1972-011 Ho AN ORDINANCE AMENDING CHAPTER 26, ARTICLF IV, qECTION 26-55 OF THE CODE OF ORDINANCES OF THE CITY OF DENTON WHICH SETS FORTH AND INCORPORATES A TAXICAB ZONE SYSTEM MAP FOR THE CITY OF DENTON, TEXAS, AMENDING RATES TO BE CHARGED PURSUANT TO SAID ZONE SYSTEM, DELINEATING OTHER CHARGES AND FEES FOR DELIVERIES, AND DECLARINC AN EFFECTIVE DATE WHEREAS, the City Council, recognizing the need to re-evaluate the taxicab rates within the City of Denton, Texas, in order to continue to provide the citizens of Denton the best taxi service possible, and WHEREAS, in an effort to re-evaluate said rate and/or service it is desirable to change the existing taxi cab zone system within the City of Denton, Texas, and WHEREAS, the rate increases, additional charges and changes recommended by the company seem to be reasonable, and necessary in order to provide a reasonable rate of return to the company, and WHEREAS, the City Council has determined that the taxicab fares proposed by the company are to be examined pursuant to the terms of the Economic Stabllzatlon Program, as amended, and WHEREAS, the City Council has determined that the increase con- talned herein is the minimum required to assure continued, adequate and safe service of the company and to provide for necessary expan- sion to meet future requirements, and WHEREAS, the increase will achieve the minimum rate of return or profit margaln needed to attract capital at reasonable cost, so as not to impair the credit of the public utility, and WHEREAS, the increase in the opinion of the City Council is cost - based and does not, reflect future inflation expectations all of which determinations have been made in consideration of rules and regulations enumerated by the Wage and Price Commission, NOWr THEREFORE, THE CITY COUNCIL OF THE CITY OF DENTON, TEXAS, HEREBY ORDAINS I That Article IV of Chapter 26, Section 26-55 of the Code of Ordin- ances of the City of Denton be deleted in its entirety and that the following Section be substituted therefor It shall be unlawful for any person to charge more for trans- porting passengers for hare within the City than hereinafter pro- vaded Fares shall be determaned based upon a zone system, by das- tance traveled The nucleus of said zone system, shall be one male an diameter, the center of which shall be the Courthouse square wathln the City Lamats of Denton, Texas, and shall be sur- rounded by concentric c~rcles one-fourth (1/4) mllea part A map delaneatlng saad zones shall be on f~le with the Caty Secretary and shall be lncorporated and made a part of th~s ordanance for all purposes Passengers w~ll be charged a minimum fare of eighty (80%)cents plus ten (10~) cents for each zone line crossed There shall be an additional charge of twenty-fave (25~) cent~ for crossing North Locust Street east to west, or vlce versa, north of Henry Street, crossing Fort Worth Drive east to west, or vice versa, south of the 1-35 Underpass, crosslng East McK~nney Street north to south, or v~ce versa, east of Mulkey and Woodrow Lanes, or crossing West Oak Street north to south, or vice versa, west of the 2200 Block There shall be a fare of one ($1 00) dollar from anywhere within the first carcle to eather the Texas Woman's University Campus or North Texas State University Campus Determination of lines crossed w~ll be made by drawing a straight line from p~ck-up point to destination There shall be a charge of flfty (50¢) cents for each addi- tional passenger or passengers where the addItional passenger or passengers are picked up and dropped at the same porn% Straight per person fares shall be charged to or from the bus stataon to e~ther unaversaty campus There shall be no charge for children under SlX (6) years of age if accompanied by a full fare passenger There shall, however, be a m~nlmum charge of one full fare on each trip -2- There shall be a mlnamum charge of twenty-fave (256) cents plus regular fare for delaveries Two atems (packages, suatcases, grocery sacks, etc ) are transported free of charge, but there will be a charge of ten (10b) cents for each additaonal item Trunks are transported for a charge of three (36) cents a pound In cases where weaghang as not possable the driver wall estimate the weaght Footlockers are one dollar-fifty cents ($1 50) A stop shall be defaned as not departing more than two (2) blocks or equivalent from most direct route There shall be a charge of fafteen (156) cents for the first three (3) manutes and ten (10b) cents for each addatlonal minute On a double fare for a round trap there shall be no stop charged, but waatlng tame shall be charged over three (3) mlnutes SECTION II That all ordInances or parts of ordlnances an force when the provisaons of thas ordinance become effective which are ancons~stent or an conflact wath the terms or provas~ons contained an thas ordin- ance are hereby repealed to the extent of any such conflict SECTION III That af any section, s~bsectaon~ paragraph, sentence, clause, phrase or word ~n thas ordanance, or application thereof to any person or cIrcumstances as held anvalad by any court of competent jurasdactaon, such holdang shall not affect the validity of the re- maaning portaons of thas ordinance, and the Caty Counclt of the C~ty of Denton, Texas, hereby declares at would have enacted such rema~n- ang portaons despite any such ~nvalldaty SECTION IV That thas ordinance shall become effectave Apral 15, 1972 PASSED AND APPROVED th~s the llth day of April, A D 1972 CITY OF DENTON, TEXAS -3- ATTEST BR~gf('S HOLT, CITY SECRETARY CITY OF DENTON, TEXAS APPROVED ~ LEGAL FORM W~RALP}{ MAN~3) CITY i~TTORNEY CITY OF DENTON, TEXAS -4-
