1974-004 NO __Ze AN ORDINANCE CHANGING THE LEGAL MAXIMUM SPEED LIMITS FOR CERTAIN DESCRIBEDPORTIONS OF CERTAIN STREETS WITHIN THE CITY LIMITS, PRO- VIDING AIPENALTY FOR VIOLATION THEREOF, AND DECLARING AN EFFECTIVE DATE ~ WHEREAS, it is deemed necessary and advisable to amend the traffic laws aS hereinafter ordered~ and WHE~AS, it is hereby offlclally found and determined that a case of emergency or urgen~ p~bllc necessity exists which requires the holding of the meeting at which this ordinance is to be con- sldered, such e~ergency or urgent public necessity being that the State Highway Commission, pursuant to state legislative authority has lowered the maximum speed limits on all public hzghways in Texas tol 55 mi~es per hour effective January 20, 1974, and that there preseatly is authorized on certain public highways within our ¢~ty a m~xim~m speed in excess of that figure, and that said meet- ing was ~pen to the p~blic, and public notice of the time, place and purpcse of said ~eeting was given, all as required by Vernon's Annotated Civil Statmtes Article 6252-17 THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS SECTION I Tha% the maxlm~/n spee~ limit on the below described portions of highways and streets within the city l~m~ts of the City of Denton are hereby changed as follows HIGHWAY 380 (WEST UNIVERSITY DRIVE) 55 ~iles per hour from Station 594~04 (West C~ty Limits) to Station 622~00 (approximately 250 feet west of Cindy Lane) HIGHWAY 38Q (EAST UNIVERSITY .D,.RIV~) 55 m~les per hour from a point 2300 feet east of the center- lln~ of ~H~ghway Loop 288 east for a d~stance 2000 feet to a poiBt 4300 feet east of th~ ce~terllne of Highway Loop 288 HIGHWAY LOOP 288 55 miles per hour from the intersection of said Highway with U S Interstate 35 E to its intersection with Highway 380 (East University Drive) DALLAS, DRIVE 55 m~les per hour from centerllne of Interstate 35 E Ser- vice Road to 200 feet southeast of Piping Rock FORT WORTH DRIVE 55 m~les per hour from 300 feet south of Santa Fe Railroad to 1200 feet north of Santa Fe Rallroad NORTH ELM STREET 55 m~les per hour from the north city limits to centerllne of Riney Road SECTION II That anyone exoeed~ng th~s speed l~m~t when posted, wlthout legal ex~use, shall be guilty of a misdemeanor, and a v~olatlon of any provision of thls ordinance shall be punished by a fine upon conviction of any amount not exoeed~ng Two Hundred ($200 00) Dollars SECTION III That all ordinances or parts of ordinances in force when the provlsions of th~s ordinance become effective which are inconsistent or ~n conflict with the terms or provisions of this ordinance are hereby repealed to the extent of any such conflict SECTION IV That ~f any section, subsection, paragraph, sentence, clause, word or p~rase of this ordinance, or application thereof to any per- son or c~roumstances, are held ~nval~d by any court of competent jur- isdiction, such holding shall not affect the validity of the remain- lng portions of th~s ordinance, and the Clty Councll of the City of Denton, Texas, hereby declares it would have enacted suoh remaining portions despite of any such ~nval~dlty SECTION V That this ordinance shall become effective at 12 01 A M on January 20, 1974, and the ~ty Secretary is hereby directed to cause the caption of this ordlnan~e to be published one time in the Denton Record-Chronicle prior to the effective date of this ordinance PASSED AND APPROVED th~s the 15th day of January, A D 1974 BILL NEU, MAYOR~ CITY OF DENTON, TEXAS ATTEST CITY OF DENTON, TEXAS APPROVED AS TO LEGAL FORM ATTORNEY~ CITY OF DENTONt TEXAS
