1973-002~N ORDINANCE BY THE CITY COUNCIL OF THE CITY OF DFNTON, TFXAS
CALLING AND ORDERING AN ELECTION TO BE HELD ON THF 3RD DAY OF
APRIL, A D 1973, THE SAME BEING THF FIRST TUESDAY IN SAID
MONTH, FOR THE PURPOSE OF ELECTING THREE (3) COUNCILMEN FOR
THE CITY OF DENTON, TEXAS, IN ACCORDANCE WITH THE PROVISIONS
OF ARTICLE 3, SECTION 3 01 (a) OF THE CHARTER OF THE CITY OF
DENTON, TEXAS; ESTABLISHING THE HOURS AND PLACE FOR THF SAID
ELECTION, PROVIDING FOR PUBLICATION OF THIS ORDINANCE AND POST-
ING IN THREE PUBLIC PLACES IN THE CITY OF DENTON AS NOTICE OF
SAID ELECTION, DIRECTING THE CITY SECRETARY TO MAKE UP THE
OFFICIALIBALLOTS, CAUSING THE SAME TO BF PRINTED AND DELIVERED
TO THE PRESIDING OFFICER, PROVIDING FOR THE MAKING OF OFFICIAL
RETURNS OF SAID ELECTION, PROVIDING FOR THE CANVASSING OF THE
RETURNS OF THE SAID ELECTION AND DECLARING THE RESULTS OF SAMF
BY THE CITY COUNCIL, AND DECLARINC AN EFFECTIVE DATE
THE COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS
SECTION I
That an election shall be held an the Community Bualdang,
an the Clvlc Center on McKinney Street, in the Catv of Denton,
Texas, between the hours of seven o'clock (7 00) A M and
seven o'clock (7 00) P M , on the 3rd day of Aorll, A D 1973,
the same beang the farst Tuesday of said month, for the purpose
of electing three (3) Councalmen for the City of Denton, in
accordance wath the provaslons of Artacle 3, Sectlon 3 01 (a)
of the Charter of the Caty of Denton, Texas
SECTION II
That the three candidates who receave the h~ghest number of
votes shall be declared elected to the Catv Council of the C~ty
of Denton
SECTION III
That notloe of sald election shall be given by the post-
ang of true copaes of th~s ordanance, s~gned by the Mayor and
attested by the Clty Secretary, in three public places of the
sald Clty, one of which places shall be at the Municipal Buald-
ang, for thirty (30) oonsecutlve days prior to the date of said
election and th~s ordinance shall be published ~n full one time
an the Denton Record-Chronlcle at least thirty (30) days prior
to sa~d election
SECTION IV
That J L Carrlco is hereby appointed presiding 3ud~e of
sa~d electaon, and Mrs Alma R Trapp is apDoanted as has alter-
nate, and the sa~d presiding 3udge shall appoint such assastants
as may be necessary to properly conduct said electIon, as pro-
vaded by ~he electlon code
SEC~,ION V
That the City Secretary shall make up the off~caal ballot
from the,names presented to h~m by applacat~on or nominating
petitions as provlded by Artlcle 3, Sectaon 3 02 and 3 03 of
the Charter of the City of Denton, Texas, and he as hereby
authorlzed and dlrected to have the ballots to be used an such
elect~on printed and delivered to the sa~d presiding judge
SECTION VI
That iIuraedlately after the counting of the votes the pre-
siding judge shall deliver the offzc~al returns of the election
to the C~ty Secretary
SECTION VII
That on the Monday next following the election, the City
Counczl shall canvass the returns and declare the results which
shall be recorded in the Minutes of the Council
SECTION VIII
That the three candidates who receive the highest number of
votes shall be declared elected and the Mayor shall deliver cer-
tificates of elect~on to the successful candidates If two or
more candidates shall tie with the second highest number of votes
or if three or more candidates shall tie for the highest number
of votes, the Council shall order a second election to be held on
the fourteenth day after the first election at which onlV the
names of the candidates who receive the same number of votes at
the first election shall be prlnted on the ballot In the event
of a tie at the second election, the tied candidates shall cast
lots to determine whlch one shall be declared elected
