1973-001 AN ORDINANCE AMENDING T~E ZONING MAP OF THE CITY OF DENTON, TEXAS, AS SAME~WAS ADOPTED AS AN APPENDIX TO THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS, ~y ORDINANCE NO 69-1, AND AS SAID MAP APPLIES lTO 23,940 SQUARE FEET OF LAND, AS SHOWN THIS DATE ON THE OFFICIA~ TAX MAP OF THE CITY OF DENTON, TEXAS, AND MORE PARTICU- LARLY D~CRIBED THEREIN, AND DECLARING AN ~FFECTIVE DATE THE CO~CIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAIN~ That the Zonmng Map of the Caty of Denton, Texas, adopted January 14, 1969, as an Appendax to the Code of Ordanances of the Caty of IDenton, Texas, under provasaons of Ordinance 69-1, be, and the sam9 is hereby amended as follows AllI the hereanafter described property as hereby removed from the "SF-17" Single Family District as shown on saad Zonang Map, and all provisions of Ordinance No 69-1, adopted the 14th day of January, 1969, as amended, shall hereafter apply to said property as "PD" Planned Development Distract an the same manner as other property]located in the !t~D'' Planned Development District accord- ang to a~d subject to the conditaon and requirement that ~aad pro- perty he~eanafter shall be restracted an its use to the operataon of a drave-~n grocery, and as applicable to the plat attached hereto, which plat ms made a part hereof for all purposes, and which pro- perty as described as follows, to-wat All that certain lo~, tract or parcel of land satuated ~n the W Lloyd Survey, Abstract No 773, Denton County, Texas, and beang part of a certaan 19 839 acre tract conveyed by Wallaam J Maller to Charles D Adam~ on October 13, 1972 as recorded ~n Volume 651, Page 5091of the Deed Records of Denton County, Texas, and beang more particularly described as follows BEGINNIN~ at the most easterly northeast corner of saad 19 839 acre tra~t at a steel pin saad poant also being an the ~outh rmqht of way line of State Highway 380, THENCE s~uth 1~ 35" west 140.0 feet to a steel pin set for corner, THENCE ngrth 78o 44' west 181 8 feet to a steel pan set for corner saad poa~t bemng an the east raght of wa l~ne of ro osed North- Street, Y P P crest THENCE n~rth 10" 48' east with the east right of way line of pro- posed No~thcrest Street 140 0 feet to a steel pan set for corner said poa~t being an the north lane of saad 19 839 acre tract and also being in the south raght of way lane of State Haqhway 380, THENCE s~utheasterly wath a 1 526~ curve to the raght and also wath the south right of way lane of State Haghway 380 160 2 feet to the place of~bsginnang and contaa~ing 22,940 square feet of land, more or less , and being the s~me property shown mn the attached plat The|owners of the land descrmbed in thms ordinance, for and in consader~tion of the granting by the Caty Council of thas zonang olassafa~atmon on the saad property, do hereby band themselves, thear suqcessors, hemrs, exe~S, admanastrators and assagns to fully co~ply wath all of the above described terms and condor%ohs for the use ~f saad land as long as this ordanance shall remamn an effect SECTION II That the City Council of the City of Denton, Texas, hereby finds that such Planned Development District is in accordance with a comprehensive plan for the purpose of promoting the general wel- fare of the City of Denton, Texas, and with reasonable consideration among other things, for the character of the land and for its pecu- lIar suitability and uses SECTION III That this ordinance shall be an full force and effect immedi- ately after its passage and approval, the required public hearings having heretofore been held by the Planning and Zoning Commission and the City Council of the City of Denton, Texas, after giving due notice thereof PASSED AND APPROVED this the 6th day of February, A D 1973 ~LL NEU, MAYOR CITY OF DENTON, TFXAS ATTEST ~R~OKS HO~T, ~ITY SECRETARY CITY OF DENTON, TFXAS APPROVED AS TO LEGAL FORM
