton, Texas, between the hours of seven o'clock (7 00) A M and seven o'clock (7 00) P M , on the 2nd day of Apral, A D 1974, the same beang the farst Tuesday of sa~d month, for the purpose of electang two (2) Co~ncalmen for the Caty of Denton, an accordance wath the pro- vasaons of Artacle 3, Section 3 01 (a) of the Charter of the Caty of Denton, Texas SECTION II That the two candadates who receive the h~ghest number of votes shall be declared elected to the C~ty Council of the Caty of Denton SECTION III That notice of said elect~on shall be g~ven by the posting of true cop~es of th~s ordinance, s~gned by the Mayor and attested by the Clty Secretary, in three p~bllc places of the said City, one of which places shall be at the Municipal Building, for thirty (30) consecutive days prior to the date of saad electaon and this ordananoe shall be published an full one t~me ~n the Denton Record- Chronicle at least thirty (30) days prior to said elect~on SECTION IV That J L Carrlco as hereby appointed presad~ng judge of sald electaon, and Mrs Alma Trapp ~s hereby appolnted as his alternate, and the said presldang judge shall appoant such assistants as may be necessary to properly conduct sa~d election, as provlded by the election code SECTION V That the C~ty Secretary shall make up the official ballot from the names presented to hlm by appllcatlon or nominating petitions as provaded by Article 3, Sectlon 3 02 and 3 03 of the Charter of the C~ty of Denton, Texas, and he ls hereby authorized and d~rected to have the ballots to be used in such election printed and delivered to the sa~d presldang judge SECTION VI That ~mmedlately after the co%%nt~ng of the votes the presiding judge shall deliver the official returns of the electaon to the City Secretary SECTION VII That on the Monday next following the election, the C~ty Council shall canvass the returns and declare the results which shall be re- corded in the Minutes of the Council SECTION VIII That the two candidates who receive the highest number of votes shall be declared elected and the Mayor shall deliver certificates of electlon to the successful candidates If two or more candidates shall tie w~th the second h~ghest number of votes or if three or more candidates shall tle for the hlghest number of votes, the Council shall order a second electlon to be held on the fourteenth day after the f~rst electlon at which only the names of the candidates who re- ceive the same number of votes at the f~rst elect~on shall be printed on the ballot In the event of a tle at the second electlon, the t~ed candidates shall cast lots to determine which one shall be de- clared elected PASSED AND APPROVED thls the 19th day of February, A D 1974 BILL NEU, MAYOR CITY OF DENTON, TEXAS ATTEST ~S HOLT, CITY SECRETARY CITY OF DENTON, TEXAS W RALPH%~NN, CITY ~ CITY OF DENTON, TEXAS
